Home My Public Portal AboutOrd. 16-05I No. 16-5 [TL 14je llrag4 Of gart d, J Councilman Presents the following Ordinance Seconded by Councilman AN ORDINANCE OF THE BOROUGH OF CARTERET ADOPTING THE SALT MEADOW REDEVELOPMENT PLAN WHEREAS, the Local Redevelopment and Housing Law, N.J.S.A. 4OA:12A -1 et seq., as amended and supplemented (the "Redevelopment Law ") provides a process for municipalities to participate in the redevelopment and improvement of areas in need of redevelopment; and WHEREAS, on December 19, 2011, the Borough finally adopted Ordinance No. 1 1.29 authorizing a redevelopment plan for Block 602, Lots 1 and 8 and Block 705, Lots 3- 20.01, 21, 31, 32 and 48 (the "Original Redevelopment Area "); and WHEREAS, by Resolution No. 15 -174, duly adopted on November 5, 2015, the Borough reaffirmed the Original Redevelopment Area and included Block 602, Lot 7 and Block 603, Lot I within the area in need of redevelopment (collectively with the Original Redevelopment Area, the "Redeveloper Area "), and WHEREAS, by Resolution No. 15 -056, duly adopted on February 26, 2015, the Borough determined that the area consisting of Block 701, Lot I on the Official Tax Map of the Borough constituted an "area in need of redevelopment" in accordance with the Redevelopment Law (the `Redevelopment Area ") and further directed the Carteret Planning Board (the "Planning Board ") to prepare a redevelopment plan for the Redevelopment Area in accordance with the Redevelopment Law; and WHEREAS, the Planning Board caused to be prepared a redevelopment plan for the Redevelopment Area (the "Redevelopment Plan", a copy of which is attached hereto as Exhibit A); and WHEREAS, on January 27, 2016, the Planning Board adopted a resolution of findings and conclusions endorsing and recommending the Redevelopment Plan; and NOW THEREFORE, BE IT ORDAINED AND ENACTED, by the Borough Council of the Borough of Carteret, Middlesex County, New Jersey, as follows: Section 1. The recommendations of the Planning Board as set forth in its January 27, 2016 resolution are hereby accepted. Section 2. The Redevelopment Plan is hereby adopted as the official redevelopment plan for the Redevelopment Area. Section 3. The zoning district map of the Borough's Land Development Ordinance is hereby amended to reflect the applicability of the Redevelopment Plan to the Redevelopment Area and the Borough's Land Development Ordinance as it affects the Redevelopment Area is hereby superseded by the Redevelopment Plan to the extent set forth therein. Any and all ordinance or resolutions of the Borough, or provision thereof, inconsistent with the provisions of this Ordinance shall be and are hereby repealed as to the extent of any such inconsistencies. Section 5. If any section, subsection, part, clause or phrase of this Ordinance or the Redevelopment Plan shall be declared invalid by judgment of any Court of competent jurisdiction, such section, subsection, part, clause or phrase shall be deemed to be severable from the remainder of this Ordinance or the Redevelopment Plan, as applicable. Section 6. This Ordinance shall take effect upon final passage and publication in accordance with applicable law. Section 7. Upon the final adoption hereof, the Borough Clerk shall forward certified copies of this Ordinance to Matthew C.
