JANUARY 16. 1992 1 The Board of Public Works and Safety of the City of Richmond, Indiana, met in regular session at 9 a.m. 2 Thursday, January 16, 1992. Thomas Milligan presided with Earnest Jarvis and Dennis Grimes in attendance. 3 Absent: None. Media in attendance: Cable 16, the Palladium-Item and WKBV. The following business was had 4 to-wit: 5 6 APPROVAL OF MINUTES OF JANUARY 9.1992 7 8 Grimes asked for corrections of the January 9, 1992 minutes on line 10 of Page 2 to read "design" instead of 9 "construct" and line 14 of Page 2 to read "above road project" instead of "Twentieth Century Bridge." Jarvis 10 made the motion to accept the minutes as corrected, the motion was seconded by Grimes and unanimously 11 passed. 12 13 APPROVAL OF CLAIMS FOR PAYMENT 14 15 Claims submitted by the City Controller for $881,517.67 were unanimously approved after a motion by Grimes 16 and a second by Jarvis. 17 18 PUBLIC REQUESTS AND COMMENT 19 20 A renewal of an application for residential handicapped parking from Mary Archambault at 308 N. 19th Street, 21 Apartment A, submitted by the Richmond Police Department, was unanimously approved after a motion by 22 Grimes and a second by Jarvis. 23 24 TABLED ITEMS 25 26 None were presented. 27 28 DEPARTMENT REQUESTS AND COMMENT. 29 30 DEPARTMENT OF PLANNING.PERMITS AND INSPECTION 31 32 Hearing under Indiana Code 36-7-97 for order dated December 19. 1991 issued to L & S Properties. Inc. 33 for premises located at 415 South 10th Street, Richmond,Indiana. 34 35 Board members heard comments from Dana Leas, inspector with the Department of Planning, Permits and 36 Inspections. As stated in the written order issued to L & S Properties, Inc., 4372 Webster Road, addressed to 37 Paul Land, concerning the property at 415 South Tenth Street deemed to be unsafe, she noted that the owner 38 had been directed by letter to demolish and remove the house and accessory building within 30 days of receipt 39 of the order. 40 41 Leas asked that the demolition order be rescinded since the property has been purchased by Michael E. Basso 42 and he has received a building permit to repair the house. Milligan requested Basso to submit a written proposal 43 for making the improvements necessary to satisfy the applicable codes and the time schedule for completion 44 thereof. On a motion by Jarvis, seconded by Grimes and a unanimous vote, the matter was taken under 45 advisement. Milligan directed the Department of Planning, Permits and Inspection to place building permits in its 46 files noting that any action by the city with regard to improvements commits the city and changes the status of 47 whatever violation is concerned. 48 49 Hearing under Indiana Code 36-7-97 for order dated December 23, 1991. issued to Elza and Lucille 50 Doolln for premises located at 111-113 North 14th Street. Richmond.Indiana. 51 52 Leas reported that Elza and Lucille Doolin of 1307 Ridge Street, had been notified by the Department of 53 Planning, Permits and Inspection of unsafe conditions of a property they own at 111-113 North 14th Street which 54 prompted the department to order the removal of unsafe rear steps, repair of rear porches and other things as 55 needed such as relocating electric services. She said no communication had been received from the owners 56 other than the signed notice that they had received the notification. 57 58 She said her department was not asking that the building be sealed because that would mean relocating four 59 families residing in the building. She asked the Board's permission to use the unsafe building funds to demolish 60 the porches and steps and hire an electrician to move the hot water heater and the service electrical center 61 inside the house. Milligan suggested the Board take the matter under advisement and asked Leas to prepare a 62 proposal for repairs, with estimates, and the Board will determine if competitive bids are needed. He said the 63 Board will order the owner to appear for a discussion and determine who would be responsible for making the 64 repairs,adding that obviously the owner will be responsible for payment. 65 90 Board of Works Minutes Cont'd January 16, 1992 Page 2 1 2 The Board heard statements from Nancy Toler, a representative of Starr Neighborhood, requesting action by the 3 Board. She noted the condition of the back stairs was dangerous, especially to the children who played there. 4 She said the Starr Neighborhood group has written several letters of complaint to the owners and to the Planning 5 Department. It is not that group's intent to see the house boarded up but for the necessary repairs to be made to 6 make the building safe. A motion to take the matter under advisement was made by Jarvis, seconded by Grimes 7 and was unanimously passed. 8 9 PENDING MATTERS 10 11 Milligan noted a matter pending before the Board which involved HELP the Animals, Inc. was lacking further 12 communication from Carolyn Blakey, President of HELP. 13 14 MISCELLANEOUS COMMUNICATIONS 15 16 Milligan noted that he had received the 1991 year-end report prepared by William Smith, manager of the Street 17 Department, concerning activities, maintenance and repair of the city street system. Milligan added that the 18 street system represents the largest single property asset that the Board of Works has the authority under 19 Indiana law to oversee and he suggested that after the Board has an opportunity to study the report that perhaps 20 Smith could be invited to give a briefing on the action of the street department at some later date. 21 22 23 ADJOURNMENT 24 25 A motion to adjourn by Grimes was seconded by Jarvis and unanimously passed. 26 27 28 29 30 31 32 33 34 Thomas Milligan, President 35 36 37 38 39 ATTEST: 40 41 Norma Carnes, City Clerk 42 43 44 45 46 47 48 49 50 51 52 53 54 55 56 57 58 59 60 61 62 63 64 65
