CITY OF RICHMOND. INDIANA. NOVEMBER 14. 1991
1 The Board of Public Works and Safety of the City of Richmond, Indiana, met in regular session November 14,
2 1991, at the hour of 9:00 A.M. in the Municipal Building in said City. Ms. Hauptstueck presided with Mr. Smith
3 and Ms. Planck in attendance. Absent: None. Media in attendance: Palladium Item and WKBV and WCTV
4 Cable 16. The following business was had to-wit:

6 APPROVAL OF MINUTES OF NOVEMBER 4. 1991

8 Mr.Smith moved to approve the minutes of the previous meetings as prepared,seconded by Ms. Planck and on
9 unanimous voice vote the motion was carried.

11 APPROVAL OF CLAIMS FOR PAYMENT

13 Mr. Smith moved to approve claims in the amount of 398,331.45 for payment, seconded by Ms. Planck and on
14 unanimous voice vote the motion was carried.

16 PUBLIC REQUESTS AND COMMENT

18 Reserved Residential Handicapped Parking

20 231 North 17th Street-New
21 506 South 5th Street-Renewal

23 Sgt. Kolentus informed the Board that the requests meet all of the guidelines and he recommended approval of
24 the requests as presented.

26 Ms. Planck moved to approve the requests for reserved residential handicapped parking at 231 North 17th
27 Street, and 506 South 5th Street, seconded by Mr. Smith and on unanimous voice vote the motion was
28 carried.

30 Curb Cut Request-911 South L Street

32 Mr.Wiwi informed the Board this request was for the Village Pantry parking lot and he recommended approval.

34 Mr. Smith moved to approve a curb cut request at 911 South L Street, seconded by Ms. Planck and on
35 unanimous voice vote the motion was carried.

37 Reserved Residential Parking District-100 Block of SW G Street

39 The Board received a petition from the residents of the 100 Block of SW G Street to designate the area a
40 Residential Parking District. It was noted that all of the residents but one signed the petition.

42 Mr. Smith moved to set December 12, 1991 for a public hearing on the petition for a Residential Parking District
43 and to request the Traffic Division to provide the necessary information, seconded by Ms. Planck and on
44 unanimous voice vote the motion was carried.

48 Smoke Free Workplace Petition

50 Ms. Hauptstueck requested clarification from the City Attorney regarding who would make this determination.

52 Mr. Metzger informed the Board that State law designates an official to set policy, but does not define who that
53 official is. he said the Board is given control of all real and personal property for the City and he felt the Board
54 has control.

56 Ms. Planck asked if that included vehicles and Mr. Metzger said it did.

58 Ms. Hauptstueck asked about the Uniform Fire Code and Chief Sticco told the Board that it only addresses
59 compliance with No Smoking signs and the Fire Department does not have authority to designate areas.

61 Chef Sticco said that Indiana Code says the City shall designate non-smoking areas and may designate
62 smoking areas.

64 Ms. Planck asked who enforced that and Mr. Metzger said there is no designated individual and the Board would
65 ultimately enforce,and it would be practically difficult to enforce.

1 Ms. Planck asked if the penalty would have to remain a Class C Infraction or could the Board designate other
2 penalties.

4 Mr. Metzger said it could be handled by a discipline procedure and would be handled by the Department Heads
5 and the Mayor.

7 Ms. Hauptstueck asked if Officer Carrico had contacted other offices in the City to sign the petition for a Smoke
8 Free Workplace and Officer Carrico presented a petition with a total of 86 signatures in favor.

10 Officer Carrico told the Board that until 1988 the Police Department manual referenced smoking areas,but it was
11 never enforced and he agreed that each Department Head would be responsible for enforcement.

13 Ms. Planck asked how many people he had contacted and he stated all sworn officers and most city employees
14 and that one or two in each office did sign the petition. Officer Carrico told the Board he has not confronted
15 Chief Rice directly or afford his the opportunity to act on this prior to taking it to the Board of Works.

17 Speaking in favor of a Smoke Free Workplace was Ms. Donna Chapman, Planning, Permits and Inspection. Ms.
18 Chapman said that smoking does hurt those around and even though she does not smoke her Doctor detected
19 damage to her lungs from being around smokers. Ms. Chapman said that her habit of eating chocolates does
20 not hurt anyone else around her and asked the Board to designate non smoking and smoking areas. Ms.
21 Chapman did compliment the Planning Department for showing her consideration in not smoking around her.

23 Firefighter David Stout told the Board that some courtesy needs to be involved in this issue. He explained in
24 other places employees are offered ways to help them quit smoking and he felt this decision might be premature
25 and there was a need to take other thing into consideration.

27 Mr. Russell Doran told the Board he felt it was a little late in this administration and felt that the Mayor's prior
28 policy of designated areas should be reestablished.

30 Ms. Jane Brookbank told the Board that Reid Hospital has made the decision to go to no smoking in 1992 with
31 the exception of an outdoor area. She said that Reid, Hills Pet Products and Belden all have non-smoking for
32 insurance reasons. Ms. Brookbank told the Board that she finds the building offensive smelling and that she did
33 realize that smokers needed some incentives to assist them quit smoking.

35 Officer Jon Carrico said the City is self insured and the insurance fund is hurt by smoking related illnesses. He
36 said he would like to get areas designated outside the building and not wait for a change of administration.

38 Mr. Mike Allen, Fire Department, said he was sympathetic and new how difficult it was to quit smoking. He said
39 said the Board does need to designate smoking areas to get the smokers away from the non-smokers and then
40 offer incentives to quit.

42 Mr. Jerry Purcell, Fire Department, told the Board that 15 out of 86 Firefighters smoke and he encouraged the
43 Board to consider incentives for quitting. He said their department was different because of the 24 hour shifts
44 and the Fire Houses became their homes.

46 Chief Sticco explained that smoking areas in the Fire Houses are determined by the majority of the men on a
47 particular shift. He said if the majority determines no smoking in the living areas, they are allowed to use the
48 wagon room.

50 Mr. Gilbert, Richmond Park Department, told the Board that people who do not smoke often have the same
51 problems as smokers.

53 Ms. Sharon Burkhardt, Controller's Office, told the Board with the current stress because of the change of
54 administration,this should be left alone until the first of the year.

56 Ms. Planck asked Ms. Brookbank if Reid had accommodations for cigarettes butts in their outside area and Ms.
57 Brookbank said that was one of the reasons for creating particular areas.

59 Ms. Hauptstueck asked Mayor Waltermann about designated areas and Mayor Waltermann said the third floor
60 break room and certain hall way areas had been designated.

62 Ms.Terri Quinter, Rose View Transit, asked the Board to designate areas in other buildings also.

64 Ms. Nanette Smejkal, Park Superintendent, informed the Board that the Park Board was addressing the issue
65 and they would be establishing their own policy even if a city wide policy is not established.

1 Mr. Stout told the Board he found designating an outside area demeaning and it would not be that expensive to
2 provide a properly ventilated area.

4 Ms. Debbie Miller, Richmond Police Department, encouraged the Board to designate no smoking since she has
5 asthma.

7 Ms. Mary Margaret Campbell, Richmond Police Department,told the Board that even with designated areas,the
8 smoke does seep into other offices.

10 Ms. Carol Brady, Clerk's Office, stated that even smokers are offended by walking into areas not properly
11 ventilated.

13 Mr. Chris Barker, Planning, Permits and Inspection, told the Board that the Building provides 2000 cubic ft. of
14 fresh air per hour. He said he was also curious about insurance claims and how they were affected.

16 Ms. Hauptstueck said that non-smokers health is better, but she was uncertain of the number of claims that
17 could be attributed to smoking.

19 Sgt. Kolentus told the Board that the Police Department was also a difficult issue by virtue of their working
20 conditions. He said that in a public building where employees come in contact with the public they might
21 consider it smoke free, but that cars and private areas would be different. Sgt. Kolentus also felt that education
22 might be an additional expense and not a good idea.

24 Ms. Planck said that public access was not what this issue was about, but rather fellow employees who do not
25 smoke.

27 Ms. Hauptstueck said that the Chief's Office did receive a letter from the pubic about the smoke in the building
28 on election day.

30 Chief Sticco said he felt that a heavier penalty does need to be researched. He suggested a committee might be
31 formed to meet with each department and see their various needs.

33 Ms. Hauptstueck asked if the Board felt comfortable making a decision today and Mr. Smith said he felt the
34 Department Heads need to be involved and felt it might take a couple of weeks to complete this.

36 Ms. Hauptstueck said she did not want to hold this decision up very long and Mr. Smith agreed, but felt they
37 should take some time now to get additional information and input.

39 Ms. Planck agreed they needed a deadline and felt two week should be the maximum time allowed.

41 Mr. Smith moved to leave the Smoke Free Workplace item tabled for two weeks, seconded by Ms. Planck and
42 on unanimous voice vote the motion was carried.

44 Standard Operating Procedure for use of Fire Vehicles

46 Chief Sticco requested the item be tabled for one more week.

48 Ms. Planck moved to leave the item on the table for one week, seconded by Mr. Smith and on unanimous voice
49 vote the motion was carried.

55 Fire Prevention Monthly Report

57 The Monthly Report for Fire Prevention was presented and there being no comments or questions, Mr. Smith
58 moved to accept and file the report, seconded by Ms._Planck and on unanimous voice vote the motion was
59 carried.

63 Change Order No.1 -Central Garage Complex

65 Mr.Wiwi informed the Board it was necessary to for a change order for the site work for the central garage

1 complex because of differing soils and piping necessary for the catch basin. He said it was a reduction in the
2 total cost of the work.

4 Ms. Planck moved to approve and execute Change Order No. 1 for the Central Garage Complex Site Work,
5 seconded by Mr. Smith and on unanimous voice vote the motion was carried.

7 CLERK'S OFFICE

9 Satisfaction and Release of Mortgage

11 Ms. Merchanthouse explained this was a release of mortgage on a paid in full Home Equity Loan for Edna
12 Spicer.

14 Ms. Planck moved to approve and execute a Release of Mortgage for Edna Spicer, seconded by Mr. Smith and
15 on unanimous voice vote the motion was carried.

17 POLICE DEPARTMENT

19 Set Date for Auction of Confiscated Items

21 Major Jack Myers asked the Board to set December 7, 1991 for an auction for confiscated articles. He stated al
22 have been held the appropriate length of time and there are many different items available for the auction.

24 Mr. Smith moved to set December 7, 1991 for the auction for confiscated item by the Richmond Police
25 Department,seconded by Ms. Planck and on unanimous voice vote the motion was carried.

27 Resignation of Jay Allen Turner

29 Major Farmer presented the resignation of Probationary Patrolman Jay Allen Turner to the Board and explained
30 he was leaving the City of Richmond.

32 Ms. Planck moved to accept the resignation of Jay Allen Turner effective November 8, 1991, seconded by Mr.
33 Smith and on unanimous voice vote the motion was carried.

37 1992 Holidays

39 The proposed holidays for City employees not represented by a bargaining unit were presented for approval.

41 Mr. Smith moved to approve the paid holidays for 1992 as presented, seconded by Ms. Planck and on
42 unanimous voice vote the motion was carried.

44 COUNCIL REQUESTS

46 16th and East Main Traffic Markings
47
48 Ms. Hauptstueck noted that Councilmember Morris had inquired about the lane markings at the intersection of
49 16th and East Main and Mr.Wiwi indicated discussion of this was brought up at the final inspection of the project
50 and the State would be responsible for the markings. He said he would follow up on the request.
