CITY OF RICHMOND, INDIANA, MAY 15, 1986
1 The Board of Public Works and Safety of the City of Richmond, Indiana, met in regular
2 session May 15, 1986 at the hour of 9:00 A.M. in the Municipal Building in said City.
3 Ms. Silberstein presided with Mr. Brown and Mr. Willis in attendance. The following
4 business was had to-wit :

6 BID OPENING - BACKHOE BID FOR PARK DEPARTMENT
7
8 Ms. Martha Wilson, Acting Purchasing Director, requested all bid be turned in for
9 opening. Having received all bids, Mr. Brown moved to close the bidding, seconded
10 by Mr. Willis and on unanimous voice vote the motion was carried.
11
12 The Proof of Publication was examined and found to be in order. Mr. Willis moved
13 to accept and file the Proof of Publication, seconded by Mr. Brown and on unanimous
14 voice vote the motion was carried.

16 The following bids were received:

18 1. Thurston Equipment. The bid was on the proper form, signed and notarized
19 and accompanied by a bid bond. The bid was for 1-John Deere at a base price
20 of 21,750.00 with other options bid.

22 i 2. Twim Valley Equipment Company. The bid was on the proper form, signed and
23 accompanied by a cashier's check. The non-collusion affidavit was not notarized
24 and Mr. Barden stated that could be a waiveable item if the Board so desired.
25 The bid was in the amount of 26,987.31.

27 3. Allen County Tractor Sales . The bid was on the correct form, signed, notarized
I28 and accompanied by a bid bond. The bid was for a Ford Backhoe at a base price
29 of 25,085.40.

31 4. McAlister Equipment. The bid was on the proper form, signed, notarized
32 and accompanied by a bid bond. The bid was for a CAT backhoe in the base amount
33 of 39,237.00.

35 5. Rudd Equipment Company. The bid was on the proper form, signed, notarized
36 and accompanied by a bid bond. The bid was for a JCB backhoe in the base amount
37 of 25,678.36.

39 6. Reid Holcome Company. The bid was on the proper form, signed, notarized
40 and accompanied by a bid bond. The bid was for a John Deere backhoe at a base
41 price of 21,549.00.

43 7. Dabney Equipment Company. The bid was on the proper form, signed and accompanied
44 by a bid bond. The non-collusion affidavit was not notarized and Mr. Barden
45 explanied that could be a waiveable item if the Board desired. The base price
46 was 26,400.00.

48 8. Dayton Ford Tractor Sales. The bid was on the proper form, signed, notarized
49 and accompanied by a bid bond. The bid was for a Ford backhoe at the base price
50 of 25,185.00.

52 9. Bright Equipment Company. The bid was on the proper form, signed, notarized
53 and accompanied by a bid bond. The bid was for a Ford backhoe at the base price
54 of 27,827.00.

56 Mr. Brown moved to refer the bids to the Purchasing Office and the Park Department
57 for evaluation, tabulation and recommendation, seconded by Mr. Willis and on unanimous
58 voice vote the motion was carried.

60 Ms. Silberstein announced the bids would be available in the Purchasing Office after
61 the Board meeting.

63 CONTINUATION OF UNSAFE BUILDING HEARING AT 519 SOUTH 10TH STREET

65 Ms. Silberstein opened the continuation of an unsafe building hearing pursuant to

lan order issued on March 10, 1986 to Mr. Carl Bradley Lindsey, Jr. on unsafe premises
2located at 519 South 10th Street, Richmond, Indiana. The order stated the following
3action be accomplished: Sealing of unsafe building within ten (10) days and repair
4of unsafe building to minimum Richmond Building and Housing Code Standards or removal
5of unsafe building within thirty (30) days.
6
7The order had been modified to eliminate the sealing of the structure and the hearing
8continued to allow a schedule of repairs and time needed to complete repairs,.to be
9submitted to the Board.
10
11Ms. Silberstein requested any further finding of fact from the Planning Department.
12
13The Clerk administered the oath to give testimony to Mr. Dennis Bronston. Mr. Bronston
14informed the Board that he had the opportunity to meet with Mr. Lindsey and examine
15the interior of the structure which did have extensive damage in the kitchen and
16other interior repairs needed. Mr Bronston stated that Mr. Lindsey wants to rehab
17the structure and in interested in participating in the City's rental rehab program.

19Mr. Willis asked for information to see if it was feasible to rehabilitate the premises .
20
21The Clerk administered the oath to give testimony to Mr. Carl Lindsey, Jr. , owner
22of record—of the premises at 519 South 10th Street.

24Mr. Lindsey informed the Board that he would do the interior cosmetic work and figured
25it would cost 700.00 to 1,000.00 for paint, ceiling tile, etc.
26
27Mr. Bronston stated that Mr. Lindsey, if qualified, could borrow up to 50% of the
28cost of rehab through the City's program and would have to secure the other 50% from
29other sources. He said that if the paperwork was submitted immediately, it could
30 be approved locally next Tuesday and submitted to the State, which is about a ten
31 (10) day review period.

33Ms. Silberstein asked if Mr. Lindsey had looked into private financing and Mr. Lindsey
34stated he has asked for 4,500.00 and received no final answer yet .

36Mr. Willis warned not to get more money in the property than it was' worth.
37
38Mr. Brown asked Mr. Lindsey if was anticipating participation in the City's Rehab
39Program and Mr. Lindsey stated he was .
40
41Ms. Silberstein asked how long was needed to complete the repairs after the financing
42was secured and Mr. Lindsey stated sixty (60) days.
43
44Mr. Willis suggested that the Board give Mr. Lindsey sixty (60) days with a thirty
45 (30) day reporting requirement.

47Mr. Willis moved to modify the Order on unsafe premises at 519 South 10th Street
48to read: repair of unsafe building to minimum Richmond Building and Housing Code
49Standards within sixty (60) days from todays date, with a status report to be given
50 within thirty (30) days, seconded by Mr. Brown and on unanimous voice vote the motion
51was carried.

53UNSAFE BUILDING HEARINGS' ON ACCESSORY BUILDINGS

55118 North 18th Street

57Ms. Silberstein opened the Unsafe Building Hearing pursuant to an order issued on
58 April 17, 1986 to David M. and Carol S. Burelison on unsafe premises located at 118
59North 18th Street, Richmond, Indiana. The order stated the following action be
60 accomplished within thirty (30) days of the receipt of the order:

64 Ms. Silberstein requested Proof of Service of Notice of Hearing and Mr. Barden stated
65it had been delilvered by Certified Mail. Mr. Brown moved to accept and file the

1 Proof of Service, seconded by Mr. Willis and on unanimous voice vote the motion was
2 carried.

4 Mr. Bronston, still being under oath, informed the Board that the Burelisons had
5 contacted him and are wanting to repair the garage. He stated they are having financial
6 difficulties preventing them from repairing the structure.
7
8 Mr. Bronston stated the roof needs replaced and the structure needs painting and
9 that some partial work has been done on the roof. He stated the structure is in
10 a deteriorating condition and the source of neighborhood complaints .
11
12 Ms. Silberstein requested testimony from the owner of record or other interested
13 parties.

15 The Clerk administered the oath to give testimony to Carol Burelison. Mrs. Burelison
16 informed the Board that she and her husband have been unemployed and it would take
17 120.00 to get the sheeting to repair the roof. She asked if the Board would allow
18 an extension of time if they removed the old roof and painted portions of the structure
19 allowing them time to get the money for the roof.

21 In response to Mr. Willis, Mr. Bronston explained that there are no funds available
22 for rehabilitation of accessory buildings .
23
24 Mr. Willis asked the Burelisons if the City could provide the materials for repair
25 of the roof, would they be willing to work off the money involved.
26
27 City Attorney Barden stated he would look into a means to allow the money to be worked
28 off.
29
30 Mrs. Burelison stated they would be willing to work off any money involved and that
31 they would immediately paint any portion of the structure in view to the neighborhood.

33 Mr. Willis requested the Burelisons to acquire a list of materials and costs and
34
35 contact the City regarding working off the money at 5.00 per hour.

37 Mr. Willis moved to modify and affirm the order on unsafe premises located at 118
38 North 18th Street to read:

40 Repair of unsafe garage to minimum Richmond Building and Housing Code Standards
41 within sixty (60) days of today's date with a report due within thirty (30)
42 days, seconded by Mr. Brown and on unanimous voice vote the motion was carried.

44 256 S.W. 3rd Street

46 Ms. Silberstein opened the hearing on unsafe premises located at 256 S.W. 3rd Street
47 pursuant to an order issued on April 14, 1985 to Thomas J. and Shirley D. Reece
48 stating the following be accomplished within thirty days of the receipt of the order:

52 Ms. Silberstein requested Proof of Service and Mr. Barden stated the owner of record
I53 had been notified by certified mail on April 16, 1986.

55 Mr. Brown moved to accept and file the Proof of Service, seconded by Mr. Willis and
56 on unanimous voice vote the motion was carried.

58 Still being under oath, Mr. Bronston presented the Board photographs of the garage
59 taken on April 11, 1986 and May 7, 1987 showing the structure still in the same
60 condition. Mr. Bronston stated he had sent a letter last summer on the structure
61 and had received no response.

63 Ms. Silberstein requested testimony from the owner of record or other interested
64 parties.

1 The Clerk administered the oath to give testimony to Mr. Thomas Reece.

3 Mr. Reece informed the Board that he wasn't physically able to repair the structure
4 last summer and that now he has started to remove the roof and haul the debris
5 away and that he would like to repair the structure.
6
7 Ms. Silberstein asked Mr. Reece if he had the materials to repair the structure
8 and finances and Mr. Reece stated he did.
9
10 In response to Mr. Willis, Mr. Reece stated he would need sixty (60) days to roof
11 and paint the structure.
12
13 Mr. Reece asked about removal of some trees along the property line in utility
14 wires and Mr. Bronston stated he would report the trees to RP&L.
15
16 Mr. Willis moved to modify and affirm the order on unsafe premises at 256 S.W.
17 3rd Street to read:

19 Repair of unsafe garage to minimum Richmond Building and Housing Code Standards
20 within sixty (60) days with a status report to be given within thirty (30)
21 days, seconded by Mr. Brown and on unanimous voice vote the motion was carried.

23 314 North 5th Street

25 Ms. Silberstein opened the unsafe building hearing on premises located at 314 North
26 5th Street pursuant to an order issued on April 14, 1986 to William Williams and
27 Mildred Nelson. The order stated the following action be accomplished:

29 Demolition of Unsafe Garage.

31 Ms. Silberstein requested Proof of Service and Mr. Barden stated the owners had
32 been notified by certified mail. Mr. Brown moved to accept and file the Proof of
33 Service, seconded by Mr. Willis and on unanimous voice vote the motion was carried.

35 Still being under oath, Mr. Bronston informed the Board that he had received a
36 letter from Mr. Williams stating that he planned to remove the structure on the
37 south side by May 17, 1986 and to repair the structure on the north side and will
38 submit plans for the repairs.

40 Mr. Willis moved to modify and affirm the order on unsafe premises located at
41 314 North 5th Street to read:

44 or removal of structures within sixty (60) days from todays date, seconded
45 by Mr. Brown and on unanimous voice vote the motion was carried.

47 Opportunity was given for the owner of record or other interested party to speak
48 and no comment was received with none being in attendance.

50 419 West Main Street

52 Ms. Silberstein opened the hearing on unsafe property located at 419 West Main
53 Street pursuant to an order issued on April 14, 1986 to Egas Realty. The
54 order stated the following action be accomplished within thirty (30) days:

56 Demolition of Unsafe Garage.

58 Ms. Silberstein requested Proof of Service and Mr. Barden stated that the owners
59 had been notified by certified mail. Mr. Brown moved to accept and file the Proof
60 of Service, seconded by Mr. Willis and on unanimous voice vote the motion was carried.

62 Mr. Bronston, still being under oath, informed the Board that he had been forwarded
63 a proposal from Whitewater Construction Co. for repairs to be completed by June
64 1, 1986 and he recommended the order be modified to reflect repairs within thirty
65 (30) days.

1 Mr. Willis moved to modify and affirm the order issued on premises located at 419
2 West Main Street to read:

5 thirty (30) days from today's date,

7 seconded by Mr. Brown and on unanimous voice vote the motion was carried.

9 Opportunity was given for testimony by the owner of record. None were present .

11 1118 Crosshall Street

13 Ms. Silberstein opened the unsafe building hearing on property located at 1118 Crosshall
14 Street pursuant to an order issued on April 14, 1986 to Barbara Simons stating the
15 following be accomplished within thirty (30) days of the receipt of the order:

17 Demolition of the Unsafe Garage.

19 Ms. Silberstein requested Proof of Service and Mr. Barden stated the owner had been
20 notified of the hearing by certified mail. Mr. Brown moved to accept and file the
21 Proof of Service, seconded by Mr. Willis and on unanimous voice vote the motion
22 was carried.

24 Still being under oath, Mr. Bronston informed the Board that the structure had been
25 removed, but the foundation was still standing and he believed it to be a source
26 of future problems such as litter and maintenance. Mr. Bronston stated he believed
27 the foundation to be a part of the unsafe structure and would like to see it removed.

29 Ms. Silberstein asked if affirming the order as issued would take care of what is
30 left of the structure.

32 Mr. Willis commented that there could be problems making the owner remove the foundation
33 and Mr. Bronston indicated that it could be addressed on ordinances outside the
34 building code.

36 Mr. Brown moved to modify the order to have the foundation removed. The motion
37 died for the lack of a second.

39 Mr. Willis stated he did not want to see the Board to picky, only to try to get
40 people to do what was reasonable.

42 Ms. Silberstein asked if the foundation was unsafe as it stands and was told _ that
43 it did not represent un unsafe condition and future problems could be dealt with
44 by other ordinances.

46 Mr. Willis stated he felt the unsafe garage had been properly resolved and the Board
47 should not speculate on the use for the existing foundation or it becoming a nuisance.

49 Mr. Willis moved to dismiss the order on unsafe premises located at 1118 Crosshall
50 Street, seconded by Ms . Silberstein and on a voice vote with Mr. Brown voting no
51 the motion was carried.

57 Ms. Silberstein opened the unsafe building hearing on premises located at 724 South
58 7th Street pursuant to an order issued on April 14, 1986 to Pauline Schiely, the
59 order stated the following be accomplished within thirty (30) days of receipt of
60 the Order:

64 Ms. Silberstein' requested Proof of Service and Mr. Barden stated the owners had
65 been notified of the hearing by certified mail .

2 and on unanimous voice vote the motion was carried.

4 Mr. Bronston, still being under oath, informed the Board that the structure was
5 still sound and that repairs had been started. He recommended the order be
6 dismissed.

8 Mr. Willis moved to dismiss the order on unsafe premises located at 724 South 7th
9 Street, seconded by Mr. Brown and on unanimous voice vote the motion was carried.

11 Opportunity was given during the hearing for testimony from the owner of record
12 or other interested parties. None were in attendance.

14 430 South 14th Street

16 Ms. Silberstein opened the unsafe building hearing on premises located at 430 South
17 14th Street pursuant to an order issued on April 14, 1986 to Ralph Conrad and Clara
18 Hall stating the following be accomplished within thirty (30) days of the receipt
19 of the order:

21 Demolition of Unsafe Garage.

23 Ms . Silberstein requested Proof of Service and Mr. Barden stated the owners had
24 been notified of the hearing by certified mail. Mr. Brown moved to accept and file
25 the Proof of Service, seconded by Mr. Willis and on unanimous voice vote the motion
26 was carried.

28 Still being under oath, Mr. Bronston informed the Board that no improvements have
29 taken place as of May 7, 1986. Mr. Bronston stated he received a letter requesting
30 additional time for repairs. Mr. Bronston stated the owners did respond to a letter
31 last fall on the structure and commit to having repairs completed by spring of
32 1986. The current correspondence comments on the fact that spring is not over until
33 June 21, 1986 and they want to repair the structure by that date.

35 Mr. Willis moved to modify the order on unsafe premises located at 430 South 14th
36 Street to read:

47 Ms . Silberstein opened the unsafe building hearing on premises located at 714 South
48 7th Street, pursuant to an order issued on April 14, 1986 to Margaret Goins and
49 Margaret Tevis stating the following action be accomplished within thirty (30) days.

54 Ms. Silberstein requested Proof of Service and Mr. Barden stated the owners had
55 been notified of the hearing by certified mail . Mr. Brown moved to accept and file

60 but debris still remained on the premises.

7 On request of Mr. Willis, Ms. Silberstein placed the meeting in a short recess .

9 The Board of Public Works and Safety of the City of Richmond, Indiana, reconvened
10 after a short recess.

12 117 - 119 North 14th Street

14 Ms. Silberstein opened the unsafe building hearing on premises located at 117-119
15 North 14th Street pursuant to an order issued on April 14, 1986 to Maria Lee Kleiss
16 stating the following be accomplished within thirty (30) days of receipt of the
17 notice:

19 Demolition of Unsafe Garage.

21 Ms. Silberstein requested Proof of Service and Mr. Barden stated that owner had
22 been notified by certified mail. Mr. Brown moved to accept and file the Proof
23 of Service, seconded by Mr. Willis and on unanimous voice vote the motion was carried.

25 Mr. Bronston, still being under oath, informed the Board that he had first made
26 contact on the garage last August and had received no response. No improvements
27 have been made to date as shown by photographs presented to the Board.

29 No owner of record or other interested parties were present to give testimony.

31 Mr. Willis moved to affirm the order issued on unsafe premises located at 117-119
32 North 14th Street for removal of the unsafe garage within thirty (30) days of the
33 receipt of the Order, seconded by Mr. Brown and on unanimous voice vote the motion
34 was carried.

38 Ms. Silberstein opened an unsafe building hearing on premises located at 325 North
39 16th Street pursuant to an order issued on April 14, 1986 to George Downing and
40 Michael Eby stating the following action be accomplished within thirty (30) days
41 of the receipt of the order:

43 Demolition of Unsafe Garage.

45 Ms. Silberstein requested Proof of Service and Mr.Bronston stated they were unable
46 to deliver the order, but he has talked with the owners and they are interested
47 in repairing the structure. He has requested a schedule of repairs in writing
48 and will reschedule the hearing if necessary.

52 Ms. Silberstein opened the unsafe building hearing on premises located at 115 North
I53 14th Street pursuant to an order issued on April 14, 1986 to Billy Ewbank stating
54 the following be accomplished within thirty (30) days of the receipt of the order:

56 Demolition of the Unsafe Garage.

58 Ms. Silberstein requested Proof of Service and Mr. Barden stated that the owner
59 had been notified of the hearing by certified mail. Mr. Brown moved to accept
60 and file the Proof of Service, seconded by Mr. Willis and on unanimous voice vote
61 the motion was carried.

63 Still being under oath, Mr. Bronston presented the Board photos from April 10,
64 1986 and May 7, 1986 showing no improvements. Mr. Bronst.on presented the Board
65 a letter from the owners stating that they were going to fix the garage by June

1 30, 1986. Mr. Bronston recommended to the Board that they modify the order to
2 allow the additional time.

4 Mr. Willis moved to modify and affirm the order issued on unsafe property located
5 at 115 North 14th Street to read:

7 Repair or removal of unsafe garage by July 1, 1986,
8
9 seconded by Mr. Brown and on unanimous voice vote the motion was carried.

11 FINAL REPORT ON 25 SOUTH 10TH AND 903-905 NORTH A STREET

13 Mr. Bronston informed the Board that the unsafe premises located at 25 South 10th
14 Street and 903-905 North A Streets have been removed pursuant to orders of the
15 Board.

17 APPROVAL OF MINUTES OF MAY 8, 1986

19 Mr. Willis moved to approve the minutes of the previous meeting as prepared, seconded
20 by Mr. Brown and on unanimous voice vote the motion was carried.

22 APPROVAL OF CLAIMS FOR PAYMENT
23
24 Mr. Brown moved to approve claims in the amount of 206,173.90 for payment, seconded
25 by Mr. Willis and on unanimous voice vote the motion was carried.

27 DEPARTMENT REQUESTS AND COMMENTS

29 Purchasing Department

31 Bid Award for Park Mowing Equipment and Trucks

33 Ms. Wilson made the following recommendation for mowers :
34
35 Sprayer to Kenny Equipment at 4,242.00.
36 Two (2) Greensmowers to Indiana Turf at 17,572 .72.
37 Tee Mower to Indiana Turf at 8,229.76.
38 Rotary Mower to Indiana Turf at 6,810.00.
39 Six Lawn Boy handmowers to Conniffs at a total of 2,140.00

41 Mr. Willis moved to award the bids for Park Department mowing equipment as recommended,
42 seconded by Mr. Brown and on unanimous voice vote the motion was carried.

44 Ms. Wilson made the following recommendations for Mini-Van and Five Trucks:
45
46 One Mini-van for Park Department to Brookbank Chevrolet at 12,433.41.
47 Four - Two Wheel Drive Pick-ups for Park Department to Brookbank Chevrolet
48 at 8,711.50 each for a total of 34,846.00.
49 One - Four Wheel Drive Pick-up Truck for Police at 13,558. 72.

51 Ms. Wilson stated that she had checked other sources to make certain that the bid
52 received on the trucks was a good bid and she distinguished it was a good price.

54 Mr. Willis asked about the old vehicles being replaced and stated he would be
55 interested in one for the landfill.

57 Mr. Willis moved to award the bids for one - Mini-Van, four- two wheel drive trucks
58 and one-four wheel drive truck per to Brookbank chevrolet per recommendation,
59 seconded by Mr. Brown and on unanimous voice vote the motion was carried.

61 Barricades at SWAC for Tour Bus

63 A letter was presented to the Board from Gwen Schroeder, Recreation Director for
64 the Park requesting the parking lanes in front of the the Senior Workers Action
65 Center at 306 South 10th Street be barricaded on the afternoons of May 19, 1986

11 and June 30, 1986 for tour buses for scheduled activities at the Senior Center.

3 The Board was informed by the Clerk that Traffic Captain Farmer had no objections.

5 Mr. Willis moved to approve the request to barricade the parking lane at 306 South
6 10th Street on May 19, 1986 and June 30, 1986, seconded by Mr. Brown and on

11 The Board was presented the Conflict of Interest Disclosure Statement of Robert
12 Michael Chambers, Detective with the Richmond Police Department. Mr. Chambers is
13 the owner of Universal Communications and does business with the City of Richmond.

15 Mr. Brown, moved to approve and execute the Disclosure Statement of Robert
16 Michael Chambers, seconded by Mr.Willis and on unanimous voice vote the motion was
17 carried.
