HomeMy Public PortalAbout08-11-1988 BOARD OF PUBLIC WORKS AND SAFETY OF THE CITY OF RICHMOND, INDIANA, AUGUST 11, 1988 1 The Board of Public Works and Safety of the City of Richmond, Indiana, met in regular session August 11, 1988 2 at the hour of 9:00 A.M. in the Municipal Building in said City. Mr. Barden presided with Mr. Brown and Mr.Willis 3 in attendance. Absent: None. The following business was had to-wit: 4 5 APPROVAL OF MINUTES OF AUGUST 4. 1988 6 7 Mr.Willis moved to approve the minutes of the previous meetings as prepared,seconded by Mr.Barden and 8 on unanimous voice vote the motion was carried. 9 10 APPROVAL OF CLAIMS FOR PAYMENT 11 12 Mr. Willis moved to approve claims in the amount of 749,617.57 for payment, seconded by Mr. Barden and on 13 unanimous voice vote the motion was carried. 14 15 PUBLIC REQUESTS AND COMMENTS 16 17 American Cancer Society Toll Road 18 19 Ms.Jo Makela, Unit Coordinator of the local unit of the American Cancer Society, requested permission from the 20 Board for the annual Toll Road sponsored by the Army Reserves. The event will be held on August 27, 1988 21 from 10:00 AM to 2:00 PM and will be at West Main and N W 5th, W. National and K-Mart, South 18th and East 22 Main,Garwood and E. National Road and E.National Road and Richmond Square Mall. 23 24 Captain William said he had no problems with the request. 25 26 Mr. Barden said the request should be approved subject to the City being held harmless and the participants 27 entering the roadway at their own risk. 28 111 29 Ms. Makela stated they would not be stopping any traffic. 30 31 Mr. Willis moved to approve the American Cancer Society Toll Road on August 27, 1988, subject to the City 32 being held harmless from any persons entering the roadway, seconded by Mr. Brown and on unanimous voice 33 vote the motion was carried. 34 35 Unsafe Premises at 739 South 5th Street 36 37 Mr. Robert Bever,Attorney at Law, representing Mr. Emory Foltz,owner of unsafe premises located at 739 South 38 5th Street, requested a stay of the Demolition Order on the property. Mr. Bever said that Mr. Foltz desired to 39 demolish the accessory building and repair the main structure rather than have the City proceed with the 40 demolition order. Mr. Bever said that Mr.Tom Pugh has submitted a bid for demolition of the accessory building 41 and they were in the process of getting quotes for repair of the main structure. 42 43 Mr. Barden asked if a compliance schedule had been developed and Mr. Pugh informed the Board that as far as 44 demolition of the accessory building, he would start the first of the next week and complete the job within two to 45 three days. 46 47 The Board was informed there was no estimate of time on the other quotes. 48 49 Mr. Dennis Bronston informed the Board this property had been the focus of two hearings. He said it would be 50 appropriate for the accessory building to be removed, but he would like to see a compliance schedule submitted 51 on repairs of the main structure within two weeks. Mr. Bronston did inform the Board that they had been unable 52 to serve notice of hearing directly to Mr. Foltz,but the hearings had been advertised. 53 54 Mr. Emory Foltz,owner of record,told the Board that his prior tenants had trashed and abandoned the property. 55 He added that the heating plant in the structure is operable. 56 57 Mr.Willis asked if a local agent could be named since Mr. Foltz was a resident of Ohio and Mr. Bever said that Mr. 58 Terry O'Maley,Attorney for Mr. Foltz,could be a designated local agent. 59 60 Mr. Barden suggested the demolition order could be modified to allow wreck and remove or repair to code within 61 sixty days,with a compliance schedule and performance bond to be posted within two weeks. 62 63 Mr. Bronston said the structure would need to be rewired, replumbed and the heating checked. 64 65 Mr. Brown moved to modify the Unsafe Order on premises located at 739 South 5th Street to wreck and remove Board of Works Minutes Cont'd August 11, 1988 Page 2 1 or repair to code within sixty days with a 5,000.00 performance bond to be posted and compliance schedule to 2 be submitted; immediate demolition of the accessory building and the premises to be inspected within forty-five 3 day for compliance,seconded by Mr.Willis and on unanimous voice vote the motion was carried. 4 5 Complaint of Nuisance at 101 NW 11th 6 7 Mr. Bobbie Sams,owner of 101 NW 11th, presented the Board a drawing of the construction site and the location 8 of the mounds of dirt on the site. 9 10 Mr. Bronston told the Board that he had received several complaints on this property, but upon inspection had 11 not observed any violations. He said the structure had been under construction for one year and there are 12 exiting dirt mounds and weeds. He said th e building permits have no time limitations for construction and they 13 feel they are good as long as construction is continuing. 14 15 Mr. Sams told the Board he had suffered some health problems and he hopes to complete construction within 16 one year. He said he has spoken with the neighbors about the removal of the trees on the property and the need 17 to remove the stumps. He said he has also had one pile of dirt removed and only left enough for the proper 18 excavation to complete the landscaping and utility hook ups when the construction was completed. 19 20 Mr.Willis suggested to Mr.Sams that he cover the piles of dirt with plastic to cover and to prevent the weeds from 21 growing through. 22 23 Mr.Bronston said there was also a commode on top of one of the dirt piles,but that had been removed. 24 25 Mr. Barden said there appears to be no violation and he thanked Mr. Sams for appearing before the Board. 26 27 DEPARTMENT REQUESTS AND COMMENTS 28 29 LAW OFFICE 30 31 Handicapped Parking on State Highways 32 33 Mr. Barden said the State Department of Highways had notified the City that all handicapped parking spaces and 34 any other changes on State Highways need to be considered by them in the future. 35 36 Captain Williams commented that he will forward all locations that have been approved locally and they will 37 retroactively approve them. 38 39 Update of Traffic Code 40 41 Mr. Barden stated that Captain Williams will compare the City Code regarding traffic with any changes that have 42 been made and submit a report for the ordinance to be amended. 43 44 Curb Damage - NW L Street 45 46 Mr. Barden reported that the Police Department and Street Department had investigated the curb damage on NW 47 L Street and found there was not enough damage to attribute it to any one violator. He said the Street 48 Department will repair the damage. 49 50 Hoosier Celebration '88 51 52 Ms. Sandy Lingle informed the Board that the local celebration for Hoosier Celebration '88 will be on September 53 3, 1988 in the Johnson Street area of the Gorge. She said the event will start at 1:00 PM with activities for families 54 and children. She said in the evening will be a free concert by Lionel Hampton. Ms. Lingle told the Board the 55 major concern in getting people in and out of the area. She said a foot bridge will be erected for access across 56 the gorge from Sim Hodgin, but access is also needed from North 2nd Street,which is not a good area to access 57 from. 58 59 Ms. Lingle said they were suggesting persons be shuttled in and out of the area. She said they would also need 60 assistance with traffic and security for Friday evening. 61 62 Mr. Larry Parker explained the concert and activities would be held at the opposite end of the meadow from the 63 old Johnson Street Substation. 64 65 Mr.Willis asked if pedestrian traffic only should be allowed in the area east of the Main Street Bridge area an Ms. /� Board of Works Minutes Cont'd August 11, 1988 Page 3 1 Lingle said the area was very narrow and they did not want vehicles i n that area. 2 3 Captain Williams said the 2nd Street area was the only workable way to get in and out and he felt they should use 4 shuttle service exclusively. 5 6 Mr. Barden said the Board also needed to waive the restrictions of the vendor ordinance for the event. He said 7 insurance coverage has already been obtained and the Park has approved all activities. Mr. Barden said that 8 would leave the traffic control and shuttle left and recommended they map out a definite route for approval by the 9 Board at its next meeting. 10 11 Captain Williams said he felt they should only consider shuttle service or crossing from Sim Hodgin. 12 13 Mr. Bronston asked if approval had been obtained from the Indiana Department of Natural Resources regarding 14 the construction of the bridge and Mr. Barden said that had all been arranged. 15 16 Mr. Barden requested a written report for the next Board meeting regarding the traffic situation. 17 18 Mr. Brown moved to waive the restrictions of the Transient Vendor Ordinance for the Hoosier Celebration '88 19 activities to include all groups associated with the event,seconded by Mr.Willis and on unanimous voice vote the 20 motion was carried. 21 22 Mr. Barden said the Board should also consider a sound control variance at their next meeting. 23 24 Mr.Willis suggested temporary traffic signage be used to accommodate the traffic. 25 26 The Board thanked Ms. Lingle and Mr. Parker for the work on the celebration and commended them for the 27 planned events. 28 29 PURCHASING DEPARTMENT 30 31 Award Contract for Architectural Services for Park Maintenance Complex 32 33 The Board received a memo from the Purchasing Department recommending the contract for architectural 34 supervision for the construction of the Park Maintenance Complex to RG Maze&Associates at a total price of 35 27,025.00. 36 37 Mr. Barden said it had been cleared with bond attorney and the City Controller. 38 39 Mr. Willis moved to award the contract for Park architectural services to RG Maze & Associates at 27,025.00, 40 seconded by Mr. Brown and on unanimous voice vote the motion was carried. 41 42 ADJOURNMENT 43 44 There being no further business,on a motion duly made,seconded and passed the meeting was adjourned. 45 46 47 48 Kenneth E.
