COMMISSION CHAMBERS OF THE TOWN HALL, 100 SEA ROAD, GULF STREAM, FLORIDA. I. CALL TO ORDER Mayor Morgan called the meeting to order at 8:30 A.M. II. ROLL CALL Present and Scott W. Morgan Mayor Participating: Thomas W. Stanley Vice Mayor Paul Lyons Jr. Commissioner Joan K. Orthwein Commissioner Donna S. White Commissioner Also Present & Gregory Dunham Town Manager Participating: Edward Nazzaro Staff Attorney Edward Allen Police Chief Rita Taylor Town Clerk III. CONSIDERATION OF SETTLEMENT AGREEMENT WITH MARTIN O'BOYLE AND HIS AFFILIATED ENTITIES Mr. Nazzaro presented a brief overview of the settlement to be considered. He explained that it is slightly different from what was decided in the previous shade meeting. He said the property in N. Hidden Harbour is not addressed, no releases of any type for O'Boyle or the entities, and it provides for a payment of $15,00.00 instead of $215,000.00 because what is not included is the dismissal of the 4474 case where we have significant exposure and the Town will be responsible for Mr. O'Boyle's attorney fees. That case is not being dismissed and the Town is continuing to argue over the fees he said. He further said that Attorney O'Connor is in agreement with this settlement but is ready to go to court if the Commission is not in agreement with this settlement. Attorney Sweetapple, the Towns' Special Trial Attorney, was present and advised that with the approval of the settlement all future litigation will be cut off and the remaining attorney fees will be settled through mediation. Mayor Morgan said that with the settlement, O'Boyle will be dismissing 5 cases and a number of counts in a 6' case and the Town would stipulate in 4 cases, which stops any additional attorney fees that the Town would have to pay our own attorneys. Attorney Sweetapple explained the details in relation to the settlement of the fees and answered several legal questions from the Commission. Vice Mayor Stanley moved to approve the settlement agreement between the Town of Gulf Stream and Martin O'Boyle and related entities as of December 12, 2018 already previously executed by Mr. O'Boyle and authorize the Mayor to execute the agreement on behalf of the Town. Commissioner Lyons seconded the motion and all voted AYE at the roll call. 1 Mayor Morgan signed the agreement at 9:13 A.M. with the 2 witnesses signing at 9:14 A.M. VI.
