Standards to be Addressed by Applicant: (1) Code Section 66.1 provides as follows: "Dock shall mean an accessory structure built on pilings over water, no part of which floats on water, and which is designed or used primarily to provide dockage for and access to one or more boats or water vessels for private use ". Code Section 66- 369(6)(b) provides: "No dock shall exceed five feet in width." Plans submitted are for a dock which is 5 feet in width over water. By definition, the application and plans comply with Code Section 66.1. (2) Rejection notice from Town of Gulf Stream states that the dock will be 7.5 feet in width. This is an erroneous finding. The width of the dock (as defined in Code Section 66.1) is 5 feet. (3) No need for mitigation measures or revisions required since the application and plans are in compliance with applicable code and are identical to the approved conditions that exist within the immediate vicinity of the subject property at: 549 Golf View Drive, 530 Middle Road, and 540 Middle Road, as examples. 4. V INTER- OFFICE MEMORANDUM 0 k-1,111 �y. TOWN OF GULF STREAM, FLORIDA OFFICE OF THE TOWN MANAGER WILLIAM H. THRASHER DATE: August 9, 2013 TO: Mayor Orthwein and Town Commissioners RE: Administrative Challenge — Cynthia Grumney, Owner 2960 Polo Drive Background The owner wishes to install a 7 -8' wood dock at their residence. The proposed wood dock extends over the water five feet and then landward 2 -3' over the newly overlaid seawall cap. Part of the owner's justification for wanting to cover the seawall cap is that there are other "like kind" or similar overlays of seawall caps in the South Cove. Prior to Ordinance 008/04 the language of the Code read "No docks can extend more than 5' over water ". With this language it may have allowed docks to extend landward from the edge of water and over the seawall cap. Code Justification Used by Administrators in Not Approving Permit Application Section 66 -1 Definitions. Dock shall mean an accessory structure Guilt on pilings over water.... Implementing Ordinance 008104. Note: The outer face of the seawall plates, wet water line, determines where the measurement of five foot width of dock begins. Following later the wet water line also is the determining factor for establishing the Effective Lot Line. Section 66 -369 Docks (6) (b). No clock shall exceed five feet in width. Note: The language of this ordinance is very specific limiting the "width" of a dock to be only 5'. The permit application clearly indicates that the proposed dock is wider than 5'. Section 70 -67. Effective lot area (b) (1). All references to "lot size" or "lot area" in this chapter shall have the same meaning as "effective lot area" which is defined as follows. "Effective lot area" shall Haan the platted /recorded lot area minus the following: Any submerged lands. Note: The wet side of a seawall plate is the point of beginning for the "effective lot line ". Section 70 -74 Setbacks (b) (1) & (3) (])Effective lot area. All setbacks shall be measured front the lot lines established under the effective lot area definition. (3) Patios and decks tip to eight inches higher than highest abutting grades. The setback is a minimum of 3' froth all property lines. Note: The lowest abutting grade has not been identified or "called out ". However, in discussion with the contractor the new seawall cap would be formed in place greater than 6 -9 inches. The new top elevation of the seawall cap could require the minimum setback requirement and make the proposed landward portion of the dock "prohibited ". IN - 18. I- •- - Administrative Challenge- Width of Dock Town Commission Meeting August 9, 2013 Page 2 Section 70 -78 Seawall height. The maximhmh height of a new or replacement seawall abutting waters connected to the Intracoastal Waterway shall be no greater than five feet NGVD. Note: The permit application is replacing any seawall plates therefore it is assumed that this section of the code does not apply. At one point the Building Administrator believed that the seawall cap was including in this NGVD requirement. Upon further review and discussion concerning the history and intent of this portion of the code it was determined that the seawall cap is a separate unit from the seawall plates. Recommendation: Agree with the Building Administrator and limit the width of the dock to 5'.
