HomeMy Public PortalAbout07-02-1987 BOARD OF PUBLIC WORKS AND SAFETY OF THE CITY OF RICHMOND,INDIANA, JULY 2,1987 1 The Board of Public Works and Safety of the City of Richmond, Indiana, met in regular session July 2, 1987 at 2 the hour of 9:00 A.M. in the Municipal Building in said City. Ms.Silberstein presided with Mr. Brown and Mr.Willis 3 in attendance. Absent: None. The following business was had to-wit: 4 5 INOPERABLE VEHICLE HEARINGS 6 7 304 SW E Street 8 213/231 1/2 NW J Street 9 458 SW 3rd Street 10 11 Mr. Bronston requested the hearings scheduled for 304 SW E Street and 458 SW 3rd Street be.dismissed since 12 the vehicles have been removed. 13 14 Mr. Brown moved to dismiss the hearings on nuisances located at 304 SW E Street and 458 SW 3rd Street, 15 seconded by Mr.Willis and on unanimous voice vote the motion was carried. 16 17 Mr. Bronston requested the hearing scheduled for 231/231 1/2 NW J Street be dismissed and the complaint be 18 withdrawn since the matter has been referred to the Traffic Division of the Police Department for action. 19 20 Mr. Brown moved to dismiss the hearing scheduled for 231/231 1/2 NW J Street and to withdraw the complaint, 21 seconded by Mr.Willis and on unanimous voice vote the motion was carried. 22 23 APPROVAL OF MINUTES OF F JUNE 25,1987 24 25 Mr. Brown moved to approve the minutes of the previous meeting as prepared, seconded by Mr. Willis and on 26 unanimous voice vote the motion was carried. 27 28 APPROVAL OF CLAIMS FOR PAYMENT 29 30 Mr. Brown moved to approve claims for payment in the amount of 157,590.57 seconded by Mr. Willis and on 31 unanimous voice vote the motion was carried. 32 33 TABLED ITEMS 34 35 BLOCK PARTY GUIDELINES 36 37 Ms. Silberstein stated the proposed guidelines for block parties were being returned to the agenda for action. 38 She said the Board felt guidelines needed to be established that would provide a fair and equitable system for 39 closing streets for block parties. She added that suggestions had been incorporated into the guidelines from the 40 Police Department, Street Department and the City Attorney. Ms. Silberstein said there is no absolute right to 41 close a public street for a party and it should be done only in the spirit of a neighborhood party. 42 43 Ms. Silberstein read the following proposed guidelines: 44 45 1. All requests for street closings for neighborhood block parties must be made be a contact person 46 who is a resident of the block(s) proposed to e closed, and who agrees to be present at the block party 47 and assume responsibility for its orderly conduct and clean-up. 48 49 2. All requests must receive the advance approval of the Police Department as to location, date, and 50 time, based on considerations deemed relevant by the Police Department such as traffic patterns and 51 congestion, and history or likelihood of disturbances. 52 53 3. No waivers of the transient vendor ordinance or the noise ordinance will be issued in conjunction with 54 a block party. 55 56 57 4. The Board of Works will only approve street closing requests for parties upon satisfactory demonstration that such parties are in fact neighborhood parties. This means parties which have 58 substantial neighborhood cooperation and support, and which anticipate attendance primarily by 59 neighborhood residents. As evidence of such neighborhood support, the Board may in its discretion 60 require the contact person to contact neighborhood residents and report their comments; it may also 61 consider the past history of block parties in the particular area. 62 63 5. Requests for street closings must be made at least one week prior to the proposed party. 64 65 ti° 1 Board of Works Minutes Cont'd July 2, 1987 Page 2 1 6. Participants in approved neighborhood block parties will be expected to thoroughly clean up, and the 2 designated contact person will be held responsible for seeing that this is done. The contact person 3 should contact in advance the Street Department if barricades are needed, and the Sanitary District if 4 special receptacles are desired. 5 6 7. Approval of all requests will be conditional and may be revoked upon violation of any ordinances or 7 laws during the course of the party, or for any reason deemed sufficient by the Richmond Police 8 Department to require the discontinuance of a block party. 9 10 Ms. Silberstein said she did not feel the proposed guidelines were unduly restrictive. 11 12 Ms. Roberta Miller of 618 North 12th Street complained to the Board regarding the block party held annually by 13 the Road Runners on North 12th Street. 14 15 Ms. Silberstein stated the guidelines would address that situation and all occurrences of block parties. She said 16 the Board could also require the approval of the Police first, but they are currently trying to get a policy into place 17 that is not too rigid. Ms. Silberstein added that parties on private property are a police matter. 18 19 Mr. Brown said he would like to have the interested party or contact persons present at the Board meeting and 20 Ms. Silberstein said she had given that some consideration, but felt it might be too restrictive for persons 21 working. 22 23 Mr. Brown commented if there were questions the Board could always table the matter for the contact person to 24 be present. 25 26 Mr. Willis said the guidelines as proposed should be tried and if they need to be enhanced,the Board could look 27 at them again. 28 29 Mr.Willis moved to adopt the Guidelines for Board of Works Approval of Block Parties as proposed, seconded 30 by Mr. Brown and on unanimous voice vote the motion was carried. 31 32 PUBLIC REQUESTS AND COMMENTS 33 34 RESIDENTIAL HANDICAPPED PARKING REQUEST-2102 GLEN COURT 35 36 The request of Mr. Robert Evans for a residential handicapped parking space at 2102 Glen Court was presented 37 to the Board for action. 38 39 Captain Williams stated the request meets the guidelines. 40 41 Mr. Brown moved to approve a residential handicapped parking space at 2102 Glen Court, seconded by Mr. 42 Willis and on unanimous voice vote the motion was carried. 43 44 REQUEST FOR TEMPORARY CLOSING OF NORTH 12TH STREET-ROAD RUNNERS 45 46 The Road Runners Motorcycle Club requested the temporary closing of North 12th Street between North F and 47 North G on Saturday, September 5, 1987 from 6 PM to 12 Midnight. The street closing would be for hosting 48 persons from Hickman County, Tennessee for an annual party. They requested using North 12th Street since 49 their clubhouse is located there and they would have the facilities needed to prepare food. They indicated in 50 their written request that they had contacted the few persons residing in the area and stated they have no 51 objections. They also stated they would do their own security and request police assistance if necessary. 52 53 Ms. Silberstein stated the request indicated a substantial number of persons attending the party would be from 54 out of state which is not within the guidelines for block parties. 55 56 Mr. Brown stated the event seems to be getting larger and larger each year and the Board encouraged them to 57 consider alternative locations last year. 58 59 Ms. Silberstein stated she felt they were looking at a request for a private party without having to rent a location. 60 61 Mr. Willis moved to deny the request of the Road Runners Motorcycle Club for a temporary street closing of 62 North 12th Street based on past experience and it does not meet the guidelines for block parties,seconded by 63 Mr. Brown and on unanimous voice vote the motion was carried. 64 65 Ms. Silberstein explained her vote as based on past history and it not being a neighborhood party. Board of Works Minutes Cont'd July 2, 1987 Page 3 1 COMPLAINT ON PROPERTY AT SOUTH E AND 16TH STREETS-COUNCILMEMBER LYNN MORRIS 2 3 Councilmember Lynn Morris approached the Board regarding the condition of a property located on the South 4 West corner of South E and 16th Streets. Ms. Morris stated she has received many complaints and forwarded 5 them to the proper departments without action. She said Mr. Bronston suggested taking the problem before the 6 Board to see what could be done. 7 8 Ms. Morris commented that the property is deteriorating and no efforts are being made to bring it to code. She 9 said the problem is causing surrounding properties to deteriorate and they are continuously being bought and 10 sold. 11 12 Also speaking on the problem was Mrs. Sophia Chagares. -Mrs. Chagares stated it was a very nice 13 neighborhood except for this deteriorating house. 14 15 Ms. Silberstein stated she was personally unfamiliar with the property,but would take a look at it. 16 17 Mr. Bronston informed the Board that this was an occupied house and has been the source of numerous 18 complaints. He said they have been contacted a number of times with legitimate concerns and the owners are 19 unresponsive. Mr. Bronston said the problem was not knowing if there was sufficient cause for the Planning 20 Department to deal with the property. He said there is currently some debris in the yard. Mr. Bronston shared 21 pictures of the property with the Board. 22 23 Mr. Brown stated the dwelling looks structurally sound, but is cosmetically in bad shape. 24 25 Ms. Morris said it was also starting to be a safety hazard at the intersection with the vegetation. 26 27 Mr.Willis commented the Board could deal with correcting hazards. 28 29 Ms. Silberstein indicated there could be a litter violation involved also. 30 31 Ms. Silberstein stated she was not certain on how to proceed on the complaint, but the City must utilize existing 32 ordinances and work within the parameters. 33 34 Mr. Bronston said all he has contacted has had difficulty deciding if they can apply an ordinance. 35 36 Mr. Martel Winburn,Wayne County Health Department,stated the matter could be a private suit and filed in small 37 claims court. 38 39 Mr.Willis suggested the neighbors might also check any restrictive covenants against any obnoxious use of the 40 property. 41 42 Ms. Morris said she felt this was a classic case for the peeling paint ordinance and feels there is a number of 43 violations that need to be aggressively pursued. 44 45 Mr.Willis said he would deal with the intersection hazard and Ms. Silberstein said she felt the Board should also 46 request a report on the ordinance dealing with exterior conditions of properties. 47 48 Mr. Winburn said he felt this was a private property nuisance and not a public nuisance. He said is a person is 49 denied the enjoyment of their property,they can have nuisances abated in court. 50 51 Ms. Morris said she would like to see a report on other ordinance violations involved. 52 53 Ms. Silberstein said she would like to have a report from Mr. Bronston regarding conditions, since without any 54 public remedy they could not defend action in court. She suggested a report be submitted to the Board from 55 Planning, Traffic and the Sanitary District. 56 57 Mr. Willis moved to request the Traffic Division of the Richmond Police Department to do a site survey of the 58 intersection of South 16th and E Streets and to request a report from the Department of Planning, Permits and 59 Inspection and the Sanitary District as any possible ordinance violations on the premises at 501 South 16th, 60 seconded by Mr. Brown and on unanimous voice vote the motion was carried. 61 62 DEPARTMENT REQUESTS AND COMMENTS 63 64 PURCHASING DEPARTMENT 65 Board of Works Minutes Cont'd July 2, 1987 Page 4 1 Set Date to Receive Quotes for Bus Bench Advertising 2 3 Ms. Stout requested the Board to table the item for one week for input from Ms. Janet McFarland, Transit 4 Manager. She said bid could still be received on the 30th of the month and be awarded prior to the contract 5 expiration or the contract could be temporarily extended. 6 7 PLANNING, PERMITS AND INSPECTIONS 8 9 Set Date for Inoperable Vehicle Hearings 10 802 North 8th Street 11 906 North I Street 12 827 North I Street 13 14 Mr. Bronston stated this item no longer action, since the nuisances had been referred to the Police Department. 15 16 202 North 15th-Repairs to be Completed 17 18 Mr. Bronston informed the Board that Mr. Barden had spoken with Mr. Hudson this morning and had been told 19 someone would be obtaining a permit today for repairs. He said he does not feel the repairs will be completed in a 20 timely manner, but a permit could be issued since,an Order to wreck and remove has not been sent out on the 21 property. 22 23 Ms.Silberstein said she felt the Order to wreck and remove should be instituted. 24 25 Reconsideration of Decision and Order on Inoperable Vehicle at 118 SW 14th St. 26 27 Ms. Silberstein stated that Ms. Dana Lewis had granted an extension of time on removal of this vehicle to July 28 25, 1987 which was not communicated to the Board. She said the Board had issued an order to remove within 29 ten days and they needed to modify the Order to remove by July 25, 1987. 30 31 Mr. Willis moved to modify the Decision and Order on a nuisance located at 118 SW 14th for the vehicle to be 32 removed by July 25, 1987, seconded by Mr. Brown and on unanimous voice vote the motion was carried. 33 34 Report on Removal of Inoperable Vehicles 35 36 Mr. Bronston reported the vehicles located at 1114 Green Street and 1214 Boyer Street had been removed and 37 the vehicle located at 1445 Harris was still remaining. 38 39 June Report on Weed Violations and Inoperable Vehicles 40 41 Ms. Dana Lewis, Weed Enforcement Officer and Inspector filed a report with the Board showing 75 certified 42 letters had been mailed on weeds, 18 telephone notifications had been made, 33 cut orders were issued for 43 mowing by contract and 31 lots moved that were right of way or city owned. 44 45 Ms. Lewis reported that 37 requests for removal of inoperable vehicles had been mailed with 10 vehicles 46 removed and 9 complaints filed with the Board. 47 48 Mr. Brown moved to accept and file the report on weed violations and inoperable vehicles,seconded by Mr.Willis 49 and on unanimous voice vote the motion was carried. 50 51 BOARD OF WORKS MISCELLANEOUS 52 53 Reset Date for Sale of Property on NW 11th Street 54 55 Mr.Willis moved to set August 10, 1987 at 9:00 AM as the date and time for a public hearing and the receiving of 56 quotes on the sale of property located on NW 11th Street,seconded by Mr. Brown and on unanimous voice vote 57 the motion was carried. 58 59 Conflict of Interest Statement- Firefighter Bill Russell 60 61 The Board received a Conflict of Interest Disclosure Statement from Firefighter Bill Russell, doing business as 62 Russell Painting Company on the painting of the amphitheater in Glen Miller Park. 63 64 Mr. Willis moved to accept the Conflict of Interest Statement of Firefighter Bill Russell, seconded by Mr. Brown 65 and on unanimous voice vote the motion was carried.
