HomeMy Public PortalAbout05-24-1989 - Special Meeting A SPECIAL MEETING OF THE BOARD OF PUBLIC WORKS AND SAFETY OF THE CITY OF RICHMOND, INDIANA, MAY 24, 1989 1 The Board of Public Works and Safety of the City of Richmond, Indiana, met in special session May 24, 1989 2 at the hour of 9:00 A.M. in the Municipal Building in said City. Mr. Barden presided with Ms. Hauptstueck and 3 Mr.Willis in attendance. Absent: None. Media in attendance: None. The following business was had to-wit: 4 5 HEARINGS FOR FALSE ALARM VIOLATIONS 6 7 Mr. Barden explained that the Ordinance establishing alarm permits and penalties for excessive false alarms 8 allowed three false alarms in a six month period with a citation to be issued requesting explanation and that the 9 forth false alarm mandated the permit be revoked. Upon revocation,the permit holder then is allowed to repair 10 the system, have it inspected by the Police Department and with approval pay a reinstatement fee for the permit. 11 12 Aldi 13 14 Mr. Barden opened the hearing in regard to seven false alarms having been registered against Aldi in a six 15 month period. 16 17 A representative from Aldi informed the Board that they had spent over 1,000.00 to fix and hopefully have the 18 system repaired. He said that every tine it rained or thundered the system was set off. 19 20 Mr. Barden recommended that pursuant to the Ordinance the permit be revoked, the system be repaired, 21 inspected and the permit reinstated with the payment of$25.00. 22 23 Mr. Willis moved to immediately revoke the Alarm Permit issued to Aldi, seconded by Ms. Hauptstueck and on 24 unanimous voice vote the motion was carried. 25 26 American Legion Post 65 27 28 Mr. Barden opened the hearing in regard to three false alarms having been registered against the American 29 Legion Post 65 in less than a six month period. 30 31 The Board received correspondence from Post 65 notifying them no one could be in attendance at this meeting. 32 33 Mr. Barden stated that he had notified them that the forth violation in a six month period will automatically 34 constitute revocation and recommended the hearing be continued indefinitely. 35 36 Mr.Willis moved to indefinitely continue the hearing for false alarm violations against American Legion Post 65 37 seconded by Ms. Hauptstueck and on unanimous voice vote the motion was carried. 38 39 B& C Video 40 41 Mr. Barden opened the hearing in regard to three false alarms having been registered against B & C Video in 42 less than a six month period. 43 44 The representative from B & C Video informed the Board that two of the alarms had been from employees 45 pushing the hold up button. 46 47 Mr. Barden notified the representative that the forth violation in a six month period will automatically constitute 48 revocation and recommended the hearing be continued indefinitely. 49 50 Ms. Hauptstueck moved to indefinitely continue the hearing for false alarm violations against B & C Video, 51 seconded by Mr.Willis and on unanimous voice vote the motion was carried. 52 53 Bench Mark Graphics 54 55 Mr. Barden opened the hearing in regard to four false alarms having been registered against Bench Mark 56 Graphics in less than a six month period. 57 58 The representative from Bench Mark Graphics informed the Board that two of the alarms had happened on the 59 same day within two hours of each other while they were revamping the office. He said the other problems were 60 during construction when the alarm company was unable to bypass the system for the construction. 61 62 Mr. Willis recommended that the two violations occurring within two hours be treated as one in and so moved to 63 combine the alarm violations on January 30, 1989 be treated as one event, seconded by Ms. Hauptstueck and 64 on unanimous voice vote the motion was carried. 65 6o Board of Works Minutes Cont'd May 24, 1989 Page 2 1 Mr. Barden notified the representative that the forth violation in a six month period will automatically constitute 2 revocation and recommended the ;nearing be continued indefinitely. 3 4 Ms. Hauptstueck moved to indefinitely continue the hearing for false alarm violations against Bench Mark 5 Graphics, seconded by Mr.Willis and on unanimous voice vote the motion was carried. 6 7 Fashion Bug 8 9 Mr. Barden opened the hearing in regard to three false alarms having been registered against the Fashion Bug 10 in less than a six month period. 11 12 The representative from the Fashion Bug informed the Board that she felt the problem was taken care of and 13 they had not had any false alarms since January. 14 15 Mr. Barden notified the represenhtive that the forth violation in a six month period will automatically constitute 16 revocation and recommended the .searing be continued indefinitely. 17 18 Ms. Willis moved to indefinitely continue the hearing for false alarm violations against the Fashion Bug, 19 seconded by Ms. Hauptstueck and on unanimous voice vote the motion was carried. 20 21 Fox Electronics 22 23 Mr. Barden opened the hearing in regard to three false alarms having been registered against Fox Electronics in 24 less than a six month period. 25 26 The representative from Fox Electronics informed the Board that the problem was being worked on and they 27 feel it is now corrected. 28 29 Mr. Barden notified the representative that the forth violation in a six month period will automatically constitute 30 revocation and recommended the hearing be continued indefinitely. 31 32 Mr.Willis moved to indefinitely continue the hearing for false alarm violations against Fox Electronics, seconded 33 by Ms. Hauptstueck and on unanimous voice vote the motion was carried. 34 35 Gun Room 36 37 Mr. Barden opened the hearing r regard to four false alarms having been registered against the Gun Room in 38 less than a six month period. 39 40 The representative from the Gun Room informed the Board that the problem has been check out twice and 41 some minor adjustments have been made. He said the business has been closed for sales since December and 42 they feel that the alarms could have been someone trying to enter. He said there have been no problems since 43 March when they adjusted some door contacts. 44 45 Mr.Willis asked if there was atten pted robbery how could that be considered a false alarm and Mr. Barden said 46 if there was probably cause the Board could abort the citations for false alarms. 47 48 Mr. Willis moved to recognize the first three false alarm violations as attempts to burglarize, thereby not false 49 alarms,seconded by Ms. Hauptstueck and on unanimous voice vote the motion was carried. 50 51 The hearing was dismissed with only one false alarm citation remaining. 52 53 Target 54 55 Mr. Barden opened the hearing i:r regard to four false alarms having been registered against Target in a six 56 month period. 57 58 There was no one representing Ti -get at the hearing. 59 60 Mr. Barden recommended that pursuant to the Ordinance the permit be revoked, the system be repaired, 61 inspected and the permit reinstate•J with the payment of$25.00. 62 63 Mr.Willis moved to immediately revoke the Alarm Permit issued to Target, seconded by Ms. Hauptstueck and on 64 unanimous voice vote the motion was carried. 65 Mr. Barden closed the False Alai.; Violation Hearings. 6/ Board of Works Minutes Cont'd May 24, 1989 Page 3 1 MISCELLANEOUS BUSINESS 2 3 Discussion of Curb Cut Permit • Star Bank on Williamsburg Pike 4 5 Mr. Barden allowed the item to be added to the agenda of the Special Meeting of the Board of Public Works and 6 Safety for discussion only. Any formal action of the Board will take place at the regularly scheduled meeting of 7 the Board on April 25, 1989. 8 9 Mr. Gayle Gardner, Attorney at Law, representing Star Bank spoke with the Board regarding a curb cut request 10 for property owned by Star Bank on N.W.5th Street (Williamsburg Pike). Mr.Gardner told the Board that a prior 11 request for this curb cut had been handled by Mr. Granville Coomes and the Board approved a cut onto 12 Progress Drive with the right to amend the petition at a later time. 13 14 Mr. Gardner said that Shannon Properties, prospective purchaser of the property rejected the access onto 15 Progress Drive and Star Bank now presents a design for access onto NW 5th (Williamsburg Pike)that has been 16 discussed with Captain Williams,the Planning Department. 17 18 Mr. Gardner said the issue in question is not the usage of the property, but the concerns over the volume of 19 traffic accessing NW 5th at this particular area. He said that Shannon Properties has proposed using a formula 20 limiting "X"number of units of traffic in a 24 hour period in accordance with a specific traffic manual. Mr.Gardner 21 said the Traffic Captain is not cc mfortable with the use of reference to a manual until it is confirmed it is the 22 same manual they use and Captain Williams proposed the curb cut be restricted to not more than 200 units of 23 traffic in a 24 hour period. 24 25 Mr. Gardner said the proposal of Captain Williams is not unacceptable to Star Bank, but it hasn't been proposed 26 to Shannon Properties,who will be in town today. He said all are trying to achieve the same outcome, but it may 27 be technically different. He added all agree,the only issue is how to word and he feels that Shannon Properties 28 ' will have something precise wher they arrive. 29 30 Mr. Gardner said he would like to be able to amend the language in the previous curb cut application and take 31 this language into the meeting with Shannon Properties today and be able to present a position of the Board at 32 this time with formal approval to be on May 25, 1989. 33 34 Mr. Dennis Bronston said he did review the proposal and was concerned about the access being granted on a 35 curve, but felt with the restrictions it will have been adequately addressed. 36 37 Captain Williams said that he anc, Mr. John Barnhizer did look at the situation and it is the volume of traffic that 38 causes accidents, he said if the wilts of traffic are limited to 200 in and out in a 24 hour period, he did not believe 39 there would be an accident proble,n. 40 41 Mr. Gardner commented that r; iptain Williams definition was the best solution without Shannon Properties 42 present, but he was concerned that they were speaking of the same thing and that Shannon wanted the 43 definition tied to a manual and the problem is they are not certain if they are using the same manuals. 44 45 Mr. Barden recommended that Plc. Gardner arrange to meet with Captain Williams and himself when Shannon 46 Properties arrive for their meeting and finalize the wording at that time for formal presentation to the Board. 47 48 ADJOURNMENT 49 50 There being no further business,Jn a motion duly made,seconded and passed the meeting was adjourned. 51 52 53 54 55 56 Kenneth E.
