HomeMy Public PortalAbout09-11-1986 9,,3'I BOARD OF PUBLIC WORKS AND SAFETY OF THE CITY OF RICHMOND, INDIANA, SEPTEMBER 11, 1986 1 The Board of Public Works and Safety of the City of Richmond, Indiana, met in 2 regular session September 11, 1986 at the hour of 9:00 A.M. in the Municipal Building 111 3 in said City. Ms. Silberstein presided with Mr. Brown and Mr. Willis in attendance. 4 The following business was had to-wit : 5 6 BID OPENING FOR EASTERN INDIANA INDUSTRIAL PARKWAY INTERSECTION 7 8 Mr. Barden examined the Proof of Publication and found it to be in order. Mr. 9 Willis moved to accept and file the Proof of Publication, seconded by Mr. Brown 10 and on unanimous voice vote the motion was carried. 11 12 Ms. Wilson requested all bid be turned in. Having received all bids, Mr. Brown 13 moved to close the bidding, seconded by Mr. Willis and on unanimous voice vote 14 the motion was carried. 15 16 The following bids were received: 17 18 Stone Valley Paving. The bid was on the proper form, signed, notarized and 19 accompanied by a bid bond. The total bid was for 135,799.80. 20 21 Contractor 's United, Inc. The bid was on the proper form, signed, notarized 22 and accompanied by a bid bond. The total bid was for 141,141.30. 23 24 Mr. Brown moved to refer the bids to the Public Works Department and the Purchasing 25 Director for evaluation and recommendation, seconded by Mr. Willis and on unanimous 26 voice vote the motion was carried. 27 28 APPROVAL OF MINUTES OF SEPTEMBER 4, 1986 29 30 Mr. Brown moved to approve the minutes of the previous meeting as prepared, seconded 31 by Mr. Willis and on unanimous voice vote the motion was carried. 32 33 APPROVAL OF CLAIMS FOR PAYMENT 34 - 35 Mr. Brown moved to approve claims in the amount of 430,748.95 and miscellaneous 36 hand claims for payment, seconded by Mr. Willis and on unanimous voice vote the 37 motion was carried. 38 39 PUBLIC REQUESTS AND COMMENTS 40 41 Music Boosters - Fish Fry Banners 42 43 Ms. Silberstein presented a request from the Richmond Music Boosters to hang banners 44 over the highway at U.S. 27 North and Sim Hodgin Parkway and South 9th and E Streets 45 from one week prior to the Fish Fry on September 19, 1986 to the week end after 46 the event. Permission has been granted from Richmond Power & Light to use utility 47 poles and the Fire Department has been contacted to hang and remove the banners . 48 Permission has also been requested from the State Highway Commission. 49 50 Mr. Willis moved to approve the request for the Richmond Music Boosters to hang 51 banners at the requested location subject to State Highway approval, seconded 52 by Mr. Brown and on unanimous voice vote the motion was carried. 111 53 54 Ms. Silberstein requested that volunteers be solicited from the Fire Department 55 rather than make it a duty assignment. 56 57 Bird Problem Within City - Councilmember Morris 58 59 Councilmember Lynn Morris brought to the attention of the Board a problem with 60 birds on the S.E. side of Richmond. She stated she had contacted a local pest 61 control company and they said they were not able to assist, due to restrictions 62 on chemical uses. Ms . Morris said the birds carry the disease Histoplasmosis 63 and they need to be dealt with. 64 Mr. Willis indicated that the State of Indiana had a tape with a distress call 65 on it that they will loan that might assist in riding the area of the birds . Board of Works Minutes Cont 'd September 11, 1986 Page 2 1 Chief Nlmitz stated that the Police have used blank shot gun shells to assist 2 Earlham with a similar problem. 3 III 4 Mr. Willis stated he would contact the State and see what the latest methods are 5 and report back. He asked Chief Nimitz about letting neighbors shoot off blanks • 6 and Chief Nimitz stated if they can validate it is blank ammunition he sees no 7 problems. 8 9 ITEMS UNDER ADVISEMENT 10 11 Ms. Silberstein reminded the Board that a report was due on U.S. 40 and Toschlog 12 Road on September 25, 1986 and possibly a report on the FOP Grievance. 13 14 S.W. 16th and U.S. 40 Traffic Signal 15 16 Ms. Silberstein stated the Board was not in agreement with the State either removing 17 the traffic signal at S.W. 16th and U.S. 40 or having it downgraded to a flasher. 18 Ms. Siberstein read the following letter of response from the Board of Public 19 Works and Safety: 20 21 In reponse to your correspondence of August 18, 1986 to Mayor Frank Waltermann, 22 in which you have proposed placing the traffic signal at U.S. 40 (National 23 Road West) and S.W. 16th Street in Richmond on flash for a six month period 24 pending further studies, the City of Richmond is at this time stronly protesting 25 such change, based on information and recommendations received from the 26 Department of Traffi Safety of the Richmond Police Department and citizens 27 in the area of the proposed change. 28 29 The reasons for our opposition to the proposed change are as follows : 30 31 1. The intersection of U.S. 40 and S.W. 16th is a primary route for 32 approximately 60 elementary school children to cross U.S. 40 going to and 33 from Westview Elementary School, one block north of U.S. 40, and the existing 34 traffic traffic signal is essential to their safe passage. We refer you 35 to the attached letter of September 4, 1986, from the Westview principal, 36 parents, and staff; and the attached memo of September 8, 1986 from Captain 37 Ron Willliams of the Richmond Police Department of Traffic Safety. The next 38 available signalized intersection, at U.S. 40 and S.W. 18th is not nearly 39 so safe for pedestrian traffic due to turning patterns of traffic at that 40 intersection and its proximity to a shopping center. 41 42 2. The intersection of U.S. 40 and S.W. 16th is the sole signalized ingress/ 43 egress point fora large residential area located south of U.S. 40, and the 44 signal facilitates access to and from this busy highway. 45 46 3. The signal is useful in slowing traffic to posted limits in that particular 47 congested area of U.S. 40, which otherwise has a history of traffic exceeding 48 limits due to long stretches without signals . • 49 50 We urge you to consider carefully the City's opposition to the State's proposed 51 change at this intersection, and to abandon the proposal to change to a flashing 52 light, in favor of either retainig the present signalization, which the City 53 maintains is warranted, or at the least installing an activated or time 54 activated signal as suggested by Captain Williams. 55 56 Thank you for your consideration in this matter. 57 58 The following public spoke in opposition to the removal of downgrading of the 59 traffic signal: 60 61 Francis Nolte of 342 S.W. 15th Street informed the Board of the great amount of 62 senior citizens in the area using the intersection to cross and indicating that 63 they must cross the street to get a bus and this is the only safe intersection. 64 65 Mildred Dooley, Crossing Guard at the intersection, informed the Board that she a39 Board of Works Minutes Cont 'd September 11, 1986 Page 3 1 was not able to stop four lanes of traffic without the aid of the light. She 2 presented the Board a petition from the residents of the area with 328 names in 3 support of retaining the traffic signal. Ms. Dooley stated that when the light 4 has been out she has needed the aid of the Police Department to get the children 5 across the street. 6 7 Ms. Virginia Oliver of 400 S.W. 16th Street stated the light was installed on 8 December 21, 1951 and this is the third fight to keep the light in place. She 9 stated there were no sidewalks on the north side of the street and pedestrians 10 need to cross U.S. 40 to walk along the street. 11 12 Mr. Bob Whipple of 323 S.W. 17th Street informed the Board that there are also 13 children attending Dennis Middle School that use the intersection to cross. He 14 added that the residential area has grown to 408 homes using this signalized 15 intersection. 16 Mr. John O'Day of S.W. 18th Street asked what the State intended to do to get 17 the children safety across the Street and Mr. Willis stated they were only 18 concerned with handling the traffic on the four (4) lane highway. Mr. Willis 19 suggested that the City should work through Mr. Roy Werking as an ombudsman for 20 state agencies since Mr. Werking was from the Richmond area. 21 22 Ms. Dooley added that the intersection was also needed by the elderly and disabled 23 as signalized crossing. 24 25 Ms. Margaret LaRue of 424 S.W. 16th informed the Board that she would not cross 26 U.S. 40 without the aid of the traffic signal. 27 28 Mrs. Nolte stated that the removal of the light would encourage speeding in the 29 area. 30 31 Mr. O'Day asked the Board where to go from here and Ms. Silberstein stated that 32 the State has the final say so over the matter with the warrants. 33 34 Mr. Willis stated the Board should contact Mr. Werking and possibly set up a public 35 meeting. 36 37 Ms. Silberstein requested the Board to adopt the letter in opposition and to also 38 enclose the letters from Westview School, Captain Ron Williams, the petition and 39 the minutes of the meeting. 40 41 Councilmember Morris also suggested that School Board members might be contacted 42 in order to lobby through the State Department of Education. 43 44 Captain Williams informed the Board that the traffic counts he had taken showed 45 1,555 cars in the area during the three (3) z hours periods that children were 46 crossing the intersection. 47 48 Mr. Willis mvoed to adopt and execute the letter in opposition to the downgrading 49 or removal of the traffic signal at U.S. 40 and S.W. 16th Streets , seconded by 50 Mr. Brown and on unanimous voice vote the motion was carried. 51 52 DEPARTMENT REQUESTS AND COMMENTS III 53 54 Planning Department 55 56 Building Division - August Monthly Report 57 58 The August Monthly Report showed a total of 119 permits issued. Mr. Brown moved 59 to accept and file the August Monthly Report, seconded by Mr. Willis and on unanimous 60 voice vote the motionwas carried. 61 62 Set Date for Unsafe Building Hearings 63 64 Mr. Brown moved to set October 16, 1986 at 9:00 A.M. for Unsafe Building Hearings 65 on property at 1302 E. Main and 713 North C, seconded by Mr. Willis and on unanimous 66 voice vote the motion was carried. 13cb 1- Board of Works Minutes Cont'd September 11, 1986 Page 4 1 Set Date for Inoperable Vehicle Hearings 2 3 Mr. Brown moved to set September 25, 1986 at 9:00 A.M. for inoperable vehicle 4 hearings on property located at 608 S. 9th, 610 South 9th, 81 N.W. L St, and 1615 5 South 5th Street, seconded by Mr. Willis and on unanimous voice vote the motion 6 was carried. 7 8 Fire Department 9 10 Retroactive Action on Promotions 11 12 A memo to the Board from Assistant Chief Don Trotter stated that the promotions 13 of Joe Pierce, Jr. and Rick Enis to First Class Fire Fighter had not been approved 14 and they should be approved retroactively to September 21, 1985. 15 16 Mr. Willis moved to approve the promotion of Joe Pierce Jr. and Rick Enis to 17 Firefighter First Class retroactively to September 21, 1985, seconded by Mr. 18 Brown and on unanimous voice vote the motion was carried. 19 20 Purchasing Department - Set Date for Fire House No. 1 Roof 21 22 Ms. Wilson informed the Board that the specifications were now ready for the re- 23 roof of Fire House No. 1. 24 25 Mr. Brown moved to set October 2, 1986 at 9:00 A.M. to receive bids for the re- 26 roofing of Fire House No. 1, seconded by Mr. Willis and on unanimous voice vote 27 the motion was carried. 28 29 Police Department 30 31 Retirement of Patrolman Donald D. Hazelwander 32 33 Police Chief Nimitz informed the Board that Patrolman Donald Hazelwander had served 34 the City well for twenty (20) years and recommended the acceptance of his 35 retirement effective September 12, 1986. 36 37 Mr. Willis move to accept the retirement of Donald Hazelwander and wish him well 38 in his future, seconded by Mr. Brown and on unanimous voice vote the motion was 39 carried. 40 41 Ms. Silbertein thanked Officer Hazelwander for his service to the City. 42 43 Hiring of Three Probationary Officers 44 45 Chief Nimitz presented Edwin David Baker, James Robert Branum and Paul David Phillips 46 as recommended applicants for Probationary Police Officers with the Richmond Police 47 Department. Chief Nimitz stated they have been approved by the Merit Commission 48 and accepted by the Pension Board. The Chief requested the hirings be effective 49 September 15, 1986. 50 51 Mr. Willis moved to approve the hiring of Edwin Baker, James Branum and Paul 52 Phillips as Probationary Police Officers effective September 15, 1986, seconded 53 by Mr. Brown and on unanimous voice vote the motion was carried. 54 55 Mayor Frank H. Waltermann administered the oaths to become Probationary Police 56 Officers and the congratulations of the Board was extended to the new members 57 of the Richmond Police Department . 58 59 ADJOURNMENT 60 61 There being no further business, on a motion duly made, seconded and passed the 62 meeting was adjourned. 63 64 65 Susan Silberstein, President ATTEST: Mary Merchanthouse, City Clerk
