HomeMy Public PortalAbout06-15-1989 • BOARD OF PUBLIC WORKS AND SAFETY OF THE CITY OF RICHMOND, INDIANA,JUNE 15, 1989 1 The Board of Public Works and Safety of the City of Richmond, Indiana, met in regular session June 15, 1989 2 at the hour of 9:00 A.M. in the Municipal Building in said City. Ms. Hauptstueck presided with Mr. Willis in 3 attendance. Absent: Mr. Barden. Media in attendance: Palladium Item, WKBV/WFMG and WHON/WQLK. 4 The following business was had to-wit: 5 6 APPROVAL OF MINUTES OF JUNE 8,1989 7 8 Mr. Willis moved to approve the minutes of the previous meetings as prepared, seconded by Ms. Hauptstueck 9 and on unanimous voice vote the motion was carried. 10 11 APPROVAL OF CLAIMS FOR PAYMENT 12 . 13 Mr.Willis moved to approve claims for payment in the amount of 1,709,537.59, seconded by Ms. .Hauptstueck 14 and on unanimous voice vote the motion was carried. 15 16 PUBLIC REQUESTS AND COMMENTS 17 18 Residential Handicapped Parking-Renewal Request at 202 South 11th Street 19 20 The request of Ms. Ruth Hunt, 202 South 11th Street, for an annual renewal of a residential handicapped 21 parking space was presented to the Board. 22 23 Lt. Smith informed the Board there was no problem with the renewal. Mr. Willis moved to approval the renewal 24 of a residential handicapped parking space at 202 South 11th Street, seconded by Ms. Hauptstueck and on 25 unanimous voice vote the motion was carried. 26 27 Use of Public Right of Way for Awning Support Posts-Esmonds Shoes 28 29 A request from Esmonds Shoes to place support posts for an awning on the public right of way in front of the 30 business located in the 100 Block of South 8th Street was presented to the Board. 31 32 Fire Chief Trotter said they did need to stay at least three feet from the hydrant. 33 34 Mr.Willis requested the City Engineer to investigate the matter and report to the Board in one week. 35 36 Mr.Willis moved to table the request of Esmonds Shoes to place support posts in the public right of way to June 37 22, 1989, seconded by Ms. Hauptstueck and on unanimous voice vote the motion was carried. 38 39 Handicapped Parking for Customers-Esmonds Shoes 40 41 Esmonds Shoes requested a handicapped parking place near their store in the 100 Block of South 8th Street. 42 43 Lt. Smith told the Board that there was handicapped parking in the area and if the Board allowed an additional 44 space, it would have to be south of the store due to a yellow curb. He said they might be able to relocated one 45 there from further up the street. 46 47 Mr. Willis said with the parking garage in that area he didn't believe that a handicapped space would cause 48 additional parking problems. Mr. Willis suggested both requests from Esmonds be table and acted upon at the 49 same time. 50 51 Mr. Willis moved to table the request for handicapped parking by Esmonds Shoes to June 22, 1989, seconded 52 by Ms. Hauptstueck and on unanimous voice vote the motion was carried. 53 54 Temporary Removal of Street Lights - Common Lumber Company 55 56 Mr. Don McBride, 5th District Councilmember, requested the Board to give approval for removal of street lights 57 on Sheridan Street in front of Commons Lumber Company to facilitate the construction of the employee parking 58 lot. He said they can be re-established at different locations after construction. 59 60 Mr. Robert Hankosky, Distribution Engineer for Richmond Power & Light, told the Board that since it was an 61 employee parking lot and there would not be a lot of traffic in and out they would be able to put the poles in the 62 parking area and accommodate the parking lot. 63 64 Mr. McBride said that Commons had no objection to the relocation of the street lights. 65 Board of Works Minutes Cont'd June 15, 1989 Page 2 1 Mr. Willis moved to approve the temporary removal and re-establishment of street lights on Sheridan Street at 2 Commons Lumber Company to the satisfaction of Mr. Hankosky, seconded by Ms. Hauptstueck and on 3 unanimous voice vote the motion was carried. 4 5 Temporary Street Closing for Pioneer Days-Wayne County Museum 6 7 The request of the Wayne County Historical Museum for temporary removal of parking for Pioneer Days was 8 presented. The request asked that parking be restricted on North A, North 11th and North 12th Streets on 9 September 10, 1989 for horse drawn vehicles. 10 11 Lt. Smith stated there were no problems with the request and they would work with the Museum. 12 13 Mr. Willis moved to approve the request of the Wayne County Historical Museum to restrict parking on 14 September 10, 1989, seconded by Ms. Hauptstueck and on unanimous voice vote the motion was carried. 15 16 Trash Receptacles at Rear of Rax Restaurants-National Road West 17 18 Mr.J.R. Webster of 218 S.W. 2nd Street forwarded the Board a written request to investigate the matter of trash 19 receptacles behind the Rax Restaurant on National Road West and their location and condition. 20 21 Ms. Hauptstueck said she had driven through the alley and felt there was sufficient space for traffic to pass. 22 23 Mr. Willis said the Sanitary District has set those containers at all restaurants and they are receiving complaints 24 on them. He said they no longer put the receptacles on private property in order to keep the trucks off the 25 parking areas and off private property. 26 27 Mr.Willis said he felt that Mr. Barden and Ms. Hauptstueck should address this complaint and he would abide by 28 their decision regarding the containers on public alleys. 29 30 Lt. Smith said he had investigated the alley and there was room for a fire truck to pass through, but they are 31 beginning to look bad and the area around needs cleaned up. 32 33 Mr.Willis said the Sanitary does replace and clean up the containers and they might consider being more careful 34 about policing the area. 35 36 Mr. Willis moved to table the complaint on trash receptacles in the alley behind the Rax Restaurant on National 37 Road West to June 29, 1989, seconded by Ms. Hauptstueck and on unanimous voice vote the motion was 38 carried. 39 40 TABLED ITEMS 41 42 Noise Ordinance Variance for Eariham College New Student Week 43 44 The Board again considered a waiver for three outdoor events to be held on the Earlham Campus in September 45 during New Student Week. The events included a dance, concert and band performance between September 46 3rd and September 6th, 1989. 47 48 No one was in attendance to represent the request and Lt. Smith told the Board that that event really has been 49 no problem in the past and they do have the right to shut it down if necessary. 50 51 Mr. Willis moved that based upon the recommendation of the Traffic Division to allow a waiver on the Noise 52 Control Ordinance for three outdoor events for Eariham New Student Week between September 3rd and 6th, 53 seconded by Ms. Hauptstueck and on unanimous voice vote the motion was carried. 54 55 DEPARTMENT REQUESTS AND COMMENTS 56 57 58 FINANCE OFFICE 59 60 Educational Assistance Program 61 62 Ms. Hauptstueck presented an Educational Assistance Plan in connection with the Tax Reform Act of 1986, 63 Code Section 89, effective January 1, 1989. Ms. Hauptstueck explained that Code Section 89 requires all 64 employers with Health Insurance, Group Insurance, Term Line and Education Assistance Plans to comply with 65 its provisions that all Benefits Plans must be in writing and all employees be provided reasonable notification of Board of Works Minutes Cont'd June 15, 1989 Page 3 1 benefits available to them in a plan by October 1, 1989. She said the City is currently without a written plan for 2 Educational Assistance and compliance consists of determining discrimination and failure to comply could result 3 in employees being taxed on full value of benefits received. 4 5 Ms. Hauptstueck stated that the Educational Assistance Plan is to encourage employees to become more 6 efficient on the job and to increase their potential for individual career development through their voluntary 7 participation in accredited educational programs. with the city to reimburse eligible educational costs through 8 determination by the department heads. Ms. Hauptstueck requested that the motion to accept the Educational 9 Assistance Program include that the thirty day requirement for notification prior to the start of classes be waived 10 for the fall semester of classes. 11 12 Mr. Willis moved to approve the Educational Assistance Plan for the City of Richmond, Indiana with the 13 exclusion of the thirty (30) day prior notification for the fall 1989 semester, seconded by Ms. Hauptstueck and on 14 unanimous voice vote the motion was carried. 15 16 PARK DEPARTMENT 17 18 Close Existing Curb Cut at Clear Creek Park 19 20 Mr. Dean Bostrom, Park Superintendent, explained to the Board that the roadway in Clear Creek Park ran from 21 Main to National and had become a raceway. He said with the renovation of the Park including the tennis 22 courts, more parking and play area the speeding cars are a liability and safety hazard for the children. Mr. 23 Bostrom said the Park Department desired to close the curb cut onto National Road and make a turn around for 24 traffic to exit back onto Main Street. He said the plans had been submitted to the State and approved. 25 26 Lt. Marshall Smith said the Police Department had no records of a traffic problem accessing National Road, but 27 they can see the safety aspects. 28 29 Mr. Willis asked why this needed Board action since the street was not a public right of way, but located on Park 30 property and Mr. Bostrom said it was a formality. 31 32 Lt. Smith added that as far as the Police Department was concerned all Park Drives are considered city streets 33 and they do have to report any accidents on them to the State. He said they will assist with the posting of"Dead 34 End"signs. 35 36 Mr. Boston said they would like to show the Board not in opposition with the request. 37 38 Lt. Smith said he felt Board action should be taken since the drives are used a public right of way. 39 40 Mr. Willis moved to acknowledge the removal of a curb cut at Clear Creek Park onto National Road West, 41 seconded by Ms. Hauptstueck and on unanimous voice vote the motion was carried. 42 43 BOARD OF WORKS MISCELLANEOUS 44 45 Unresolved Grievances 1 to 6-1989 filed by Firefighters Local 1408 46 47 Ms. Hauptstueck noted the receipt of Grievances 1 to 6-1989 from Firefighters Local 1408 and recommended 48 an Executive Session for discussion of the Grievances be set on June 26, 1989 at 9:30 AM. 49 50 Mr. Jim Sticco, representing Local 1408 Grievance Committee, asked a different date be established since he 51 could not be in attendance at that time. 52 53 Mr. Willis moved to set June 28, 1989 at 9:00 AM for an Executive Session of the Board of Public Works and 54 Safety,seconded by Ms. Hauptstueck and on unanimous voice vote the motion was carried. 55 56 ADJOURNMENT 57 58 There being no further business,')n a motion duly made,seconded and passed the meeting was adjourned. 59 60 61 62 63 64 Carrie N.
