THIS SECOND AMENDMENT TO COOPERATIVE AGREEMENT made and
entered into this ! H^ day ofz 1979, by and between the
City of McCa11, a municipal corporation located in Valley
County, Idaho, hereinafter referred to as the City, and the
PAYETTE LAKES WATER & SEWER DISTRICT, Valley County, Idaho,
a sewer district organized and existing under and by virtue
of Chapter 32, Title 42, Idaho Code, and lying adjacent and
contiguous to the geographical boundaries of the City of
McCall, Idaho, hereinafter referred to as the District,
WITNESSETH
WHEREAS, the parties hereto made and entered into a
Cooperative Agreement dated December 15, 1977, hereinafter
referred to as said Agreement;
WHEREAS, the parties hereto made and entered into a
First Amendme7t to Cooperative Agreement dated the 4th day
of December, 1978, (hereinafter referred to as said First
Amendment); and
WHEREAS, the parties now desire to make this second
amendment to said Agreement as hereinafter set forth.
NOW, THEREFORE, in consideration of said Agreement and
in consideration of the additional covenants and agreements
hereinafter set forth, the parties hereto do hereby amend
said Agreement by the addition of two new sections thereto
to read as follows:
Section 16. PONDEROSA STATE PARK INTERCEPTOR LINE. It
is agreed by and between the parties hereto that the District
shall transport sewerage effluent from Ponderosa State Park
for the City, to the sewage treatment facility described in
said Agreement and that in order to do so the District hereby
specifically agrees to oversize that certain District Sewer
interceptor extending from the vicinity of said Ponderosa
State Park to said sewage treatment facility, the local cost
of which is estimated to be $3,500.00 which the City agrees
to pay to the District, plus interest at 7% per annum, when
such line is operational as follows:
$3,500.00 at 7% for 20 years, at an annual cost of
$330.40 or at a monthly cost of $27.53 over said 20
year period.
Section 17. COST OF TRANSPORTING EFFLUENT. The cost of
transporting said sewage effluent from Ponderosa State Park
to the sewage treatment facility which the City shall pay to
the District from the time said interceptor line is operational
is the sum of $25.00 per month. At such time as operational
experience provides an actual cost of transportation of such
effluent, such costs shall be pro -rated between the City and
the District ?'ased upon volume of effluent produced from
Ponderosa State Park and District sewer users.
It is further specifically agreed by and between the
parties hereto that in all other respects said Cooperative
Agreement as amended December 4, 1978, shall be and remain
in full force and effect.
IN WITNESS WHEREOF, the parties hereto have caused this
Second Amendment to Cooperative Agreement to be executed by
its respective officials pursuant to due resolution of each,
the day and year first above written.
