HomeMy Public PortalAboutResolution 11-24 Transition PlanRESOLUTION NO. 11-24 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MCCALL, IDAHO RELATING TO A SECTION 504 TRANSITION PLAN, AND TITLE VI OF THE CIVIL RIGHTS ACT OF 1964; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, Title VI of the Civil Rights Act of 1964 provides that: "No person in the United States shall, on the grounds of race, color, or national origin, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any program or activity receiving Federal assistance under this title or carried out under this title"; and WHEREAS, the Federal -aid Highway' Transportation Act of 1973 added sex to the list of prohibitive factors; disability was added through Section 504 of the Rehabilitation Act of 1973; and age was subsequently added in 1975 under the Age Discrimination Act.; and WHEREAS, the Civil Rights Restoration Act of 1987, broadened the scope of Title VI coverage by expanding the definition of terms "programs or activities" to include all programs or activities of Federal Aid recipients, sub -recipients, and contractors/consultants, whether such programs and activities are federally assisted or not (Public Law 100.259 (S.557) March 22, 1988); and WHEREAS, at the June 24, 2010, City Council Meeting, the McCall City Council approved an Affirmative Action Plan and a Limited English Proficiency plan; and WHEREAS, at the December 2, 2010 City Council Meeting, the McCall City Council approved Resolution 10-26 adopting a Non -Discrimination Policy Statement in compliance with Title VI of the Civil Rights Act of 1964; and WHEREAS, at the June 23, 2011, City Council Meeting, the McCall City Council reviewed the draft 504 Transition Plan for the City of McCall; and WHEREAS, at the October 20, 2011 City Council Meeting, the McCall City Council approved Resolution 11-18 adopting a fair Housing Policy; and WHEREAS, City staff held a public workshop on November 15, 2011, that was noticed in the Star -News for citizen participation in the development of the 504 Transition Plan for the City of McCall; and WHEREAS, an ad for public participation through written comment was published in the November 24, December 1, and December 8, 2011 Editions of the Star -News; and WHEREAS, at the December 15, 2011 City Council Meeting, the McCall City Council heard public comment regarding the 504 Transition Plan for the City of McCall. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF MCCALL, Valley County, Idaho that: Page 1 of 2 Resolution 11-24 Section 504 Transition Plan December 15, 2011 Section 1: The City of McCall has completed an inspection of all public building access which includes sidewalks, ramps and doors. Section 2: The City has developed a Transition Plan to bring all public access to ADA Standards. This document is a working document that can and will be refined and expanded during its continued life. (Attachment A) Section 3: In the event the City of McCall, as the recipient, distributes federal aid funds to a sub - recipient, the City of McCall will include Title VI language in all written agreements and will monitor for compliance Section 4: The City of McCall's City Clerk is responsible for initiating and monitoring Title VI activities, as required by 23 Code of Federal Regulations (CFR) 200 and 49 CFR 21. Bailey, Mayor Page 2 of 2 ATTACHMENT A City of McCall ADA Transition Plan f 2011 BACKGROUND/PURPOSE The Americans with Disabilities Act (ADA), signed into law in 1990, is a civil rights statute prohibiting discrimination against people who have disabilities. ADA covers a wide range of disabilities, including physical disabilities that limit mobility, stamina, vision, hearing, and speech as well as cognitive disabilities, emotional illness and learning disorders. Title II of the ADA prohibits state and local governments from excluding participation in or denying benefits of programs, services or activities to people with disabilities. Pedestrian facilities in the state right-of-way are considered a service of the Idaho Transportation Department (ITD). Under the ADA, designing and constructing public facilities that are not accessible by people with disabilities constitutes discrimination. The ADA also requires public entities with 50 or more employees to perform a self - evaluation to determine barriers to accessibility, as well as create a Transition Plan identifying how compliance will be achieved. This document is intended to satisfy the Transition Plan requirement of 28 CFR Section 35.150, as it relates to Existing Facilities, and curb ramps. All local public agencies must have a formal transition plan if they have 50 or more employees. A transition plan consists of an assessment or physical inventory, a priority - order list of corrections which include dates and cost, and a public involvement component to gather public input and make changes to the plan based on that input. The assessment or inventory includes access for the disabled to all your programs and services, your buildings, and your pedestrian facilities (curb ramps, signals, sidewalks and ped buttons, etc.). The City's transition plan is intended to be a fluid document that can and will be refined and expanded during its continued life. The City understands the possibility of the need to amend its plan and stands ready to review and consider suggestions and input. Transition Plan 2011 CITY OF MCCALL Section 504 Transition Plan Facilities Accessibility History of Section 504 Transition Plan: • November, 2010: Greg Nicholas, Building Inspector of the City of McCall, conducted an evaluation of the City facilities • Rick Scherette, Streets Supervisor, conducted an evaluation of the pedestrian ramp information The Uniform Federal Accessibility Standards (UFAS) were used in the facilities review to determine compliance of the various building components and other structure and site elements. When signs are provided they must contain the elements identified by the international Symbol of Accessibility: • Accessible parking spaces; • Accessible passenger loading zones; • Accessible entrances when not all are accessible; • Accessible toilet and bathing facilities when not all are accessible The police side of the building is not accessible and needs directional signage of an alternate entrance Stairs The interior and exterior stairs connecting levels do not comply. They must have continuous handrails along both sides, and have 12 inches of handrails parallel to the floor beyond the top and bottom riser. Passenger Loading Zone and Exterior Accessible Route A sign displaying the International Symbol of Accessibility is required at the accessible passenger loading zone. Exterior Accessible Routes Accessible route must be at least 36 inches wide except at doorways or gates.
