HomeMy Public PortalAbout04-09-1987 ia-5 BOARD OF PUBLIC WORKS AND SAFETY OF THE CITY OF RICHMOND, INDIANA,APRIL 9,1987 1 The Board of Public Works and Safety of the City of Richmond, Indiana, met in regular session April 9, 1987 at 2 the hour of 9:00 A.M. in the Municipal Building in said City. Ms. Silberstein presided with Mr. Brown and Mr. 3 Willis in attendance. The following business was had to-wit: 4 5 UNSAFE BUILDING HEARINGS 6 7 1826 East Main Street 8 9 Ms. Silberstein opened an Unsafe Building Hearing pursuant to an Order issued on February 26, 1987 to S. 10 Ronald Gurvitz, 6739 Woodmere Court, Indianapolis, Indiana 46260 on property located at 1826 East Main 11 Street. The Order stated the following action be accomplished: Wreck and remove building (dwelling) within 12 thirty (30) days of the receipt of the Order. 13 14 Ms. Silberstein requested Proof of Notification of the Hearing. 15 16 Mr. Dennis Bronston provided a publishers affidavit from legal publication, a return receipt from the Planning 17 Office and a return receipt from the Clerk's Office. 18 19 Mr. Brown moved to accept and file the Proof of Notification, seconded by Mr. Willis and on unanimous voice 20 vote the motion was carried. 21 22 The Clerk administered the Oath to give testimony to Mr. Dennis Bronston, Code Enforcement Officer. 23 24 Mr. Bronston informed the Board the property had been damaged by fire. He stated that Mr. Lawrence Cox has 25 purchased the property, but the deed is not yet recorded. Mr. Bronston indicated that Mr. Cox wants to repair 26 the premises and has removed the roof from the existing structure. He added that Mr. Cox will repair the roof, 27 rewire and secure the premises within ninety (90) and finish the remainder of the structure within twelve (12) 28 months. Mr. Bronston recommended the Board modify the order to add repair of the exterior within 90 days and 29 completion of the structure within 12 months. 30 31 Mr. Bronston said the exterior repairs would include a water tight roof completed and removal of an existing 32 stairway. 33 34 Mr. Silberstein requested testimony from the owner or record or other interested parties. 35 36 The Clerk administered the Oath to give testimony to Mr. Lawrence Cox. Mr. Cox informed the Board that he had 37 purchased and property and will record the deed upon completion of a title search. He said he has already 38 started some repairs and has 80%of the top floor off. 39 40 Mr. Silberstein asked if the structure would be ready to occupy within a year and Mr. Cox stated it would be. 41 42 Mr.Willis moved to modify the Order issued on property located at 1826 East Main Street to include the repair of 43 the exterior of the structure within ninety (90) days and the entire structure brought to code within twelve (12) 44 months,seconded by Mr. Brown and on unanimous voice the motion was carried. 45 46 218-220 North 14th Street 47 48 Ms. Silberstein opened an Unsafe Building hearing on property located at 218-220 North 14th Street, pursuant tc 49 an Order issued to Patricia E. Riddle and Ellis J.Johnson of 64 West Eaton Pike, New Paris, Ohio and Patricia 50 Keener of 2001 West Main Street, Richmond, Indiana. The Order stated the following action be accomplished: 51 Wreck and remove building (dwelling)within thirty(30)days of receipt of the Order. 52 53 Ms. Silberstein requested Proof of Notification of the Hearing. 54 55 Mr. Bronston produced a Publishers Affidavit on a legal advertisement and a return receipt. Mr. Brown moved to 56 accept and file the Proof of Notification, seconded by Mr. Willis and on unanimous voice vote the motion was 57 carried. 58 59 Mr. Bronston,still being under oath, informed the Board that the property had been fire damages in December of 60 1986. He said there had been extensive damage and that a wrecking permit had been issued to Mr. Lawrence 61 Cox. He said Mr. Cox has also filed a Proof of Insurance. He said the wrecking should be started shortly. Mr. 62 Bronston indicated there was another problem with a City Department that needs to be expedited to allow the 63 wrecking to proceed. 64 65 Mr. Bronston recommended to the Board that the order to wreck and remove be affirmed. Board of Works Minutes Cont'd April 9, 1987 Page 2 1 Ms. Silberstein asked if the property had been released by the Fire and Police Departments from investigation. 2 Mr. Bronston stated it had been released by the Fire Department. 3 4 Ms. Silberstein asked if there was anything we need to safeguard our right to enter with the wrecking permit 5 issued. 6 7 Mr. Bronston stated he was not certain, but he would try to get the situation expedited. 8 9 There was no one present to speak in opposition to the Order. 10 11 Mr. Bronston said he had spoken with Mrs. Riddle,the owner, and she asked if the lot could be built on after the 12 demolition. 13 14 The Board indicated that was no problem. 15 16 Mr. Brown asked if the Board needed to table action on the Order and Mr. Willis stated the Board could not stop 17 the wrecking. 18 19 Mr. Willis moved to affirm the Order issued on property located at 218-220 North 14th Street to wreck and 20 remove the dwelling within thirty(30)days of the receipt of the Order,seconded by Mr. Brown and on unanimous 21 voice vote the motion was carried. 22 23 105-107 South 13th Street 24 25 Ms. Silberstein opened an Unsafe Building Hearing on property located at 105-107 South 13th Street pursuant to 26 an Order issued on February 26, 1987 to Morton L. and Cynthia Carmichael. The Order stated the following 27 action be accomplished: Wreck and remove building (dwelling)within thirty(30)days of receipt of the Order. 28 29 Ms. Silberstein requested Proof of Notification of the Hearing. 30 31 Mr. Bronston presented the Board a Publishers Affidavit on a legal advertisement and a return receipt. 32 33 Mr. Brown moved to accept and file the Proof of Notification, seconded by Mr. Willis and on unanimous voice 34 vote the motion was carried. 35 36 Mr. Bronston, still being under oath, informed the Board that the premises had been damaged by fire in 37 December of 1986. He said there had been extensive damage and the property had been released from 38 investigation. Mr. Bronston indicated the owner agrees the property is damaged beyond repair, but an insurance 39 settlement is still in dispute. Mr. Bronston said the structure is secured, but a lot of debris remains on the site 40 causing a lot of complaints and further fire hazard. 41 42 Mr. Bronston recommended the Board affirm the Order to wreck and remove. 43 44 Ms. Silberstein asked what effect the Order would have on the debris and Mr. Bronston stated the time has 45 effectively expired on the Order and he has already received quotes for demolition. He said after a ten (10)day 46 notification time to the owners, he would then be able to have the structure demolished and all debris would be 47 removed then. 48 49 There was no one speaking in opposition to the Order as issued. 50 51 Mr. Willis moved to affirm the Order issued on property located at 105-107 South 13th Street to wreck and 52 remove the dwelling within thirty (30) days of receipt of the Order, seconded by Mr. Brown and on unanimous 53 voice vote the motion was carried. 54 55 CONTINUATION OF UNSAFE BUILDING HEARINGS 56 -57 400 Kinsey Street 58 59 Ms. Silberstein opened a continuation of an Unsafe Building Hearing on property located a 400 Kinsey Street 60 pursuant to an Order issued to Sharron Werner on January 27, 1987 to wreck and remove the unsafe building 61 within forty-five (45)days of receipt of the Order. She stated the hearing had been continued to gain entry and 62 make contact with the owner. 63 64 Mr. Bronston,still being under oath, informed the Board that the owner still refused to claim any certified mail and 65 attempts have been made by both Planning and the Clerk's Office. He added they also have not gained entry. Board of Works Minutes Cont'd April 9, 1987 Page 3 1 Mr.Willis asked if they would get a Court Order to gain entry. 2 3 Mr. Silberstein added that there have been good faith attempts to personally notify the owner. 4 5 Mr. Bronston recommended to the Board the hearing be continued one (1) month to allow time for a Court Order 6 to gain entry and inspect the premises. 7 8 Mr. Willis moved to continue the Unsafe Building Hearing on property located at 400 Kinsey Street to May 7, 9 1987 at 9:00 A.M.,seconded by Mr.Brown and on unanimous voice vote the motion was carried. 10 11 1109 Parry Street 12 13 Ms. Silberstein opened a continuation of an Unsafe Building Hearing on property located at 1109 Parry Street 14 pursuant to an Order issued on January 27, 1987 to David Dilley to wreck and remove the dwelling within forty- 15 five days of receipt of the Order. 16 17 Ms.Silberstein indicated the Board continued the hearing to gain entry to the premises for inspection. 18 19 Mr. Bronston, still being under oath, informed the Board that his Office and the Clerk's Office both tried to make 20 contact with Mr. Dilley regarding the hearing and were unable,but reminded the Board it had been advertised. 21 22 Mr. Bronston stated he and Mr. Curtis Hedgecock gained entry to the structure. He said there is a 100 AMP 23 service and some new wiring started, but considerable damage had been done in the installation of the electric 24 service. Mr. Bronston said no permits had been issued for any of the repairs. He added there were no bathroom 25 facilities and the electric service is located in what would have been the bathroom, which is not allowed by the 26 electrical code. 27 28 Mr. Bronston said the gas furnace is all right, but the water heater is not properly installed. He said there is 29 extensive damage to walls and floors by the structure being vacant. 30 31 Mr. Bronston stated it was his opinion that it would not be economically feasible to repair the structure and since 32 no owner is available to insure the repairs he recommended removal of the dwelling. 33 34 Mr. Bronston added that Mr. Dilley was in the habit of acquiring properties and not rehabilitating them or keeping 35 them up. 36 37 The Board was also informed the taxes for 1985 have not been paid. 38 39 There was no one speaking in opposition to the Order. 40 41 Mr.Willis moved to affirm the Order issued on property located at 1109 Parry Street to wreck and remove unsafe 42 building within forty-five days of receipt of Order, seconded by Mr. Brown and on unanimous voice vote the 43 motion was carried. 44 45 APPROVAL OF CORRECTED MINUTES OF APRIL 2.1987 46 47 Mr. Willis moved to approve the minutes of the previous meeting with the following correction, seconded by Mr. 48 Willis and on unanimous voice vote the motion was carried. Page 1, Line 15: Replace"Silberstein" with 49 "the". 50 51 APPROVAL OF CLAIMS FOR PAYMENT 52 53 Mr. Brown moved to approve claims for payment in the amount of 86,777.61 seconded by Mr. Willis and on 54 unanimous voice vote the motion was carried. 55 56 PUBLIC REQUESTS AND COMMENTS 57 58 OPENING DAY PARADE-EVENING OPTIMIST 59 60 A letter was presented to the Board from Mr. Evan Collinsworth representing the Richmond Evening Optimist. 61 Mr. Collinsworth requested permission to hold a parade in connection with opening day ceremonies for the youth 62 teams. The parade would be on May 17, 1987 starting at 1:00 P.M. and would proceed from Dennis Middle 63 School west on Peacock Road to NW 13th Street. They also requested any necessary Police assistance. 64 65 Mr.Willis expressed concern about streets being torn up due to the sewer project in the area and that it would be LP Board of Works Minutes Cont'd April 9, 1987 Page 4 1 difficult to know how far they would be at that time. 2 3 Marshall Smith of the Traffic Division stated there would be no problem if the streets were ready and they could 4 find an alternate route around the streets that were torn up. 5 6 Mr.Willis moved to approve the opening day parade for the Richmond Evening Optimist on May 17, 1987 on the 7 route requested or an alternate route if necessary with approval through the Traffic Division, seconded by Mr. 8 Brown and on unanimous voice vote the motion was carried. 9 10 RECONSIDERATION REQUEST FOR RESIDENTIAL HANDICAPPED PARKING AT 121 SOUTH 10TH STREET 11 12 Ms. Silberstein explained this request was denied on February 26, 1987 due to off street parking available. 13 Marshall Smith explained there was a cement floor left from a garage torn down at the rear of the property 14 providing off street parking. Officer Smith stated that the structure is a double and the individual applying for the 15 residential handicapped space indicates he has no ample parking available since the upstairs tenant uses most 16 of the available off street parking. 17 18 Officer Smith stated in his opinion there was ample parking for two vehicles at the rear of the property and he 19 would still recommend denial. He said the only way he would consider approval would be to hear from the 20 landlord stating there was no parking available. 21 22 Officer Smith also informed the Board that the guidelines for residential handicapped parking need to be 23 revamped after some experience with them. He indicated in the case of the 100 block of South 10th Street four 24 (4) adjacent property owners have residential handicapped parking spaces causing a problem with parking in the 25 block. 26 27 Ms. Silberstein asked if the location of all spaces in the City have been identified and Officer Smith stated they 28 were trying. 29 30 Mr.Willis said the intent was not to have multiples in a one block area. 31 32 Mr. Silberstein said she tried to think of additional situation when the guidelines were developed bu they need to 33 address the guidelines and possibly a percentage situation would be an answer to control the number of spaces 34 in a particular area. 35 36 Mr. Willis moved to deny the appeal for a residential handicapped parking space at 121 South 10th Street upon 37 recommendation of the Traffic Division and until further evidence of need is provided, seconded by Mr. Brown 38 and on unanimous voice vote the motion is carried. 39 40 DEPARTMENT REQUESTS AND COMMENTS 41 42 PLAN NING.PERMITS AND INSPECTION 43 44 February and March Monthly Reports-Building Division 45 46 The February and March Monthly Reports of the Building Division of the Planning Department showed a tota 47 of162 permits issued and five buildings demolished. 48 49 Mr. Brown moved to accept and file the February and March monthly reports for the Building Division,seconded 50 by Mr.Willis and on unanimous voice vote the motion was carried. 51 52 Set Date for Inoperable Vehicle Hearing on Nuisance at 1333 South 9th Street 53 54 Mr. Barden explained there were four(4)vehicles involved and have been the source of many complaints. 55 56 Mr. Willis moved to set April 30, 1987 at 9:00 A.M. as the date and time for an Inoperable Vehicle Hearing on 57 nuisances located at 1333 South 9th Street, seconded by Mr. Brown and on unanimous voice vote the motion 58 was carried. 59 60 Finding of Fact-602 North 12th Street 61 62 Ms. Silberstein explained the Board had affirmed the Order to wreck and remove the unsafe structure located at 63 602 North 12th Street and now needed to execute the Finding of Fact. 64 65 Mr. Brown moved to execute the Finding of Fact on the unsafe premises located at 602 North 12th Street, IA 7 Board of Works Minutes Cont'd April 9, 1987 Page 5 • 1 seconded by Mr.Willis and on unanimous voice vote the motion was carried. 2 3 PPURCHASING DEPARTMENT 4 5 Set Date to Receive Bids for Street Sweepers 6 7 Purchasing Director, Rita Stout explained the bid received for the contractual sweeping of streets was much 8 higher than anticipated and approved. She said they were going to contract the sweeping of the downtown area 9 as set out in Section B of the specifications. 10 11 Mr.Willis added that the negotiated price for Section B was$25.00 a curb mile versus the$60.00 per curb mile in 12 Section A for residential areas. 13 14 Ms. Silberstein asked if the price was broken out in the bid on the curb mile and Mr.Willis said it was a total price. 15 16 Ms. Silberstein asked what the Board was awarding on the Street Sweeping bids and Mr. Brown asked if there 17 might have been more bids if it had been bid by the curb mile. 18 19 Ms. Stout stated they solicited input from vendors when bidding the project and that the specifications were 20 prepared with options to bid partially or overall. 21 22 Ms. Silberstein asked if it is a clear price to sweep the downtown area for$25.00 and Ms. Stout stated that price 23 was negotiated with the vendor. 24 25 Mr.Barden recommended throwing out the bid completely and soliciting bids on the downtown area per curb mile. 26 He indicted since the City has gone through the formal bidding process unsuccessfully, he felt they could use 27 informal quotes. 28 29 Ms. Stout stated she would contact other vendors about the price on a curb mile basis. 30 31 Mr. Brown moved to authorize the Purchasing Director to negotiate with the bidders and receive quotes for award 32 as provided in Part B of the specification on the sweeping of streets, seconded by Mr. Willis and on unanimous 33 voice vote the motion was carried. 34 35 Mr. Brown moved to set April 30, 1987 at 9:00 A.M. as the date and time to receive bids for three (3) street 36 sweepers,seconded by Mr.Willis and on unanimous voice vote the motion was carried. 37 38 FIRE DEPARTMENT 39 40 March Monthly Report 41 42 The March monthly report of the Fire Department showed a total of 73 runs with a loss of 85,000.00. 43 44 Mr. Brown moved to accept and file the March Monthly Report of the Fire Department,seconded by Mr.Willis and 45 on unanimous voice vote the motion was carried., 46 47 SET DATE FOR EXECUTIVE SESSION 48 49 Mr. Brown moved to set April 16, 1987 at 8:45 A.M. as the date and time for an executive session of the Board of 50 Public Works and Safety for personnel matters,seconded by Mr.Willis and on unanimous voice vote the motion 51 was carried. 52 53 The meeting will be in the Mayor's Office. 54 55 ADJOURNMENT p56 57 There being no further business, on a motion duly made,seconded and passed the meeting was adjourned. 58 59 60 61 62 63 64 Susan Silberstein, President 65 ATTEST: Mary Merchanthouse,City Clerk
