BOARD OF PUBLIC WORKS AND SAFETY OF THE
CITY OF RICHMOND, INDIANA, JUNE 19, 1986
1 The Board of Public Works and Safety of the City of Richmond, Indiana, met in
2 regular session June 19, 1986 at the hour of 9:00 A.M. in the Municipal Building
111 3 in said City. Ms. Silberstein presided with Mr. Brown and Mr. Willis in attendance.
4 The following business was had to-wit:

6 9:00 A.N. UNSAFE BUILDING HEARINGS

8 Ms. Silberstein announced the Unsafe Building Hearings would be delayed to later
9 in the Agenda.

11 APPROVAL OF MINUTES OF JUNE 12, 1986
12
13 Mr. Willis moved to approve the minutes of the previous meeting as approved, seconded
14 by Mr. Brown and on unanimous voice vote the motion was carried.

16 APPROVAL OF. CLAIMS FOR PAYMENT
17
18 Mr. Brown moved to approve claims in the amount of 128,534 .80, seconded by Mr.
19 Willis and on unanimous voice vote the motion was carried.

21 REPORT ON G STREET BRIDGE - COUNTY ENGINEER
22
23 Mr. Dick Jackson, Wayne County Engineer, gave the Board an update on the G Street
24 Bridge. Mr. Jackson stated that an inventory of the bridge had been completed
25 on April 22, 1986 and it was the opinion that the bridge was safe with the three
26 (3) ton weight limit. He said the curb lane was developing some holes and with
27 the help of the City Street Commissioner, the curb lane had been closed and the
28 bridge was now two (2) lanes.

30 Mr. Jackson explained that the firm of Butler, Siefert, Fairman had been contracted
31 for engineering purposes and now a Chicago firm had been hired under their direction
32 to take core samples and study the bridge to see what can be saved. He said the
33 earliest date for start of construction would be in July or August of 1987 and
34 that with all the paper work and agencies involved they were moving as quickly
35 as possible.

37 Ms. Silberstein asked about a rating on the inventory sheet and Mr. Jackson
38 explained that the ratings were from 1 to 9 and the lower number indicates a
39 worse rating. He indicated that with the three (3) ton limit, he doesn't feel
40 the bridge is a problem and feels much of the work will be cosmetic rather than
41 structural.

43 Ms. Silberstein asked who certified the three (3) ton limit as safe and Mr. Willis
44 stated that it was certified by federal standards under the Federal Bridge Law
45 and it is inspected every two (2) years.

47 Mr. Willis stated that he felt it was prudent to get buses and other heavy equipment
48 off of the bridge and using alternate routes to prevent any possible disaster.
49 He said that closing the bridge would cause other traffic problems .

51 Mr. Jackson stated that he hoped the City would agree with continuing to patching
52 and reparing the bridge and Mr. Willis stated that they would commit to keeping
111 53 potholes, etc. repaired.

57 PUBLIC REQUESTS AND COMMENTS

59 Approval for Roto-Whirl Helicopter Rides - Rose Festival

61 Ms. Silberstein read the following request:

63 This is a request for approval for Roto Whirl of Indianapolis to land one
64 helicopter in the parking lot of the City Building (far west end) on Saturday,
65 June 28, Sunday, June 29, Froday, July 4, Saturday, July 5, and Sunday, July

1 6, during the Richmond Area Rose Festival.

3 Roto Whirl will be giving rides to the general public at a cost of $10.00
4 per person. Attached is a copy of the certificate of insurance.

6 The schedule for June 28 and 29 is tentative to date. The schedule for
7 July 4, 5, and 6 is confirmed.

9 This will be the same as last year. If you have any questions, please feel

16 Mr. Willis moved to approve the request of Roto Whirl to use the west end of the
17 City Building parking lot on June 28, 29, July 4, 5, and 6th, seconded by Mr.
18 Brown and on unanimous voice vote the motion was carried.

20 Approval for Exemption from Noise Control Ordinance - Ken Alexander and Phillip King
21
22 Ms. Silberstein presented the requests of Ken Alexander and Phillip King for a
23 waiver of the noise control ordinance for a free concert at 1900 North J Street
24 by Sound Ministries.
25
26 Speaking for the request was Mr. Phillip King of 3692 Test Road. Mr. King explained
27 that Sound Ministries desired to put on a free concert for outreach on June 21,
28 1986 from 7:00 P.M. to 11:00 P.M. on private property at 1900 North J Street .
29 He said it would be a semi-accoustical concert with sound amplification used for
30 voice and certain instruments and would be in a garage with the door opened.
31 He stated the concert was in connection with Faith Tabernacle Church and was
32 specifically for residents in North Richmond.

34 Ms. Silberstein stated that the Board has in the past granted waivers when the
35 entire neighborhood is involved and participating in an event, but in this instance
36 the Board needs to consider any disruption to neighbors not involved in the activity.

38 Mr. King indicated he did not anticipate any disruption of the neighborhood and
39 the'amplifications is used only for clarity and audibility not loudness.

41 Mr. Willis asked if they would be willing to cooperate with Police if any complaints
42 were received if the Board honored the request and Mr. King stated they would.

44 Mr. Brown asked if they would be using any part of the roadway and Mr. King stated
45 they would stay on private property.

47 Mr. Willis approve the request to waive the Sound Control Ordinance for a concert
48 by Sound Ministries at 1900 North J Street on June 21, 1986 from 7:0 P.M. to
49 11:00 P.M. contingent upon Police notification to stop, seconded by Mr. Brown
50 and on unanimous voice vote the motion was carried.

54 Residential Handicapped Parking Request at 212 South llth St.

56 The request for Odis Lady for a residential handicapped parking request at 212
57 South llth Street was presented. Captain Farmer stated the request meets the
58 requirements and even though there is a garage available at the rear of the
59 property it is not serviceable. He recommended approval of the request.

61 Mr. Willis moved to approve the request for a residential handicapped parking
62 space at 212 South llth Street, seconded by Mr. Brown and on unanimous voice vote
63 the motion was carried.

1 Report of Traffic Hazard at South 16th and J Streets

III 3 Councilmember Lynn Morris presented the Board photographs of a traffic hazard
4 at South 16th and J Streets where weeds and vines have grown around a pole and
5 there is no visibility. She stated it was located on the N.E. corner of the
6 intersection and is not certain about the responsibility.
7
8 Mr. Willis suggested that the Board hold any action and allow him and Captain
9 Farmer to view the situation and report back to the Board.

19 Mr. Dennis Bronston informed the Board that he has been unable to contact the
20 property owners at 517 North 20th Street and 326 North 10th Street and requested
21 the Board reschedule these hearing to July 17th in order a title search can be
22 completed and the owners property notified.

24 Mr. Brown moved to set unsafe building hearings on property located at 517 North
25 20th Street and 326 North 10th Street for July 17, 1986 at 9:00 A.M. , seconded
26 by Mr. Willi and on unanimous voice vote the motion was carried.

28 640 South llth Street

30 Ms. Silberstein opened the Unsafe Building Hearing on premises located at 640
31 South llth Street pursuant to an order issued to Clifford and Margaret J. Malicoat
32 and Beatrice Eaton on June 2, 1986. The order stated the following action be
33 accomplished: Vacating of building within fifteen (15) days of the receipt of
34 the order and repair or removal of building within thirty (30) days of the receipt
35 of the order.

37 Ms. Silberstein requested determination that the owner had been properly notified
38 and Proof of Notification by return receipt mail was provided. Mr. Brown moved
39 to accept and file the Proof of Notification, seconded by Mr. Willis and on
40 unanimous voice vote the motion was carried.

42 The Clerk administered the oath to give testimony to Mr. Dennis Bronston. Mr.
43 Bronston informed the Board that he had issued an unsafe building order on Jue
44 2, 1986 after an inspection by the Wayne County Health Department. He stated
45 the inspection showed unsanitary conditions with debris throughout the structure
46 and other unsanitary facilities in the structure. He said that he and Mr. Martel
47 Winburn of the Health Department had told Mrs. Eaton that they would be back for
48 a re-inspection and that upon re-inspection no improvements had been made.

50 The structure has been designated Unfit for Human Habitation.

52 Mr. Bronston stated that the property has now been vacated and they are now working
III53 with the owners to clean up the premises . Mr. Bronston stated that he
54 anticipated the attendance of the owner, but they are not in attendance.

56 The Clerk administered the oath to give testimony to Mr. Martel Winburn of the
57 Wayne County Health Department to speak in support of the unsafe building order.

59 Mr. Winburn stated he had received numerous complaints on the premises and had
60 found unsanitary conditions and a threat to residents and neighbors along with
61 being a fire hazard.

63 Mr. Willis asked if the structure should be demolished and Mr. Bronston stated
64 stated that they had needed to vacate the premises to determine if it could be
65 repaired or needed to be removed and he had been unable to make a structural

1 condition report due to the unsanitary conditions in the interior. He stated
2 the structure is now being cleaned and recommended that the Board affirm the order
3 and the thirty (30) days should allow the time to start work toward repairing
4 or removing the structure.

6 There were no owners or other interested parties in attendance.

8 Ms. Silberstein suggested that the proper address of the property be noted when
9 the order was affirmed.

11 Mr. Willis moved to affirm the unsafe building order issued on unsafe premises
12 located at 640 South llth Street stating that the property be repaired or removed
13 within thirty (30) days of the receipt of the order, seconded by Mr. Brown and
14 on unanimous voice vote the motion was carried.

16 1431 South I Place

18 Ms. Silberstein opened the Unsafe Building Hearing on property located at 1431
19 South I Place pursuant to an order issued to Anita Bowling (aka Anita
20 Stubbinfield) on June 2, 1986. The order stated the following action be
21 accomplished within thirty (30) days of the receipt of the order: Repair or removal
22 of building.

24 Ms. Silberstein requested Proof of Notification to the owner. Mr. Bronston stated
25 he had been unable to notify the owner by mail and that it had been legally advertised
26 on June 9th and 10th. Ms. Silberstein determined that the advertisement on June
27 9th would meet the requirements for notification. Mr. Brown moved to accept and
28 file the Proof of Notification, seconded by Mr. Willis and on unanimous voice
29 vote the motion was carried.

31 Mr. Dennis Bronston, still being under oath, informed the Board that the structure
32 had been victim to fire on April 10, 1986 and that several attempts had been made
33 to reach the owner that had been unsuccessful. He said after the notification
34 he had been contacted by Mr. Russ Commons and Mr. Tom Price regarding permits
35 for repairs and that Mrs . Anity Stubbinfield had also contacted him. He stated
36 that also after making an inspection on the permits and the legal notification
37 Mr. Stubbinfield had contacted him about the permits . He stated he recommended
38 sufficient time for improvements to be made if the owners were committed to doing
39 it in a timely manner.

41 Mrs. Anita Stubbinfield of 909 South 8th Street, owner of record informed the
42 Board that they have been held up on the insurance claim, but that they have decided
43 to repair the premises regardless of the insurance claim and have started cleaning
44 in order to build back.

46 Also speaking for Mrs. Stubbinfield was Councilmember Marion Williams. Mr. Williams,
47 being under oath, stated that the Stubbinfield's did not know the procedure for
48 permits and repairs and now they want to rebuild if they can get the building
49 permits to get started.

51 Mr. Brown stated his concern about doing the work themselves and also needing
52 a timetable for completion of repairs.

54 Mrs. Stubinfield stated that she was supposed to hear from the insurance company
55 within two (2) to three (3) weeks, but regardless they were wanting to rebuild
56 and would located the funds with or without the insurance money.

58 Mr. Brown asked if the property was secure and he was informed it was.

60 Mr. Willis moved to affirm the unsafe building order on property located at 1431
61 South I Street and to modify the order to read: Repair of the unsafe building
62 within 120 days with a thirty (30) day status report, seconded by Mr. Brown and
63 on unanimous voice vote the motion was carried.

1 Ms. Silberstein opened the Unsafe Building Hearing on premises located at 904
2 South llth Street pursuant to an order issued to Carolyn B. Tate Lf/Est/Rem/ to
III 3 Charles H. Tate on June 2, 1986. The order stated the following be accomplished
4 within thirty (30) days of the receipt of the order: Repair or removal of the
5 building.

7 Ms. Silberstein requested Proof of Notification and Mr. Bronston presented a return
8 receipt certified mail received on June 4, 1986. Mr. Brown moved to accept and
9 file the Proof of Notification, seconded by Mr. Willis and on unanimous voice
10 vote the motion was carried.

12 Mr. Dennis. Bronston, still being under oath, informed the Board that the structure
13 was a two story frame structure needing paint, holes repaired in the walls and
14 the roof over a building attached to the rear of the structure in danger of collapse.

16 Mr. Bronston stated that RP&L had removed service in 1984. Mr. Bronston added
17 that Mrs . Tate has been confined to the house.

19 Speaking as an interested party was Mr. Jerry Good. Mr. Good had been contacted
20 to rehabilitate the structure and demolish the structure at the rear of the
21 building. He said that Mr. Tate will• be in town this weekend about the work to
22 be done and he would be subcontracting the electrical and plumbing.

24 Mr. Willis asked that this hearing be tabled for two (2) weeks to receive an
25 estimate of repairs and see the committment from the owner.

27 Mr. Willis moved to table the Unsafe Building Hearing on property located 904
III28 South llth Street to July 3, 1986 at 9:00 A.M. , seconded by Mr. Brown and on
29 unanimous voice vote the motion was carried.

31 INQUIRY ON FIRE HYDRANT

33 Councilmember Williams asked how to get a fire hydrant moved since it is a traffic
34 hazard where it is located.

36 Mr. Williams stated that it would need to be inspected and see if it would be
37 feasible for the Fire Department to authorize the relocation.

39 Mr. Brown moved to authorize Public Works Director Ralph Willis to look into the
40 relocation of the fire hydrant with costs to be borne by the citizen requesting
41 the relocation of the hydrant, seconded by Mr. Willis and on unanimous voice vote
42 the motion was carried.

52 Mr. Bronston reported that the accessory buildings have been removed and repairs

57 Mr. Bronston reported that no repairs have started to the accessory building and
58 that Mrs. Clara Hall had talked with Mr. Willis about not being able to afford
59 the repairs. Mr. Willis offered to assist her in getting the building removed
60 and would like to see it done by the owner within three (3) weeks with assistance
61 from City to haul away debris.

6 Mr. Bronston reported that repairs have been started.

11 still needs paint.

16 and footers remain.

20 Set Date to receive bids for Street Improvements

22 Mr. Willis requested the Board to set a date to receive bids for improvements
23 on S.W. 17th Street from B to National Road, Fort Wayne Ave from D to E Street,
24 D Street from 7th to 8th Street and the Hawkins Road intersection.

26 Mr. Brown moved to set July 10, 1986 at 9:00 A.M. as the date and time to receive
27 bids for the specified street improvements, seconded by Mr. Willis and on unanimous
28 voice vote the motion was carried.
