HomeMy Public PortalAbout12-28-1989 BOARD OF PUBLIC WORKS AND SAFETY OF THE CITY OF RICHMOND, INDIANA, DECEMBER 28. 1989 1 The Board of Public Works and Safety of the City of Richmond, Indiana, met in regular session December 28, 111 2 1989 at the hour of 9:00 A.M. in the Municipal Building in said City. Ms. Hauptstueck presided with Ms. 3 McFarland in attendance. Absent: None. Media in attendance: Palladium Item, WKBV/WFMG and 4 WHON/WQLK. The following business was had to-wit: 5 6 APPROVAL OF MINUTES OF DECEMBER 21,1989 7 8 Ms. Sarah Braxton brought to the attention of the Board that the previous minutes did not reflect that the Building 9 Division of Planning, Permits and Inspection had presented their monthly report. 10 11 Ms. McFarland moved to approve the minutes of the previous meeting with the notation that the Monthly Report 12 of the the Building Division of Planning, Permits and Inspection was presented, seconded by Ms. Hauptstueck 13 and on unanimous voice vote the motion was carried. 14 15 APPROVAL OF CLAIMS FOR PAYMENT 16 . 17 Ms. McFarland moved to approve claims in the amount of 237,.358.24, seconded by Ms. Hauptstueck and on 18 unanimous voice vote the motion was carried. 19 20 TABLED ITEMS 21 22 None were presented. 23 24 PUBLIC REQUESTS AND COMMENTS 25 26 Renewal of Handicapped Parking-308 North 19th Street 27 28 The renewal of a residential handicapped parking space for Mary Archambault of 308 was presented to the 29 Board. 30 31 Captain Williams told the Board that he recommended approval since the renewal met all the guidelines. 32 33 Ms. McFarland moved to approve the renewal of a residential handicapped parking space at 308 North 19th 34 Street, seconded by Ms. Hauptstueck and on unanimous voice vote the motion was carried. 35 36 DEPARTMENT REQUESTS AND COMMENTS 37 38 PLANNING, PERMITS AND INSPECTION 39 40 Repairs to be Completed at 30 North 15th Street 41 42 Ms. Braxton reported that repairs are not completed, and Mr. Stamper has not yet secured the financing which 43 the Board had allowed until January 21, 1990 to complete. She said the structure is being secured by Mr. 44 Dennis Jones,owner of record. 45 46 Ms. Hauptstueck asked if the securing would be completed by by Friday of this week and why Mr. Jones was 47 doing the securing rather than the City. 48 49 Ms. Braxton informed the Board she was unaware of why Mr.Jones was doing the securing. 50 51 Repairs to be Completed at 415 North 15th Street 52 53 Ms. Braxton reported that there was conversation that a VISTA volunteer was attempting to work with Habitat for 54 Humanity to look into utilizing this property for that program. She said there has been no purchase of the 55 property to date. 56 57 Ms. Hauptstueck stated the recommendation of the Board was to proceed with the demolition order. 58 59 Update on 410/412 North 11th-Repairs to Have Started or be Demolished 60 61 Ms. Braxton reported that a wrecking permit had been issued for demolition of this property and it would be 62 down within one week. 63 64 65 Board of Works Minutes Cont'd December 28, 1989 Page 2 1 BOARD OF WORKS MISCELLANEOUS 2 3 Award Contract for Sheltering of Animals 4 5 City Attorney Bruce Metzger recommended to the Board that since HELP the Animals, Inc. had only bid to 6 provide services from July 1, 1990 through December 31, 1990, and the Animal Welfare Shelter bid to provide 7 services for all of 1990, the contract should be awarded to the Animal Welfare Shelter. Mr. Metzger further 8 , stated that he understood that the Animal Welfare Shelter was currently under investigation and that the bid 9 , should be awarded to them on a month by month basis with automatic renewal pending the outcome of any 10 investigation. Mr. Metzger informed the Board that they should award the bid on the presumption of innocence. 11 12 Ms. McFarland moved to award the bid for the sheltering of animals for 1990 to the Animal Welfare Shelter, 13 under the assumption of innocence, on a month by month basis with automatic monthly renewal pending any 14 investigation. 15 16 Prior to a second on the motion, Mr. Richard Longer, representing the Animal Welfare Shelter, told the Board 17 that he suggested the attorneys for the City and the Shelter get together. He said they were not under any 18 investigation and would not accept a bid on a month by month basis. 19 20 Mr. Metzger commented to the Board that they could be required to accept the bid as submitted or to reject the 21 bid. 22 23 Mr. Longer reminded the Board that the specifications allowed for cancellation of the contract at any time if there 24 were any violations. 25 26 Ms. Hauptstueck told Mr. Longer that was why the Board wanted to award the contract on a month by month 27 basis with automatic renewal. 28 29 Ms. McFarland told Mr. Longer that the Board was concerned with the welfare of animals placed in a shelter and 30 wanted to make certain that the contract could be terminated depending upon the outcome of any investigation. 31 32 Mr. Metzger suggested that the Board take the matter under advisement for one week to allow him time to 33 further investigate. 34 35 Ms. McFarland withdrew her prior motion, and moved to take the award of a contract for sheltering of animals for 36 one week for further investigation, seconded by Ms. Hauptstueck and on unanimous voice vote the motion was 37 carried. 38 39 Extension of 1989 Contract between the City and FOP 40 41 Mr. Mark Smith, representing the John Hennigar Lodge #63, Fraternal Order of Police and all members, 42 requested the Board to extend the 1989 contract for wages and working conditions until a new contract is settled 43 and approved. He explained this would be a benefit to both the citizens and the police. 44 45 Mr. Metzger explained to the Board that Mayor Waltermann, on the advise of his attorney, did not wish to 46 continue negotiations on the 1989 contract until after the hearing on January 16, 1990 on the petition filed with 47 the Courts on determination of powers. 48 49 Mr. Smith stated that the FOP was not arguing about powers and that was why they approached the Board of 50 Works rather than the Council for the contract extension. 51 52 Ms. McFarland asked if the negotiations were nearing any understanding and Mr. Smith said it had been over 53 thirty days since they had last negotiated and the meeting set for this day had been cancelled. 54 55 Ms. Merchanthouse, member of the negotiating committee for the City, told the Board that the Mayor and 56 committee were in agreement with an extension to the end of January. 57 58 Ms. Hauptstueck asked what the Court petition had to do with the contract and Mr. Metzger told the Board that 59 the Mayor was under the advise of the attorney handling that suit and he had not been involved. 60 61 Chief Joseph Nimitz told the Board that he supported the extension of the contract since he felt the officers 62 should know where'they stand and the Board should agree at least to the thirty day extension. 63 64 Ms. McFarland moved to approve the extension of the 1989 Agreement between the City of Richmond and John 65 Hennigar Lodge#63, Fraternal Order of Police until January 31, 1990, to allow time for negotiations between the Board of Works Minutes Cont'd December 28, 1989 Page 3 1 two parties,seconded by Ms. Hauptstueck and on unanimous voice vote the motion was carried. 2 3 Ms. McFarland reminded Mr. Smith that he could appear before the Board again for additional requests for 4 extensions if the matter was not settled within the extension. 5 6 ADJOURNMENT 7 8 There being no further business,on a motion duly made, seconded and passed the meeting was adjourned. 9 10 11 12 13 14 Carrie Hauptstueck, President 15 16 17 18 19 20 ATTEST: 21 Mary Merchanthouse, City Clerk 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 45 46 47 48 49 50 51 52 53 54 55 56 57 58 59 60 61 62 63 64 65
