Dear Mr. Golus:
The City has contracted with CNI to correct defective work that Wausau has refused to
correct. Please note that the City reduced payment to Wausau to reflect the cost of this
correction, which will prevent dual payment for the same work. Payments to Wausau
were further reduced by additional liquidated damages, resulting in the City receiving
more funds than we have valid claims to pay. Accordingly, we will return those funds,
Tess the amount in application #22.
Listed below is a breakdown of BOR funding for the project:

Expenditures 10/00 — 03/01 $1,854,400
Funds returned to BOR $ 549,992
Revised Funds available $1,695,620
Expenditures 07/01 — 09/01 $1,501,811
Federal Funds Reclamation expended $ 62,000
Funds available 10/01/01 $ 131,809
BOR funds on hand that can be applied to application #22 for $50,354 upon BOR
approval, leaving funds to be retumed to BOR of $546,271.
Revised Funds Available $ 678,080.

Dear Mr. Golus:
Work has re -commenced ❑n the J-Ditch project. We are processing
application for payment number 8 and will be forwarding it to you shortly. The
Surety, Wausau, has opted to not use the number 7 in the series, as this was
an application that the defaulted contractor had attempted to use. By not
using the number 7, it reduces confusion. Listed below is a breakdown of
BOR funding for the project.
