SPECIAL TOWN COMMISSION MEETING
100 SEA ROAD, GULF STREAM, FLORIDA
PURSUANT TO SECTION 286.011(8), FLORIDA STATUTES
MINUTES
MONDAY DECEMBER 10, 2018 @ 8:30 A.M.
I. CALL TO ORDER AND ROLL CALL (IN TOWN COMMISSION CHAMBERS)
Mayor Morgan called the meeting to order at 9:00 A.M. and those answering the roll
call were Mayor Scott W. Morgan, Vice Mayor Thomas M. Stanley, Commissioner
Paul A. Lyons, Jr., Commissioner Joan K. Orthwein, Donna S. White, Town Manager
Gregory Dunham, Staff Attorney Edward Nazzaro, Police Chief Edward Allen, Town
Clerk Rita L. Taylor. Vice Mayor Stanley was excused and left the meeting.
II. APPROVAL OF AGENDA
There were no comments, additions or objections to the agenda as presented.
III. CONSIDERATION OF SETTLEMENT AGREEMENT WITH MARTIN O'BOYLE
AND HIS AFFILIATED ENTITIES
Mayor Morgan explained that consideration will be given to a settlement agreement.
IV. ATTORNEYS REQUEST ADVICE REGARDING PENDING LITIGATION
INCLUDING THE CASES ON EXHIBIT A
The Mayor called attention to the list of cases attached and explained that the
attorneys are present.
V. MAYOR MORGAN ANNOUNCES:
A. PURSUANT TO SECTION 286.011(8), FLORIDA STATUTES, THE TOWN
COMMISSION IS ADJOURNING AND COMMENCING CLOSED DOOR
ATTORNEY CLIENT SESSIONS FOR THE PURPOSE OF DISCUSSING
SETTLEMENT NEGOTIATIONS AND/OR STRATEGY RELATING TO
LITIGATION AND EXPENSES IN THE CASES AND SETTLEMENT
AGREEMENT SET FORTH ON EXHIBIT "A" ATTACHED HERETO, WHICH
ARE PENDING IN THE CIRCUIT COURT OF THE FIFTEENTH JUDICIAL
CIRCUIT IN AND FOR PALM BEACH COUNTY, FLORIDA
B. THE ESTIMATED LENGTH OF THE SESSIONS ARE APPROXIMATELY
TEN MINUTES FOR EACH CASE AND TWENTY MINUTES FOR THE
SETTLEMENT AGREEMENT
C. THOSE PERSONS ATTENDING THE SESSIONS ARE: MAYOR SCOTT
MORGAN; VICE -MAYOR THOMAS STANLEY; TOWN COMMISSIONERS
JOAN ORTHWEIN, PAUL LYONS, AND DONNA S. WHITE; TOWN

COURT REPORTING
Staff Counsel Nazzaro stated he needed advice concerning litigation including
settlement negotiations and strategy regarding litigation expenditures.
D. ATTENDEES RETIRE TO CONFERENCE ROOM
The Special Meeting was recessed at 9:05 A.M.
VI. RECONVENE COMMISSION MEETING
The Special Commission Meeting reconvened at 12:15 P.M.
Staff Attorney Nazzaro said they appreciate the Commission's advice and have a good
consensus of where we are and the attorneys are clear on the direction moving forward.
VII. ANY OTHER MATTERS
There were no other matters.
VIII. ADJOURNMENT
Mayor Morgan adjourned the special meeting at 12:20 P.M.
