RESOLUTION NO. 2010 -01 -04
A RESOLUTION AUTHORIZING FINAL ACCEPTANCE OF THE VILLAGE AT GRAND PARK
FILING 1 WATER AND STREETS SUBDIVISION IMPROVEMENTS
WHEREAS, Cornerstone Winter Park Holdings LLC (the "Applicant executed a
Subdivision Improvements Agreement, dated June 17, 2008, to guarantee completion of certain
required improvements for the subdivision known as the Village at Grand Park Filing 1.
WHEREAS, the Applicant has applied to the Town for final acceptance of such required
subdivision improvements.
WHEREAS, Town staff has reviewed such application, has inspected such
improvements, and has certified to the Board of Trustees that all such required improvements
meet the requirements for final acceptance by the Town.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE
TOWN OF FRASER, THAT:
(1) The Board of Trustees finds and determines that: (a) All required water and street
and drainage improvements for the Village at Grand Park Filing 1 have been satisfactorily
completed in accordance with the approved plans and specifications for such required
improvements and have been preliminarily accepted by the Town; (b) all warranty periods
provided in the Fraser subdivision regulations and the Subdivision Improvements Agreement
have ended and any defects found upon inspection of the required improvements have been
satisfactorily remedied by the Applicant; and (c) with the exception of payment of fees, all other
applicable requirements, if any, contained in said subdivision regulations, the Town's design
and construction standards and the Subdivision Improvements Agreement have been satisfied.
(2) The Board of Trustees hereby authorizes final acceptance of said required
subdivision improvements, conditioned upon receipt of payment for all applicable fees within
fourteen business days. If such conditions are not satisfied within said fourteen day period, this
resolution shall be null and void and of no effect.
DULY MOVED, SECONDED, AND ADOPTED THIS 17 DAY OF MARCH, 2010.
