HomeMy Public PortalAboutr 07:164P00111#ion of toe j6orVg4 of &r #ere#, �q- 4, No. 07 -164 Date of Adoption Ame 14, 20 07 AUTHORIZING MAYOR TO EXECUTE AN AGREEMENT WITH THE COUNTY OF MIDDLESEX FOR TRANSPORTATION SERVICES WHEREAS, the Borough of Carteret operates tluee vehicles, one of which has wheelchair accessibility for those in need of transportation and will continue to apply for Federal Transit Administration (FTA) grants to receive new and replacement vehicles as needed; mid WHEREAS, as a grant recipient, the Borough is required to coordinate transportation services with the County; mid WHEREAS, the Borough has represented its interest and commitment to provide the most efficient and effective transportation for eligible Borough residents; NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough Carteret as follows: 1. That the Mayor is hereby authorized and directed to execute the attached agreement with the County of Middlesex on behalf of the Borough. 2. That a copy of the executed agreement be forwarded to the County of Middlesex as requested. Adopted this 14" day of June, 2007 and certified as a trite copy of the original on June 15, 2007, LINDA A. RIVERA, Assistant Municipal Clerk RECORD OF COUNCIL VOTE X - Indicate Vote An - Absent NV - Not Voting XOR - Indicates Vote to Overmle Veto Adopted at a meeting of the Municipal Council AGREEMENT TO COORDINATE TRANSPORTATION SERVICES BETWEEN MIDDLESEX COUNTRY AND THE BOROUGH OF CARTERET This agreement, made this 2nd ay of FebruarY between the County of Middlesex, hereinafter called the "County" and the Borough of Carteret, a municipal corporation of the State of New Jersey, hereinafter know as the `Borough ". Whereas, the Borough operates three vehicles, one of which has wheelchair accessibility for those in need of transportation and will continue to apply for Federal Transit Administration (FTA) grants to receive new and replacement vehicles as needed; and Whereas, as a FTA Section 5310 grant recipient, the Borough is required to coordinate transportation services with Middlesex County; and Whereas, the Director of the Carteret Office on Aging and the Director of the Middlesex County Department of Transportation have met and discussed the coordination of services between the two programs to the benefit of the elderly and disabled of the Borough; and Whereas, the Borough has represented its interest and commitment to provide the most efficient and effective transportation for eligible Borough residents; Now, therefore, in consideration of satisfying the Borough's shared services requirement under FTA Section 5310 agreement, the parties hereto do mutually promise and formally agree as follows: The Borough and the County agree to provide services and operate the vehicle in such a manner as to enhance the transportation opportunities for senior citizens and persons with disabilities in the Borough. The Borough agrees to coordinate the use of the Section 5310 vehicle with the County to the fullest extent. Transportation services to senior citizens and persons with disabilities will be provided to Borough residents, and when possible, the Borough will accept additional requests and /or refen'alsafrom the County, focusing particularly on trips originating within the Borough with destinations in the Borough. Further, the County will reciprocate through the provision of existing County transportation services, particularly focusing on transportation to destinations outside of the Borough of Carteret. The Borough and the County fiirther agree to abide by the required terms and conditions for operating said vehicle in accordance with applicable federal and state statutes. 4. The Borough further agrees to maintain said vehicle in accordance with a daily maintenance schedule at it's own cost and expense as well as insurance, fuel and driver salary. The Borough and County shall abide by all provisions and requirements regulating the issuance of a Commercial Driver's License (CDL). The Borough agrees to provide said services without regard to age, color, gender, sexual orientation, disability, race, relig applicant or recipient of services. on, national origin, or marital status of the 7. The Borough and the County agree to provide services in accordance with the Title II of the Americans with Disabilities Act (ADA), which requires that all Programs, services and activities that are contracted out by a govermnent entity, must be accessible to a person with disabilities. The Borough and the County will comply with the provisions of Title II of the ADA. S. The Borough further agrees to explore future coordination opportunities with the County that serves to improve services delivered to the residents of the Borough. In witness whereof, the parties hereto have caused this Agreement to be sign and attested to by the proper corporate officers and affixed with their corporate seals on the days set forth above.
