HomeMy Public PortalAbout01-15-1987 '3 BOARD OF PUBLIC WORKS AND SAFETY OF THE CITY OF RICHMOND, INDIANA, JANUARY 15, 1987 I The Board of Public Works and Safety of the City of Richmond, Indiana, met in regular session January 2 15, 1987 at the hour of 9:00 A.M. in the Municipal Building in said City. Ms. Silberstein presided with 3 Mr. Brown and Mr. Willis in attendance. The following business was had to-wit: 4 55 CONTINUATION OF UNSAFE BUILDING HEARING - 820 NORTH 18TH STREET 7 8 Ms. Silberstein stated that the hearing had been continued from January 8, 1987 for final 9 determination of sale of the property. 10 1I Ms. Silberstein asked for comment from anyone supporting the Unsafe Building Order issued on the 12 property at 820 North 18th Street. 13 14- Mr. Dennis Bronston stated that the Senior Building Inspector had met with Mrs. Robinson and Mr. 15 Shouse to go over the problems with the property. Mr. Bronston said that Mr. Dooley had spoken with 15 Mrs. Robinson and he anticipated the attendance of her and Mr. Shouse today. He said as of January 12, 17 1987, when the final contact had been made with the Planning Department, no final determination had 18 been made on the sale of the property. 19 20 Mr. Bronston said that he was under the impression that Mr. Shouse wanted to hire an electrical 21 contractor and do other repairs himself and he felt it could be done in a six (6) month time period, but 22 was not certain and did not want to be in the same position as Mrs. Robinson at the end of the six (6) 23 months. 24 25 Mr. Willis asked if the roof was good and Mr. Bronston stated it was basically good. 26 27 Ms. Silberstein asked if the yard had been cleaned up and Mr. Bronston said he was not certain since he 28 did not go on the inspection. 29 30 Ms. Silberstein stated she was ready to issue the order and leave the ownership question up to the 31 parties involved. 32 33 Mr. Brown asked if the property would be purchased and Mr. Bronston stated that no final 34 determination had been made. Mr. Bronston informed the Board that he had received complaints on the 35 ' property this week and inquiries about what was going to happen. Mr. Bronston did stated that the - 36 property was secured. 37 38 Ms. Silberstein stated that the Order issued on October 16, 1986 called for removal of the unsafe 39 structure, but the Board could make the order less stringent by adding removal or repair and clean up. 40 41 Mr. Willis suggested the litter in the yard could be dealt with through the Litter ordinance and asked if 42 the owners had rights to stay the order if the Board affirmed it. 43 44 Mr. Barden said they would be able to file an injunction in Court to stay the order. 49 46 Ms. Silberstein added that if clean up of the property is attached to the order, then the City can 47 remove and bill back charges. 48 49 Mr. Willis recommended removal of the litter within ten (10) days and removal of the unsafe structure 50 after thirty (30) days unless a schedule of repairs is submitted within that time period with repairs to 51 be completed within six (6) months. 52 53 Mr. Willis moved to affirm and modify the Order issued on October 16, 1986 on unsafe premises 54 located at 820 North 18th Street to include removal and clean up of all debris in yard within ten (10) 55 days, and removal of the unsafe premises after thirty (30) days or the submission of a schedule of 56 repairs within the thirty (30) days with repairs to be completed within six (6) months of the 57 submission of the schedule, seconded by Mr. Brown and on unanimous voice vote the motion was 58 carried. 59 60 UNSAFE BUILDING HEARING ON PROPERTY LOCATED AT 815 SOUTH E STREET 61 62 Ms. Silberstein opened the Unsafe Building Hearing on property located at 815 South E Street pursuant 53 to an order issued to Robert and Janet L. Gray, 4473 South C Place, Richmond, Indiana. The Order was 64 issued on December 19, 1986 and ordered the vacating of unsafe building and removal of all debris and 65 materials that are contributing to potential fire and health hazard. The action in order was to be 66 accomplished immediately. Board of Works Minutes Cont'd January 15,1987 Page 2 1 Ms. Silberstein requested Proof of Notification of the hearing. 2 3 Mr. Barden informed the Board that notice had been attempted by Certified Mail to the residence and 4 was unclaimed. Mr. Barden stated that another certified notice had been mailed to the business address 5 of Mr. Gray and was claimed. He said regular mail was also sent out on the notification and a good faith 6 effort had been shown to meet the time requirements on notification 7 8 Mr. Brown moved to accept and file the Proof of Notification, seconded by Mr. Willis and on unanimous 9 voice vote the motion was carried. 10 11 Ms. Silberstein requested testimony in support of the Order. 12 13 The Clerk administered the Oath to give testimony to Mr. Dennis Bronston. 14 15 Mr. Bronston informed the Board that the Order had been issued pursuant to the findings of the Wayne 16 County Health Department and the Case Manager with Area IX Agency on Aging. He said the reports of 17 those agencies were included in the information with the Order. Mr. Bronston said the order causes the 19 vacating of the property and the removal of debris which is supported by copies of pictures taken in the 19 premises and letters from the agencies involved. 20 21 Mr. Bronston stated that he has been involved with the property since May 22, 1986 at which time he 22 requested an interior inspection and on July 17, 1986 he requested some exterior improvements be 23 made. Mr. Bronston stated some of the improvements were initiated. 24 2.5 Mr. Bronston informed the Board that he would like to modify the order to require an inspection by the 26 Planning Department prior to any occupancy to determine if any other code violations exist and that all 27 unsanitary conditions have been eliminated. 28 2.9 Mr. Bronston added that Mr. Richard Gray, a brother of Robert Gray, had requested help of the City to 30 get the conditions at this property alleviated and Mr. Bronston felt he needed an inspection before he 31 could help. 33 In response to the Board, Mr. Bronston stated that the property was currently vacant and the residents 34 had been taken to a nursing home. 35 36 Ms. Silberstein noted the property was under an Order of the Health Department as Unfit for Human 37 Habitation, but added the City wants to back it up and also inspect for code violations. 39 There were no other witnesses present in the hearing. 40 41 Ms. Silberstein asked why the Order called for action to be taken immediately and Mr. Bronston 42 explained it was an immediate concern that the premises not be reoccupied until conditions are 43 improved. He said he is not suggesting the City remove the debris and clean up, only hoping the owner 44 gets it done. 45 46 Mr. Willis asked if the structure was dangerous and Mr. Bronston said they would need an inspection to 47 make that determination. 48 49 Ms. Silberstein suggested that the Board modify the Order that prior•to reoccupancy the premises must 50 be inspected by the Building Division for code violations and be fit for human habitation. 51 52 Mr. Brown moved to affirm and modify the Order issued on unsafe premises located at 815 South E 53 Street for vacating of unsafe premises and removal of all debris immediately and prior to reoccupancy 54 the premises must be inspected by the Building Division for code violations and be fit for human 55 habitation, seconded by Mr. Willis and on unanimous voice vote the motion was carried. 56 57 APPROVAL OF MINUTES OF JANUARY 8. 1987 • 58 59 Mr. Brown moved to approve the minutes of the previous meeting as prepared, seconded by Mr. Willis 60 and on unanimous voice vote the motion was carried. 61 62 APPROVAL OF CLAIMS FOR PAYMENT 63 64 Mr. Brown moved to approve claims for payment in the amount of 2,883.36, seconded by Mr. Willis and 65 on unanimous voice vote the motion was carried. G6 Board of Works Minutes Cont'd January 15, 1987 Page 3 1 PUBLIC REQUESTS AND COMMENTS 2 3 RESIDENTIAL HANDICAPPED PARKING SPACE AT 418 NORTH 21ST STREET 4 5 The request of Delbert Goins of 418 North 21st Street for a residential handicapped parking space was 6 presented to the Board. Mr. Goins had Handicapped Permit No. A-03041 with an expiration date of 7 April 3, 1988. 8 9 Captain Williams stated he has checked the request and finds it meets the guidelines. 10 11 Mr. Willis moved to approve a residential handicapped parking space at 418 North 21st Street, 12 seconded by Mr. Brown and on unanimous voice vote the motion was carried. 13 14 1986 FRANCHISE FEES-CLEARVIEW CLEARVIEW CABLE 15 16 Mr. Rich Cody, Manager of Clearview Cable TV, presented the Board the franchise Fee for 1986 in the 17 amount of 48,046.20. 18 19 Ms. Silberstein stated the fee was very timely and represented an approximate 7,000.00 increase 20 over 1985. 21 22 Ms. Silberstein recommended that the Board of Public Works and Safety make recommendations to the 23 Common Council and the Mayor that some of the increase in franchise fees be dedicated for the 24 operation of the PEG Channel and regular system checks of the local cable. 25 26 DEPARTMENT REQUESTS AND COMMENTS 27 28 PURCHASING DEPARTMENT 29 30 Bid Award for Bulk Purchases of Gasoline and Fuel Oil for 1987 31 32 In a memo to the Board, Purchasing Director, Rita Stout, recommended the bid for all types of gasoline 33 and fuel oil go to Farm Bureau Cooperative as the lowest and best bidder. 34 35 Mr. Willis moved to award the bid for all types of gasoline and fuel oil for 1987 to Farm Bureau 36 Cooperative per the bid and specifications, seconded by Mr. Brown and on unanimous voice vote the 37 motion was carried. 38 39 PLANNING, PERMITS AND INSPECTION 40 41 Execution of Finding of Fact on Unsafe Premises Located at 713 North C St. 42 43 Ms. Silberstein stated that the Order for the removal of the unsafe premises at 713 North C Street was 44 affirmed by the Board on November 13, 1986 and this document sets out the facts and 45 recommendations and will be recorded. 46 47 Mr. Brown moved to approve and execute the Finding of Fact on unsafe premises located at 713 North C 48 Street, seconded by Mr. Willis and on unanimous voice vote the motion was carried. 49 50 Mr. Bronston informed the Board that two (2) quotes for demolition have been received. 51 52 Monthly Report-Building Division 53 54 The December Monthly Report of the Building Division showed a total of 135 permits issued at a total 55 cost of 1,458,658.00. 56 57 Mr. Brown moved to accept and file the December Monthly Report, seconded by Mr. Willis and on 58 unanimous voice vote the motion was carried. 59 60 Set Date for Unsafe Building Hearings 61 62 Mr. Bronston requested the Board set March 19, 1987 for Unsafe Building Hearings on property located 63 at 1109 Parry St., 600 North 13th Street, 602 North 13th Street and 400 Kinsey Street and February 64 19, 1987 for hearings on outbuildings at 338 Pearl Street and 1020 South 8th Street. Board of Works Minutes Cont'd January 15, 1987 Page 4 I Mr. Bronston stated the dwellings have been vacant for a number of years and represent a hazard.
