Subject:Chapter 119 Request - Records - Arrests for Trespassing in the Town Hall& Disorderly
Persons in the Town Hall
Please provide copies of any records wherein charges were brought forth by Gulf Stream against any party (excluding
Martin O’Boyle) for
1. Trespassing in the Town Hall; or
2.Being a Disorderly Person in the Town Hall
I’m assuming that there are no such records. I’m sure a quick polling of the Department members will get you to “there
are no responsive records”, whereupon we are done. If there are records, you’ll let me know the cost or I will put up the
$250 (and I think you are holding in excess of that amount).
Please confirm that this request os in process.
Thank you!

Dear Martin E. O’Boyle [e-mail to: meo@commerce-group.com]:
The Town of Gulf Stream has received your public records request dated June 2, 2019. The
original public records request can be found at the following link:
http://www2.gulf-stream.org/weblink/0/doc/158732/Page1.aspx
Under the settlement agreement, you agreed to pay a $250 facilitation fee at the time a public
records request was made. Pursuant to that agreement, “failure to pay the facilitation fee will
conclusively render such public records request withdrawn.” We consider this public records
request withdrawn.
Please be advised that the Town has not charged anyone for trespassing in the Town Hall or being
a disorderly person in the Town Hall since January 1 of this year.
Sincerely,
Reneé Rowan Basel

Renee – thank you for your email below. I’m inclined to object to providing you with he $250 “Facilitation Fee” for this

Please let me know if you are refusing to provide me with a response to this request for records. Of course, if you
advise that any such records exist, I will reconsider your request to pay the $250 Facilitation Fee.
Until I hear from you, please accept this letter as formal notice (pursuant to Ch. 119.12(1)(b) Notice) that if we do not
receive a full and complete response to the referenced Records Request within five (5) business days from the date of
this email, we will institute a formal legal action against you, unless an agreed upon reasonable extension is requested
and granted.
