HomeMy Public PortalAboutRES-CC-2003-14Resolution 14-2003 A RESOLUTION ADOPTING A MEMORANDUM OF UNDERSTANDING BY AND BETWEEN THE CITY OF MOAB AND CANYONLANDS NATURAL HISTORY ASSOCIATION WHEREAS, the City of Moab and Canyonlands Natural History Association desire to enter into an agreement providing for the funding of extended rest room hours at the Moab Information Center, and WHEREAS, the attached Memorandum of Understanding sets forth the terms and conditions of such an agreement NOW, THEREFORE, we, the Goveming Body of the City of Moab do hereby approve the attached Memorandum of Understanding as presented to this meeting of the Moab City Council and authonze the appropnate individuals to execute said memorandum This resolution shall take effect immediately upon passage Passed and adopted by action of the Governing Body of the City of Moab in open session this 27s' day of May, 2003. David L Saknson Mayor Page 1 of I May 27, 2003 MEMORANDUM OF UNDERSTANDING Between the City of Moab and Canyonlands Natural History Association This Agreement is made and entered into this ol7- day of M , 2003 between the City of Moab ("City") and the Canyonlands Natural History ssociation ("CNHA") RECITALS WHEREAS, CNHA operates the Moab Information Center ("MIC") located at Center Street and Main Street, and WHEREAS, the MIC provides services and Information to the many visitors that frequent the Moab area and its surrounds, and WHEREAS, tourism is the primary economic base for the City of Moab and businesses in the Moab area; and WHEREAS, pedestrian activity in the downtown area is related to tounst spending; and WHEREAS, providing services to pedestrians and visitors in the downtown area, including restroom facilities is essential to increasing pedestrian satisfaction and activity, and WHEREAS, the MIC provides public restroom facilities for extended hours dunng tounst season, and WHEREAS, the City believes this service is related to the economic viability of the downtown AGREEMENT The parties agree as follows: 1. Purpose of Agreement — The parties agree that the purpose of this agreement is to provide funding for the provision of extended hours for rest room facilities 2 Funding Services — The City agrees to allocate funding in itsannual budget for the provision of extended hours for rest room facilities at the MIC The allocation of funds shall be $1,500 per year made on the basis of availability of funds Funds will be allocated on July 1 of each year, and be made available for disbursement to CNHA after August 1 of each year 1 3. Provision of Extended Rest Room Hours — CNHA agrees to provide public rest room services at the MIC for extended hours on Fridays and Saturdays until 10 00 pm during the penod of June 1 through October 1 of each year 4. Term — This agreement shall remain in effect for one year, at which time it shall be reviewed and/or renewed by the parties If after one year the parties choose to renew the agreement in substantially the same form, the agreement will remain in effect until 90 days wntten notice from either party.
