I, Carol J. Wright, being duly sworn and say, I am the receptionist of
The Star-News, a weekly newspaper published at McCall, in the County of Val-
ley, State of Idaho; that said newspaper is in general circulation in the county
of afore said and is a legal newspaper; that the PUBLIC NOTICE, a copy of
which is enclosed hereto and is a part hereof, was published in said newspaper
once a week for a period of three weeks in the regular and entire issue of every
number there of during the period of time of publication, and was published in
the newspaper proper and not in a supplement; and that publication of such
notice began June 2, 2011 and ended June 16, 2011.

In the District Court of the Fourth Judicial District of
the State of Idaho, In and For the County of Valley
Case No. CV 2011-173C
In the Matter of: City of McCall an Idaho municipal
corporation, and Payette Lakes Recreational Water and
Sewer District, an Idaho political subdivision, Joint Pe-
titioners.
Comes now, clerk of the court, who hereby gives
notice of filing of petition for judicial confirmation by the
petitioners, City of McCall, Valley County, Idaho, and
Payette Lakes Recreational Water and Sewer District as
follows:
To: The citizens of McCall, Idaho, and other interest-
ed parties. 1. Pursuant to Idaho Code Section 7-1301 et.
seq. the City of McCall and Payette Lakes Recreational
Water and Sewer District have petitioned the district
court for judicial review and confirmation that:
a. The duties and obligations contained in the settle-
ment agreement dated October 20, 2010, are ordinary
and necessary liability of the petitioners.
b. By incurring those liabilities the petitioners are pro-
tecting the health, safety and welfare of their respective
constituents; and
c. Those liabilities are with the “ordinary and neces-
sary expense” exception to the voter approval and sink-
ing fund requirements of Article VIII, Sec. 3 of the Idaho
Constitution.
2. This Notice of Filing shall be published at least
once a week for three (3) consecutive weeks in the of-
ficial newspaper of general circulation in the jurisdiction,
The Star-News, and shall further be posted at the main
door of City Hall, City of McCall, 216 E. Park St., McCall,
Idaho and on the main door of Payette Lakes Recre-
ational Water and Sewer District at 201 Jacob Street,
McCall, Idaho, for a period of not less than 30 days prior
to any hearing on this matter. Interested parties who wish
to review the petition or any of the documents referred to
or incorporated in the petition may do so during normal
business hours at the office of the city clerk, McCall, City
Hall, 216 East Park Street, McCall, Idaho.
3. Any interested party with standing seeking to
participate in this matter may appear in these pro-
ceedings as provided by law by written appearance
or answer to the petition filed with the clerk in the
above-entitled court at any time prior to the date set
for hearing on the petition, which has been set for
the 23rd day of June, 2011 at 4:30 p.m. or as soon
thereafter as the matter may be heard, at the above-
entitled court, at the Valley county courthouse, 219
north main,cascade,idaho.
