I am in receipt cf your letter of June '19, 2001. I have done and will continue to do rn«
very best to work cooperatively with you and the City of WKali, despite continued
criticism at every turn. We have acted and will continue to act reasonably and
professionaliv.
You repeatedly state that I don't "understand". that 1 don't have "accurate information,
and that information I do have has been "filtered", 1 require Mr. Eigler's expertise in
order for me to act knowledgeably. John Eigler :s one of the most respected surety
consultants in the business, and has worked closely for Wausau on this project just as
he has for innumerable projects for some decades in the past. The procedures we have
implemented for his consulting work are customary. t have not previously had anyone
suggest his contributions to a project to be less than exemplary. Bearing these
thoughts in mind, and respectfully considering the difficulty the City and its engineers
have had in dealings with others, I do not feel your assertions are accurate. Please do
explain any construction details causing concern to Mr. Eigler and he will frankly relay
those concerns to me. I have your letters as well, and if additional information is
necessary please feel free to correspond with any further explanation required.
You insist that our only options on the wet well are to sign proposed charge order #3 or
tear out the wet well and install the penetration under the original specifications. You
state that we are not correcting the °defective" work although we have been directed to
do so. You suggest that the wet well must withstand the pressure of 288 million gallons
of effluent. Based or these comments ! could just as easily point out that you don't have
accurate information, ana that you don't understand the situation. 1 respectfully
observe that there are other options available. and we are working on those options
now; that we have not received a directive describing any specific physical work to be
done on the wet well; that physical work would have already been done on the wet we:I
had your engineer allowed it; that we have been evaluating and re -scheduling additional
wet well work; and that its not meaningful to suggest that the wen well penetration end
piping will carry pressure equal to 228 million galiorls of effluent.
Mr. Eigler will attend the substantial completon tour as our consultant. r ve worked very
closely with him and plan to continue to do so. As i advised you several days ago, we
are in the process of re -scheduling additional work on the wet well and will .advise you
with details as soon as a schedule can be re-establshed.

I received this from Interwest. I did not know what it was until I spoke with
Prather and Eigier and they both indicated that this is a proposed contract
price adjustment that would be part of a change order that would allow the
owner to accept defective work. The defective work is the geocomposite.
The specifications required that testing be performed as part of the
Quality Control program. This testing was riot performed. When you
have a minute, please call so that we can discuss.

Work Change Directive #2
Serrot International shall perform an inspection of the repairs to the liner that have been
performed by other liner subcontractors. The purpose of the inspection shall be to
determine what measures are necessary for Serrot to warrant the work of others as if
Serrot performed it.
If after the inspection, Serrot determines that additional physical measures are required,
up to and including complete removal and replacement, Serrot shall perform the work in
accordance with the following requirements.
• Liner material required for the repair work will be provided by the
Owner. 60-mil HDPE as manufactured by Serrot international.
• Extrusion Joint Resin: High density polyethylene the same as the sheet
resin with the same physical characteristics.
• Verify that pond surface is raked smooth, free of all sharp rocks or other
sharp objects, vegetation and stubble and acceptable to receive liner rind
geocomposite.
• Verify the suitability of geocomposite installation for liner installation.
■ Verify that all cracks and voids in the surface arc filled.
■ Verify that pond surface is free of water and mud,
• Provide written certification that pond surface is acceptable for the liner
and geocomposite. Placement of liner on subgrade constitutes acceptance
of subgrade.
• Inspect stored liner sheets and geocomposite to verify sheets have not
been damaged in storage or handling.
• Have on -site, All equipment, personnel and supplies necessary to
complete the installation in a workmanlike manner.
• Use extrusion welding process for making field joints in HDPE liner.
• Clean contact surfaces of all dirt, dust, moisture or other foreign
materials.
• Perform destructive testing of seam, including tensile and peel
tests; at the start-up of each seaming operation, including the
beginning of each work day and anytime equipment is shut off for
30 minutes or longer. Test may be run with scrap material.
■ A test will be considered satisfactory if initial elongation
occurs in the liner material at a location other than the
seam. The shear and peel test values must be equal to
those for the raw material.

• Apply sufficient molten high density polyethylene extrudate along
the seam to both contact surfaces to create a strong homogenous
weld.
• Maintain resin temperature as it emerges from the extrusion die at
428° F to 536' F and measure temperature at least once per four-
hour period with a pyrometer.
• Completely seal all joints.
+ Protect liner from damage at all tunes during installation.
• If required by climatic conditions, provide temporary enclosures to
provide conditions conducive to welding liner,
• Visually inspect entire liner surface in work area and all seams.
• Test ail extrusion welds in HDPE liner with a vacuum box_ 5 psi. The
vacuum box shall be kept stationary at each location for a period of no
less than 5 seconds while examining for holes in the seam.
• Repair seams in the geocomposite shall be completed using cable ties
spaced at 6" intervals along the seam length.
• Perform work in accordance with Serrot International's Quality Control
Manual for the installation of HDPE geomembrane.
• Defects identified shall be repaired or replaced by the Contractor at no
additional cost to the Owner.
If portions of the liner are removed for repairs or to examine the subgrade and it is
determined by Serrot, in conjunction with the Engineer, that repair of the subgrade is
warranted, repairs will be performed. The requirements for performing this work arc
presented below:
• Grade pond surface smooth, remove all ruts, depressions or other
irregularities in the subgrade.
+ Perform all work by hand using hand tools. Use of mechanical
equipment will require the equipment be moved across the lined surface
in an acceptable manner.
+ Grade subgrade flush with the existing concrete penetration pad,
• Grade slope to match surfaces to remain and concrete penetration pad.
+ Provide written certification that surface is ready to receive the liner and
geocomposite. Placement on subgrade constitutes acceptance of
subgrade.
• Present damage to adjacent liner and geocomposite
Purpose of Work Change Directive:
Contractors Northwest, Inc., as part of their agreement with the Owner, has
attempted ro hydrostaticall.v test the primary wet well. During this attempted test, the wet
well leaked and it appears that water escaped the primary wet well and traveled through
the embankment, along the conduit created by the inlet pipeline bedding. This water
ultimately exited the slope face underneath the liner. Damage resulted, and ruts could be

seen. on the reservoir slope subgrade. The extent of the rutting under the concrete inlet
penetration. pad was unknown at the time, but it was believed that it would require repair.
Leakage through the concrete pad had resulted in water collecting in the HDPE
penetration boot.
The resulting damage to the reservoir jeopardized the City's ability to comply
with the Consent Order. i-f the damage was not corrected immediately, the reservoir level
would have continued to rise and access to the damaged area would have become further
restricted. If the damage was rot corrected, further, more extensive damage could have
resulted as the reservoir was filled through the winter and access to the damaged area
would have then been even more difficult.
Wausau was given notice of the defects and the need for a quick response to avoid
potential damages. Waaaau failed to respond in a fashion that allowed the damaged
work to be corrected in a timely manner. Discussions with legal counsel for Serrot
International, the liner subcontractor, revealed that Serrot was of the position that they
were owed money on their subcontract and were not inclined to return to the job for
repair work until these issues were resolved to their satisfaction. Because of'issues
associated with the warranty, Serrot was the preferred company to perform work on the
liner. However, Wausau was unable to resolve the issues they had with Serrot and it
seemed unlikely that a resolution would be reached in the time frame necessary to correct
the damage without additional damages as a result of the delay. The City elected to issue
Work Change Directive 41 that allowed Contractors Northwest to move forward with the
repairs utilizing the services of 3 liner subcontractor other than Serrot.
Wausau has now indicated that Serrot is available to implement any necessary
repairs. While others have already performed the work, the City desires for the entire
liner system to be warranted by one installer under the conditions of the Contract
Documents for the City of McCall, Idaho, T-Ditch — Phase 2 Project. This work change
directive has been issued to allow Serrot to perform the necessary inspections and repairs
to allow them to warrant the repair work in the same manner as the other work performed
for the Ciry of 'McCall, Idaho, J-Ditch — Phase 2 Project.
