The purpose of my review was to verify the structural components installed were in general conformance with the structural drawings. I offer the following for your use. OBSERVATIONS Throughout the construction process I have made several routine reviews and addressed questions from the contractor, reviewed submittals, and approved substitutions for specified components. These substitutions included a cable tie -down system in lieu of the anchor rod system. reviewed the installation of the cable tie -down system with you and the contractor. A few locations did not allow continuous top plate to foundation installation. At these locations, the contractor was instructed to offset the cables between floors. Due to unforeseen conditions with the cable system, the contractor installed anchor rod tie - downs in several locations. I directed additional flat strapping to be installed to complete the jamb- header -top plate continuous load path for the larger windows located on the living room level. This is a confusing scenario concerning an extended period of time with multiple Charter amendments and the absence of specific information concerning the property in question over time. However, the earlier conclusion was that it appeared that the structure was placed on the property when there was at least some provision in the Charter that likely dealt with the seawall setback issue and, therefore, it seemed likely that the provision was not applicable or thought to be applicable at the time of the original construction. That being the case, I don't think it could be applicable now in the absence of additional information not readily available. Please let me know if you have any further questions or would like to discuss this further. The city's charter was amended in 1891 to empower the mayor & council to to establish the limits of streets & the "way known as the strand" & to give authority to convey by ordinances to the abutting owners of lots fronting the stand, the portion of land between their lots & the new boundary of the strand. I do not know if records exists which would establish the boundary. the charter was amended in 1941 (Georgia Laws,pg 1748) to give authority to the Mayor & Council to transfer by resolution to any property owner who contributed an aliquot part of the cost of the erection of the sea wall, from the ..comer of Second Street to the ..,corner of Fourteenth St. along the Strand all of the city's interest to that portion of the Strand which remains abutting the property eastwardly to within 1 8f of the sea wall & the owner so contributing shall have the right to obtain a deed, provided the Mayor & Council and the property owner shall not utilize the 18ft area abutting on the sea wall & the land so deeded except for purposes of repair Wor maintenance of the sea wall & groins. The 1941 amendments were repealed in 1945, following amendments in 1943 that authorized a special assessment for certain activities.) do not presently have access to the 1943 Act, but the 1945 Act continued an tax for beach purposes. The charter of 1970 contained the same provision as is found it the current charter. Maps over the years have referred to the "strand",as I read them, as going as far south as 19th.& thus would seem to include the area of Mr. Damadlan's property There has been an indication that Mr. Demarjian's house was built following construction of the sea wall. To me this indicates that the charter provision in whatever form it may have existed at the time was not thought to be applicable to the situation.This may be because the charter provision was not thought to apply to this situation or similar situations where there may have been no conveyance or where the sea wall was westward to the strand. That is the way the 1941 section reads as i understand it. Given the fact that the house was built after there were provisions dealing with the strand in the charter, 1 am inclined to conclude the provision is not applicable to this tot. There are other sources of information which could impact this & the one I would most like to review would be the title history of Mr. Damarjian's property. It likely would not answ3er the question either but we could at least determine where the lot line was before the sea wall was put in. I knew from earlier issues that many property owners at the time (1936 or so) granted construction easements to the city & the Works Progress Administration to allow the construction. I guess the bottom line based on current information though is that the set back would only need to be 10ft off the lot tine- which is now the sea wall- at least in the absence of any other restriction of record. I have now seen Mr. Damarjian's email of today regarding the binding effect of letters from the city or DNR Such letters are of different Impact than is a building permit & the relative binding nature of a letter depends on the circumstances.Such a letter may or may not be superseded by a subsequent change in the law, so there is no hard & fast answer to the question. What I have said In the past, is that once a permit is issued by DNR for a project, or DNR has authorized a certain project, the city is obliged to honor those in the context of newly adopted ordinances. I have no idea whether that has or will happen here but if it has/should, I would address the situation in the context. I hope this helps. The project must comply, as applicable, for areas permitted herein, with all other Federal, State, and local statutes, ordinances, and regulations, and the applicant must obtain all licenses and permits prior to commencement of construction. 2. This permit does not resolve actual or potential disputes regarding ownership of or rights in or over the property upon which the subject project is proposed, and shall not be construed as recognizing or denying any such rights or interests. 3. All plans, documents, and materials contained in this permit application, required by the Shore Protection Act O.C.G.A. 12 -5 -230 et. seq. are a part of this permit and conformance to such plans, documents, and materials are a condition of this permit. No change or deviation from these plans, documents, and materials shall be permitted without prior notification and approval by the Department or Committee. 4. No further encroachment or construction shall take place within State jurisdiction, except as permitted by the Shore Protection Committee. Any modification of the plans or structure in the jurisdictional area must be reviewed and approved by the Department prior to construction. 5. A construction placard will be required to be obtained from the Department up to 30 days prior to the start of project construction and must be posted at the site. This placard will include certain steps in the construction of the permitted project that must be approved by the Department prior to construction. 6. The exact location and configuration of this project must be reviewed onsite and approved by Department staff immediately prior to beginning construction. Minor changes to the location may be allowed or required in areas that have eroded or accreted subsequent to the original jurisdictional determination. 7. No construction materials may be disposed of in the jurisdictional area of the Shore Protection Act. 8. The public shall maintain rights of ingress and egress on the foreshore beach area seaward of the ordinary high water mark. 10. If the permitted improvements are damaged, fall into disrepair, become dilapidated, are not meeting their expected usefulness, or are not maintained at a serviceable level, then it is the responsibility of the owner to remove the improvements. A new permit will be required to retain and repair the structure, improvement or asset if it loses its structural integrity and is no longer serviceable. 11. The Shore Protection Committee is not bound in the future to protect any asset or improvements authorized by the permit. 12. The permit must be posted onsite within twenty -four (24) hours of beginning construction. 13. A copy of the above conditions must be supplied to the person in charge of construction. SPECIAL CONDITIONS: 1. During and after construction, external lighting must conform to turtle friendly lighting standards as approved on consultation with DNR/WRD staff. Any bulb, fluorescent tube, lamp or other source of light from the subject parcel shall be shielded, screened or turned off should it be capable of creating a shadow on the beach between May 1 and October 31. 2. Access to the beach will be via an existing dune path to prevent habitat fragmentation, wildlife disturbance and impacts to nesting marine turtles and birds. 3. Approximately 2,260 square feet or 62% of the jurisdictional area will be restored with native vegetation. All non - native landscaping must be removed from the site. Landscaping in the 20' access easement on the southern side of the property must be designed in order to continue to allow pedestrian ingress and egress to the beach. 4. A landscape plan must be provided to the Department for approval prior to installation. Landscaping will consist of native species and shall not change the jurisdiction of the Shore Protection Act in the future. 5. No construction or landscaping is permitted in the dune areas. Should the dunes shift landward, which is considered a natural function of the sand sharing system, every effort must be made to protect the dynamic area. 6. During construction, no materials or equipment can be stored in the dune area. During construction, silt fence must be placed landward of the existing dune to clearly delineate the dune area where no impacts are permitted. 7. All proposed driveways must be constructed of pervious materials. 8. To ensure public safety the retaining wall adjacent to the 6' pedestrian easement on the north side of the property must be reviewed by a structural engineer and if necessary measures must taken to ensure the integrity of the wall to provide public safety. 9. Permittee must provide a post - construction survey to the Department within thirty days of completion of the project. Landscaped trees will not change the Shore Protection Area jurisdiction and must be noted as landscaped on the post construction survey. The survey must be performed by a surveyor registered in the State of Georgia and must comply with appropriate professional industry standards.
