CITY OF RICHMOND, INDIANA, JANUARY 5, 1989
1 The Board of Public Works and Safety of the City of Richmond, Indiana, met in regular session January 5, 1988
2 at the hour of 9:00 A.M. in the Municipal Building in said City. Mr. Barden presided with Ms. Hauptstueck and
3 Mr.Willis in attendance. Absent: None. The following business was had to-wit:

5 ELECTION OF OFFICERS

7 Ms. Hauptstueck moved to nominate Mr. Barden as President of the Board of Public Works and Safety. Mr.
8 Willis seconded the motion. There being no other motions, Mr. Barden was elected President of the Board of
9 Public Works and Safety.

11 Mr. Willis moved to nominate Ms. Hauptstueck as Vice President of the Board of Public Works and Safety. Mr.
12 Barden seconded the nomination and there being no other nominations, Ms. Hauptstueck was elected Vice
13 President of the Board of Public Works and Safety.

15 APPROVAL OF MINUTES OF DECEMBER 29, 1988

17 Ms. Hauptstueck moved to approve the minutes of the previous meetings as prepared, seconded by Mr. Willis
18 and on unanimous voice vote the motion was carried.

20 APPROVAL OF CLAIMS FOR PAYMENT

22 Ms. Hauptstueck moved to approve claims for payment in the amount of 521,474.93 seconded by Mr.Willis and
23 on unanimous voice vote the motion was carried.

27 Dedication of Alley at 14 South 18th Street

29 Speaking for the request by Mr. Dana Weigle for the dedication of an alley at 14 South 18th Street was Mr.
30 Robert Burton, Attorney at Law, 25 North 7th Street. Mr. Burton presented the Board the legal description and
31 plat of the proposed dedicated alley and introduced Mr. Dana Weigle, Mr. Ray Risca, Construction Engineer with
32 McDonald's Restaurants and Mr.John Beals, Surveyor.

34 Mr. Burton said the proposed dedicated alley was a 20 ft. by 139 ft. from South 18th Street to an existing
35 north/south alley. He said it was necessary for the alley to be dedicated with the McDonald's expansion to
36 handle traffic of area residents, sanitary trucks and was part of the approval for zoning for the relocation, and
37 expanded building and parking. He said the alley is at the south end of Mr. Weigle's property, east to 18th
38 Street.

40 Speaking against the proposed dedicated was Mr. Steve Surles of 28 South 18th Street. Mr. Surles explained to
41 the Board that his home is directly south of the alley and proposed right of way will only be eighteen (18) inches
42 from his house. He said this is a safety hazard and nuisance. Mr. Surles commented on an existing law
43 requiring buildings to be eight (8)feet from an alley and asked about it pertinence in this case. He said he has
44 two children and feels that the alley will be a hazard with increase traffic from the new facility for McDonald's. He
45 added that persons would also be able to peep into their windows easily. Mr. Surles said his home is now ten
46 (10)to fifteen (15)feet away from the alley.

48 He said he did not agree with the dedication of the alley or the McDonald's expansion and a denial by the Board
49 would send the issue back to the Board of Zoning Appeals. Mr. Surles presented a petition to the Board that was
50 formerly presented to the BZA in opposition to the expansion.

52 Mr. Willis reminded Mr. Surles that the Board of Public Works and Safety did not deals with matters that had
53 been before the BZA. He said he did not intend to go over the matters as decided upon by the BZA, but rather to
54 deal with the matter at hand and not miss the opportunity to control the events so all involved could really live
55 with the alley dedication.

57 Mr. Willis said it would be trying to muddle and cloud the issue of the dedication to discuss the BZA
58 recommendations and the Board should address the right of way and show some spirit of cooperation to make
59 the best of this issue.

61 Ms. Kay Surles,28 South 18th Street, presented the Board pictures of her home showing how close the alley, as
62 proposed, would be to the house. She requested the Board address the safety problems with children using
63 the alley for play and walking and as proposed,there would be no way for the children to get out of the right of
64 way if a vehicle was coming down the alley.

1 Mr. Willis asked if McDonald's was presenting the request to see if the design would fly or was it already
2 established and Mr. Risca said the design was on paper and the lines could be moved.

4 Mr. Weigle informed the Board there could be a four (4) to six (6) foot latitude. Mr. Weigle asked how far the
5 Surles house was from their property line and Mr.Surles said it was eighteen (18)inches.

7 Mr. Weigle commented that he has not seen many children using the alley for a walkway, but agreed they
8 probably do play in the alley. He said that most persons using the alley have garages.

10 Mr. Risca confirmed there could be a four(4)to six(6)foot buffer strip.

12 Mr. Willis commented that the City does not have designs for alley and one had not been dedicated since the
13 1940's. He said the proposed right of way at twenty (20)feet does not mean that the pavement has to be that
14 size.

16 Mr. Ray Keller, 40 South 18th Street, said the City should make certain that it new equipment will fit in the
17 proposed alley, since some of the equipment now has problems and would not feel that sixteen (16)feet would
18 be wide enough to accommodate it.

20 Mr. Weigle said they were open to moving the alley six (6) feet to the north with the radius at the end into the
21 existing alley flaring to 20 (twenty)feet for a radius to allow easier access into the existing alley.

23 Mr.Willis agreed the same width was not needed to travel in,as to turn in and if the Board investigates the matter
24 and go through the standards,some problems could be addressed.

26 Mr. Keller asked about the parking of cars on South 18th Street and a visibility problem and requested the City
27 investigate that matter also.

29 Mr.Willis said he was not certain of the importance of that, but he would encourage proper curb cuts for ingress
30 and egress out of the store area.

32 Mr. Barden asked if Mr. Willis wanted to see the plan for the sixteen (16)foot pavement prior to acceptance and
33 dedication by the Board and Mr. Willis said he would like to see the problem addressed before the Board
34 accepted the dedication. Mr.Willis added that if there is a good engineering job and no emotion,the Board could
35 then be comfortable in doing their work.

37 Mr. Surles asked about the buffer zone and if it would be a part of the twenty (20)foot right of way and Mr.Willis
38 said the current drawings show pavement to the right of way lines and can be redesigned to show the pavement
39 only wide enough to get vehicles through to allow less harm to the properties.

41 Mr. Barden asked where the Board should go from here since it was only a matter of design and Mr. Burton said
42 they were willing to accept a dedication subject to Mr. Willis'standards.

44 Mr. Weigle said he would have no problem up to twenty-six (26) foot as long as it did not present any zoning
45 problems.

47 Mr. Barden suggested the drawings be redone in connection with the Engineer's Office.

49 Mr. Keller asked if the neighbors might be allowed to see what the design is going to look like and asked who
50 would own the existing alley after the new one is dedicated.

52 Mr.Willis said the existing alley would need to be vacated, with protection for utilities.

54 Mr. Keller asked if the alley were moved up that far, how would the neighbors access the rear of their properties
55 and also how Richmond Power&Light lines would be accessed.

57 Mr. Weigle said that most new McDonald's were building utilities underground with the transformer on their
58 property. He said he had talked with property owners regarding rear access and has assured them he will
59 accommodate their needs. He said there would be no access from McDonald's parking area onto the alley and
60 the Sanitary District will pick up off their property.

62 Mr.Willis suggested the dedication be continued for one week to allow him to meet with McDonald's engineer and
63 survey the site.

65 Mr. Surles still expressed concern about the traffic and also whose responsibility it would be to maintain the

1 buffer zone.

3 Mr.Willis indicated that Captain Willis could assist with the site visit and make recommendations.

5 Mr.Willis moved to continue the dedication of an alley at 14 South 18th Street to January 12, 1989,seconded by
6 Ms. Hauptstueck and on unanimous voice vote the motion was carried.

12 Personnel Policy Changes

14 A memo from Ms. Roberson explained to the Board that changes had been made to the personnel policy-to
15 clarify procedures for OSHA, EEOC and Affirmative Action complaints and to establish past practice for
16 vacation carry over. She said Mayor Waltermann has approved the changes.

18 Ms. Hauptstueck moved to approve the changes in the Personnel Policy as presented, seconded by Mr. Willis
19 and on unanimous voice vote the motion was carried.

23 Appoint to Plan Commission

25 Ms. Hauptstueck moved to reappoint Ms. Susan Silberstein to represent the Board of Public Works and Safety
26 on the Plan Commission for a one year term,seconded by Mr.Willis and on unanimous voice vote the motion was
27 carried.
