Motion to approve a Land Clearing Permit. B. Motion to approve a Special Exception to reduce the rear setback to 30'. C. Motion to approve a Level III Architectural/Site Plan Review, based on a finding that the proposed home is consistent with applicable review standards, with the following conditions: 1. A utility easement along the northern 15' of the property shall be dedicated prior to issuance of a certificate of occupancy. Site grading shall be constructed according to the approved Drainage Plan. 2. Revise trellis to comply with rear setback requirements [21/2' overhang permitted]. 3. The Construction Traffic Management Plan submitted with the application shall be followed during construction. 4. The cast -stone columns at the front entry shall be revised to smooth white columns. 5. The roof height shall be reduced [ from 21'6," discouraged range] to 20 feet [preferred range]. Basis for Recommendation: The proposed home appears to be consistent with applicable sections and the intent of the design manual. The design incorporates numerous preferred features of the Bermuda style (quoins, shutters, white tile roof, muttons, white trim, etc.) One -story homes are preferred in the Core District. Moreover, because the home proposed for demolition contains prohibited features, including a mansard roof, the new home should represent a substantial improvement to the property. The plans include a brick paver circular drive and a significant amount of new landscaping around the home. The existing 24 -foot Sea grape tree at the north side of the property will remain. ARPB # 000 -11, Page 1 SUGGESTED modifications While not mandated by the Design Manual, the following modifications or features are preferred and would result in a more traditional Bermuda appearance: • Please replace the cast -stone columns at the front entry with smooth stucco columns. • Please consider adding shutters to the north and south elevations. • Please reduce roof height to 20' to bring it into the preferred range (21'6" is in discouraged range) Special Exception for Rear Setback Special exception provisions allow for a reduction in the ICWW setback if necessary to achieve adequate buildable area. The review criteria require that the character of the area and water views must not be significantly impacted and that a more attractive design must result from the additional buildable area. The Special exception can be justified for the following reasons: 1. Adherence to a 50 -foot setback for all portions of the home would severely restrict the buildable area of the lot and would result in a less attractive building form. (most likely two - story) 2. Only one -story portions of the home will be located at a 30 -foot setback, in fact the entire home is one -story. 3. The orientation of the home is such that the water views of adjacent homes should not be significantly impacted. 4. The proposed design appears to meet all of the review standards, general and specific. Given the proposed home's overall adherence to the standards and intent of the Design Manual, it is recommended for approval. Additionally, the owner should be complimented for her willingness to dedicate a drainage utility easement along the northern 15' of the property. Trellis Setback A rear trellis is shown at approximately 25' from the ICWW. The required setback for principal structures would be 30', while minor accessory structures must be setback from the ICWW a minimum of 20'. Because the trellis is attached to the principal building, it is technically considered part of the principal structure and, thus, subject to the greater setback. Staff will be requesting ARPB input on this topic. Other Requirements that must be met prior to Building Permit or C.O. Issuance 1. The owner expects to connect to the GS Private Sewer. If this does not occur, the septic system must be approved by the Palm Beach County Heath Unit. 2. A four -foot high pool barrier shall be provided prior to issuance of certificate of occupancy. All chain link fencing must be completely concealed by plant material. Prohibited uses. (a) To promote the private, peaceful, residential enjoyment of property in the single family zoning districts in the town, and to protect these districts from the noise, traffic, congestion, crime and tumult associated with nonresidential uses, nonresidential uses shall be prohibited including, but not limited to, the following: (1) The conduct of any professional, business, occupation, or calling. (2) Home occupations and other home -based businesses. (3) Transient uses including, but not limited to, time- sharing uses, corporate retreats and property rentals with lease terms of less than three months. (4). Other nonresidential uses including temporary uses, whether or not they benefit charitable organizations, such as: Auctions and silent auctions Commercial still photography Commercial motion pictures/videos Display of items to be for sale at a later date Garage/yard sales Home tours and show houses Tag /estate sales Trunk sales and equivalent in -home display sales (5) Aircraft landing pads and strips, whether temporary or permanent. (6) Any other use not specifically permitted. ® (b) These prohibitions shall not extend to telephonic transactions and communications. Sec. 70.50. Private schools. Any private school conducted in any single family residential zoning district may continue to be used as such under the provisions of sections 66 =131 et seq. of this Code, provided however, that any private school building, or other structure used in connection with and as a part of and appurtenant in the operation and maintenance of such private school, may be replaced, or another building substituted in place thereof; repaired and maintained from time to time as shall be necessary for the effective operation and maintenance of such private school; and further, any development permits, orders or written agreements granted or executed by the town prior to the adoption of this chapter shall remain in full force and effect. Sec. 70 -51. Minor accessory structures. The following structures shall be considered as minor accessory structures in all five single family zoning districts subject to specific setbacks established in this chapter. Any structure which is larger or more intensive shall be subject to the same setbacks as the principal structure. (1) Detached, one -story structures of 300 square feet or less and 18 feet or less in height, including but not limited to: Garages/sheds Gazebos Greenhouses Guest houses ool cabanas/bathhouses Trelhses/arbors (2) Permanent recreation facilities, including but not limited to: Batting cages/backstops CD70:21 § 70 -100 GULF STREAM CODE Sec. 70 -100. Roof and eave heights. (a) Generally. (1) The height and number of eave lines and the overall height of a structure play an important role in establishing visual continuity with other structures on the street and maintaining an appropriate residential/human scale. Most structures in the town are characterized by simple roof designs with low to medium eave heights and roof heights. This type of design emphasizes the horizontal dimension of the structure while minimizing the vertical dimension. (2) Roof height is measured from the top of the first finished floor to the highest exterior point on the roof. Eave height is measured from the top of the first finished floor to the top of the roof beam at the end of the beam. Different eave heights establish different save lines. Two or more separate roof areas with the same save height are considered to have the same eave line. (3) Roof features can provide appropriate design articulation to a roof area, but should be used sparingly to avoid unnecessary and undesirable complexity. Roof features include, but are not limited to, chimneys, cupolas, decorative towers, dormers, and small cut -outs and extensions. Two or more dormers are considered to be one roof feature, as are two or more chimneys. (4) Entry features, if used, should provide a sense of arrival to visitors, yet should not overpower them or the remainder of the structure. The scale and proportion of entry features should be consistent f with the rest of the structure, varying just enough to provide a focal point to the front of the house. i r/'N One story homes. Eave heights: Less than eight feet or greater than 12 feet (greater than 14 feet for entry features) Eave lines: Five or more Roof features: Five or more visible per building side Roof heights: Greater than 24 feet (greater than 28 feet for roof features) (c) 71ao story homes.
