ORDINANCE NO. 9-2022
A SPECIAL ORDINANCE VACATING
A PUBLIC WAY (ALLEY)
WHEREAS, Earlham College has petitioned the Common Council of Richmond,
Indiana, requesting that a portion of a dedicated public way (alley) be
vacated, which public way has been identified by Petitioner in a legal
description and map showing the portion of the parcel to be vacated,
which Petition to Vacate is attached hereto as Exhibit A and is
incorporated by reference and made a part of this Ordinance; and
WHEREAS, The only abutting landowners are as follows:
(a) Earlham College
801 National Road West
Richmond,IN 47374
; and
WHEREAS, Common Council, pursuant to Indiana Code 36-7-3-12, conducted a
public hearing on said petition on March 9, 2022, after publishing legal
notice thereof at least 10 days in advance of said hearing as required by
statute; and
WHEREAS, The Richmond Advisory Plan Commission conducted a public hearing on
said petition on February 24, 2022, after publishing legal notice thereof at
least 10 days in advance of said hearings; and
WHEREAS, It is desirable to vacate said public way.
NOW, THEREFORE, be it ordained by the Common Council of the City of
Richmond, Indiana,that subject to the preservation of easements for existing utilities,the
portion of dedicated alley described in attached Exhibit A is hereby vacated and that
ownership of such land shall vest in the abutting property owners.
Passed and adopted this 7th day of March, 2022, by the Common Council of the
City of Richmond, Indiana.

VACATION PETITION NO.___
A PETITION TO VACATE A DEDICATED ROADWAY
Comes now the owner of the real estate abutting a dedicated roadway more
particularly described herein and, pursuant to Indiana Code § 36-7-3-12, petition for
vacation of said dedicated roadway.
The dedicated roadway to be vacated is outlined in red on attached Exhibit A
and is described as follows,to wit:
0.044 Acres
Situated in the Northwest Quarter,Section 5,Township 13 North,Range I West,City of
Richmond,Wayne Township,Wayne County,Indiana,being a Vacation of a 12.00 foot
wide alley,running east and west,south of Lots 1,2,and 3,in Earlham Place Addition,as
described in Plat Book 4,Page 53,as recorded in the Wayne County Recorder's Office,as
shown on a survey certified by Gordon E.Moore,P.S.20400025,as Beals-Moore&
Associates,Inc.,dated 16 January 2022,W.O.2021-017,Drawing No.C-4404,and being
more particularly described as follows;
Commencing at an iron rod found at the southwest corner of Lot 4,in said Earlham Place Addition;
thence North 00°20'29"West(bearings are based upon GPS Coordinates,Projection Set:
USA/NAD83/Indiana East)54.00 feet along the west line of said Lot 4,also being the east line of
College Avenue,to the northwest corner of said lot,also being the POINT OF BEGINNING for the
tract herein described;
thence North 00°20'29"West 12.00 feet,continuing along the east line of College Avenue,to the
southwest corner of Lot 3,in said addition;
thence North 89°34'25"East 160.00 feet along the south lines of Lots 3,2,and 1,to the west line of
a 20.00 foot wide alley,in said addition;
thence South 00°20'29"East 12.00 feet along the west line of said 20.00 foot wide alley,to the
northeast corner of said Lot 4;
thence South 89°34'25"West 160.00 feet along the north line of said Lot 4,to the point of
beginning,containing 0.044 acres,more or less,being subject to all legal easements of record.
The undersigned believes the above property should be vacated for the following
reasons:
a. Vacation of the existing 12.00 foot wide Alley will allow development of Lots 1,2.3,&
4,in Earlham Place Subdivision. An easement will be prepared over the 12.00 foot
wide strip for future maintenance of an existing sanitary sewer.
b. There will be easement provided through the new development to permit Ingress&
Egress from the North/South 20 foot wide alley,North to National Road West.
c. The Vacation will not prohibit access to churches,schools,or public buildings.
d. The Vacation will not hinder use of a public way by the neighborhood. All properties
south of the Vacated alley will continue to have access to College Avenue and to the 20
foot wide alley East of the Lots.
