RESOLUTION NO. 22-9986
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF OPA-
LOCKA, FLORIDA, AUTHORIZING THE CITY MANAGER TO
PROVIDE VENDORS OF THE OPA-LOCKA FLEA MARKET WITH
AN EXEMPTION FOR A LOCAL BUSINESS TAX RECEIPT IF THE
BUSINESS QUALIFIES PURSUANT TO §205.162, FLORIDA
STATUTES; TO FURTHER EXEMPT PAYMENT FOR OTHER FEES
ASSOCIATED WITH OBTAINING A BUSINESS TAX RECEIPT FOR
A PERIOD OF ONE YEAR; PROVIDING FOR INCORPORATION OF
RECITALS; PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City of Opa-Locka currently has a program and application in
place for the exemption of business tax receipts (formally occupational license) if a
business qualifies pursuant §206.162, Florida Statutes; and
WHEREAS, on May 20, 2022, the City of Opa-Locka received notification that
leases for vendors of the Opa-Locka Flea Market, located at 12605 NW 42nd Avenue, will
expire on June 30, 2022 and that those businesses will be closed indefinitely; and
WHEREAS, due to the establishments closing, the Interim City Manager brought
this resolution forward to the City Commission as an add-on item with the intent of
assisting vendors who occupy space at the Opa-Locka Flea Market to have business tax
receipts waived for a period of year; and
WHEREAS, the intent of the resolution is also to request waiver of all fees
associated with Annual Local Business Tax Receipt to include: certificate of use; water and
sewer verification, mechanical, electrical, plumbing fees and code enforcement inspection
services for a period of one year; and
WHEREAS, the City Commission accepts the recommendation of the Interim City
Manager and desires to continue to approve application exemptions for those flea market
and other businesses that qualify for exemption pursuant §206.162, Florida Statutes; and
WHEREAS, further, the City Manager is authorized to exempt payment for other fees
associated with obtaining a business tax receipt for a period of one year.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF
THE CITY OF OPA- LOCKA, FLORIDA:
SECTION 1. The recitals to the preamble herein are incorporated by reference.

SECTION 2. The City Commission of the City of Opa-Locka, Florida hereby authorizes
the City Manager to provide vendors of the Opa-Locka Flea Market with an exemption for
a Local Business Tax Receipt if the business qualifies pursuant to §205.162, Florida
Statutes and if otherwise permitted by Florida law. The City Commission further
authorizes the City Manager to exempt payment for other fees associated with obtaining
a Business Tax Receipt to include: certificate of use; water and sewer verification,
mechanical, electrical, plumbing fees and code enforcement inspection services for a
period of one year.
SECTION 3. Sections of this Resolution may be renumbered or re -lettered and
corrections of typographical errors which do not affect the intent may be authorized by
the City Manager, following review by the City Attorney, without the need for public
hearing, by filing a corrected copy of same with the City Clerk.
SECTION 4. This Resolution shall take effect upon adoption and is subject to the
approval of the Governor or Governor's Designee.

Short Title:
A resolution authorizing the City Manager to forego collection of the City of Opa-locka Fees associated with
Occupational Licenses for one year for all vendors of the Opa-locka Flea Market.
Staff Summary:
On May 20, 2022, the City of Opa-locka administration was made aware that the owners of the Opa-locka Flea -
Market located at 12605 NW 42nd Avenue lease expires on June 30, 2022.
As a result of the establishment closing, the City of Opa-locka would like to assist the business owners by
foregoing collection of all fees associated with obtaining an occupational license if they decide to open their
business at a new location within the City of Opa-locka.
Financial Impact:
Numerical value of Business License Fee is an estimate as a different fee is calculated for each business.
Maximum Liability is a calculation of all vendors (approximately 700) receiving the benefit.
Expected Liability is a calculation of vendors the City expects will accept the benefit, which is
approximately 175.
Proposed Action:
Staff recommends the City Commission approve the legislation in attempt to aid the business owners.

Dear Valued Merchant,
We regret to inform you that our lease with the owners of 12691 and 12705 NW 42 Avenue in
Opa Locka, Florida expires on June 30, 2022, which means after more than 40 years'
operating as a pillar of commerce and culture in our community, the Opa Locka Hialeah Flea
Market will permanently close its doors.
We are extremely proud of the job we have done running the flea market these past five
years, including working with you to survive and even thrive after Hurricane Irma, as well as
contending with the ongoing global pandemic. We have always appreciated your hard work
and partnership.
That said, it is important for you to know that your merchant's license agreement and
occupancy license will expire on June 20, 2022. Also, as part of the property owners'
move -out requirements. you will be responsible for the prompt and timely removal of all
goods, inventory and other property that you are storing at the flea market. Any items left on
the premises after closure will be discarded.
Please know that our goal in providing you with this notice is so that you will have time to
make the appropriate arrangements for your business. Should you have any questions, direct
them to one of our three onsite managers.
