JULY 23, 1992
1 The Board of Public Works and Safety of the City of Richmond, Indiana, met in regular session on Thursday,
2 July 23, 1992 in said City. Thomas Milligan presided with Earnest Jarvis and Dennis Grimes in attendance.The
3 following business was had to-wit:

6 APPROVAL OF MINUTES OFJULY 16.1992

8 The minutes of the previous meeting were approved on a motion by Jarvis, second by Grimes and carried on a
9 unanimous voice vote.

11 APPROVAL OF CLAIMS FOR PAYMENT

13 Claims submitted by the City Controller were as follows: (a) $207,998.41 which included $56,403.43 for the
14 electric bill for the city building and street lights and $41,293.43 for group medical insurance premiums;(b)three
15 separate claims in conjunction with the Color Box project totaling $11,270.00; (c) $5,000 for the Police
16 Department; (d) $34,751.08 for payroll taxes and withholding; and (e) $15,170.00 for interest on Sanitary
17 District bonds. The motion for approval of the claims was made by Grimes, second by Jarvis and carried by a
18 unanimous voice vote.

20 REQUESTS

22 A. Jarvis reminded Board members of the recent visit of the Rev. Francis Daniels during which he
23 commended the Board for work being done in the Townsend Center area but pointing out the need to
24 look at the speeding problem. The problem was turned over to Captain Danny McClure of the Traffic
25 Division. Based upon a survey the Traffic Division recommended placing"School Zone"signs on North
26 12th and North 13th streets around Townsend Center; reducing the speed limit on North 12th and
27 North 13th streets between North H and North J streets to 20 m.p.h.; and putting three-way stop signs
28 at North 12th and "I" streets. Jarvis made a motion to approve the recommendations, second by
29 Grimes and carried by a unanimous voice vote.

31 B. A request from Reid Memorial Presbyterian Church read by Grimes, asked for temporary closing of
32 the alley next to the church between North 10th and North 11th streets the week of July 27 during the
33 church's vacation bible school. The Traffic Safety Division investigated the request and recommended
34 that it be granted. A motion to that effect was made by Grimes, second by Jarvis and carried by a
35 unanimous voice vote.

37 C. Tim Beck of Beck Welding Supply at 825 Liberty Avenue appeared before the Board to explain his
38 request to close South "I" Street between South 4th and Liberty Avenue between the hours of 7 a.m.
39 and 5 p.m. Friday,Aug.21,to accommodate a commercial products display. Signatures of residents on
40 South I Street had been secured and the Traffic Division had no objections to the granting of the
41 request. Jarvis made the motion for approval, second by Grimes and carried by a unanimous voice
42 vote.

44 D. Jarvis brought the Board's attention to a complaint received from the AS-U-LIKE Barber, Pipe &
45 Tobacco Shop at 7 East Main Street about the semi-trucks using its parking lot as a turn-around
46 causing damage to the blacktop. In the letter it was pointed out that the railroad overpass at that
47 location is only 13 feet and many trucks get trapped approaching the bridge and use the parking lot to
48 turn around. Captain Danny McClure noted that the state has placed signs on National Road West
49 warning that there is a low bridge ahead but no warning sign exists on West Main Street. McClure
50 recommended that the City place signs between 1st and 2nd streets on West Main Street. Jarvis made
51 the motion to approve the recommendation,second by Grimes and carried by a unanimous voice vote.

53 E. Handicapped parking requests approved on a motion by Jarvis, second by Grimes and carried by a
54 unanimous voice vote included a renewal for Kristi Dillon at 123 Richmond Ave. and a new space for
55 Maxine Brumley at 205 North 5th Street. A request for a renewal by Tom Wood at 402 North 19th
56 Street was denied because the residence has ample off-street parking consisting of a concrete parking
57 area and two-car garage. The motion to deny was made by Jarvis, second by Grimes and carried by a
58 unanimous voice vote.

60 CONTRACTS

62 A. Grimes reported that one bid had been received for the manufactured homes for the Infill Housing
63 Project in the Etta Lundy Subdivision on North 12th Street as a result of the advertisement July 1 and
64 July 8 in the Palladium-Item. It was from Jerry Jennings, owner and agent for D & J Mobile Homes.
65 Grimes opened the packet, passed it on to Milligan who noted all the papers were in order and then

1 handed it to Jarvis who read the bid.The total base bid was$359,743.58 which included $50,571.94 for
2 Unit A, $52,351.94 for Unit B, $54,666.94 for Unit C and $55,481.94 for Unit D. Expiration date of the
3 bid was August 23 and if accepted the work will begin within 14 days of the awarding of the bid and
4 completed within 120 days. Jarvis recommended the matter be taken under advisement, second by
5 Grimes and carried by a unanimous voice vote.

7 B. Bill submitted for payment from Barrett Paving was brought to the Board's attention by Grimes who
8 noted it was a progress payment on the Dana Parkway project for $78,876.01 which is at 38 percent
9 completion. Grimes made the motion for approval of the payment by the Board, acting as agent for
10 Star Bank,trustee of the bond proceeds of the TIF bond, second by Jarvis and carried by a unanimous
11 voice vote.

13 C. Jarvis read a letter received from the Indiana Department of Highways containing a three-year
14 sweeping agreement covering 8.40 miles of U.S. 27, 9.20 miles of U.S. 40 and 11.40 miles of State
15 Road 227, at the rate of $300 per curb mile bringing the total to$8,700.Jarvis said Bill Smith, manager
16 of the Street Division, noted the agreement was the same as in the past and the amount did not
17 increase. Jarvis made the motion to accept the agreement, second by Grimes and carried by a
18 unanimous voice vote.

20 ORDINANCE VIOLATIONS

22 A. Milligan said each of the Board members had been given a report filed by the Richmond Police
23 Department about an incident involving a pit bull dog determined to be a dangerous and vicious dog
24 under section 91.17 of the Richmond Code by the Board of Works in 1991. Milligan noted that under
25 that section the Police Department is permitted to make a determination that a dog is vicious and that
26 would then require the owner to comply with the provisions of the vicious dog ordinance. This, Milligan
27 said, occurred in 1991 and the owner had filed an appeal with the Board of Works and after the hearing
28 it was determined that it was a vicious dog. The same dog was involved in another incident the night of
29 Saturday, July 18, and as a result a police officer was bitten. The Police Department requested the
30 Board to determine whether or not the owner had complied with the requirements of the ordinance and
31 asked the Board to impose sanctions.

33 Milligan noted that a violation of this ordinance could be prosecuted in Wayne Superior Court No. 3,
34 however, the Board of Public Works and Safety can impose sanctions. The sanction being requested
35 by the Police Department was that the dog be destroyed. Milligan said the dog is impounded at the
36 contract shelter at the present time.

38 The hearing will be conducted at next week's meeting, July 30, scheduled to begin at the regular time
39 of 9 a.m. The owner will be notified of the hearing by letter and at that time the Board will hear from the
40 police officers involved,the dog owner or any other interested parties.

42 OTHER MATTERS

44 A. Grimes read the June report from the Fire Department in which it was noted that fire extinguisher
45 training and fire safety classes had been conducted at several agencies which included Hill's Pet
46 Foods, Richmond State Hospital, Golden Rule Nursing Home, Dana Corp., Heritage Regency,
47 Townsend Center and Fairview Baptist Church. The Department also participated in organizational
48 meetings for the July 4 fireworks and monitored Rose Festival activities which included the inspection of
49 all the concessions and vendors.

51 B. The Board acted on a recommendation received from Fire Chief Jim Sticco for the promotion of
52 Chester Kirkman Jr. to engineer. Sticco said Kirkman had been on the department six years and has
53 been an outstanding firefighter. He added that he will be a probationary engineer for six months. Based
54 on Sticco's recommendation Grimes made a motion for approval, second by Jarvis and carried on a
55 unanimous voice vote. Milligan pointed out that the Fire Department promotions and designations of
56 rank are within the purview of the Board of Works. However,the Police Merit Commission serves in that
57 capacity for the Police Department.

59 C. McClure introduced Janice Passmore as the new sergeant of the traffic division.
