SUPPORTING ASSEMBLY BILL A -1723
WHEREAS, Assembly Bill A -1723, enacted by the Senate and General Assembly,
would permit municipalities to charge public utility fees to cover the full cost of traffic
control services that municipalities deem necessary due to emergency work performed by
public utilities; and
WHEREAS, as such, A -1723, provides that, whenever a municipality determines that
the services of its police department are necessary to direct traffic around emergency
work performed by a public utility, the municipality shall be permitted to charge the
public utility a fee to cover the full costs associated with the provision of its police
department's traffic control services; and
WHEREAS, current Idw requires the New Jersey Board of Public Utilities is to resolve
any dispute between the municipality and a public utility that may arise under the bill's
provisions, as determined by the board; any fee paid by a public utility to a municipality
for traffic control services pursuant to the bill's provisions is to be recoverable in the
public utility's base rate case; and
WHEREAS, municipalities must often pay their police officers overtime for providing
traffic control and in turn are forced to raise property taxes on residents to pay for these
additional costs.
WHEREAS, tine New Jersey League of Municipalities strongly supports A -1723 as
released and has requested that all of its members to go on record similarly supporting the
same.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough
of Carteret, County of Middlesex, State of New Jersey, as follows:
That the Borough of Carteret hereby supports Assembly Bill
A -1723 released by the Senate and General Assembly,
2. That a copy of this Resolution be forwarded to the New Jersey
League of Municipalities, Assemblyman Ronald S. Dancer,
Senator Joseph Vitale, Assemblyman Craig Coughlin and
Assemblyman John Wisniewski.
