SPECIAL MEETING
BOARD OF PUBLIC WORKS AND SAFETY OF THE
CITY OF RICHMOND, INDIANA, JUNE 3, 1991
1 The Board of Public Works and Safety of the City of Richmond, Indiana, met in special session June 3, 1991 at
2 the hour of 9:00 A.M. in the Municipal Building in said City. Ms. Hauptstueck presided with Ms. McFarland in
3 attendance. Absent: Mr.Smith . The following business was had to-wit:

5 DECISION AND ORDER ON VICIOUS DOG HEARING

7 Ms. Hauptstueck explained that the Board was in session to issue a determination in the case of William
8 Hengstler for owning a vicious dog as determined by the Richmond Police Department.

10 Ms. McFarland stated she had some comments and concerns about the case before giving the determination.
11 She was concerned that dog is dangerous no matter what the circumstances. Mr. Hengstler stated continually
12 in the hearing that he has no control over the dog when it is outside of the house and that the dog may cause
13 injury to someone again. Mr. McFarland stated that she had visited the dog and it seemed friendly.

15 Ms. Hauptstueck stated that taking everything into consideration the dog has a tendency to be dangerous. The
16 attack on the Police Officer was a vicious attack.

18 Ms. Hauptstueck made a motion to uphold the Police Department determination that the dog "Bandit"owned by
19 William Hengstler, be declared dangerous and vicioius and not destroy the dog but to abide by the alternate
20 rules of Ordinance No. 11-1990 which set out regulations which must be followed when a dog is determined
21 dangerous or vicious, seconded by Ms. McFarland and on a unanimous voice vote the motion was carried.

23 Ms. Hauptstueck asked Mr. Hengstler if he was familiar with regulations and he stated he was but that he has
24 been unable to locate an isurance company that will provide the coverage required. Officer Glover will assist in
25 providing information to meet the requirements.

27 Mr. Hengstler was reminded that if all the conditions are not complied with that a$2,000.fine would be assessed
28 for each violation. The animal will remain impounded until all the conditions are met. The Police Department wil
29 make regular inspections to see that the owner of the animal continues to comply.
