HomeMy Public PortalAbout04-26-1986 BOARD OF PUBLIC WORKS AND SAFETY OF THE CITY OF RICHMOND, INDIANA, APRIL 24, 1986 1 The Board of Public Works and Safety of the City of Richmond, Indiana, met in regular 2 session April 24, 1986 at the hour of 9:00 A.M. in the Municipal Building in said 3 City. Ms. Silberstein presided with Mr. Brown in attendance. Mr. Willis was absent. 4 The following business was had to-wit: 5 6 BID OPENING FOR FIRE DEPARTMENT BREATHING APPARATUS 7 • 8 The Purchasing Director, Rita Stout, requested all bids be turned in for the Fire 9 Department breathing apparatus. 10 11 Having received all bids, Mr. Brown mvoed to close the bidding, seconded by Ms. 12 Silberstein and on unanimous voice vote the motion was carried. 13 14 Ms. Stout examined the Proof of Publication and found it to be in order. Mr. Brown 15 moved to accept and file the Proof of Publication, seconded by Ms. Silberstein and 16 on unanimous voice vote the motion was carried. 17 18 The following bids were received: 19 20 1. Midwest Fire and Safety. The bid was on the proper form, signed and notarized 21 and accompanied by a bid bond in 10% of the total bid. The total bid price 22 was for 30,988.25 with trade in of eighteen (18) air masks . 23 24 2. Breathing Air System. The bid was on the proper form,signed and notarized 25 and accomp'axi±e'd by a cashier's check in the amount of 10% of the total bid. 26 The bid included a price of 14,907.00 for the cascade system and an 27 alternate bid of 79,507.00 with trade in for purchase of 83 face masks of their 28 brand. III 29 30 Ms. Stout explained the bids were detailed with several different items and could 31 be split per item or go as a package bid. 32 33 Mr. Brown moved to refer the bids for the Fire Department breathing apparatus to 34 the Purchasing Director and the Fire Department for evaluation and recommendation, 35 seconded by Ms. Silberstein and on unanimous voice vote the motion was carried. 36 37 Ms. Stout announced the bids would be available for inspection in the Purchasing 38 Office. 39 40 CONTINUATION OF UNSAFE BUILDING HEARING - 511 NORTH 18TH STREET 41 42 Mr. Bronston requested the hearing be moved to the end of the agenda along with the 43 report on 903-905 North H Street to give time for the property owner to attend the 44 meeting. 45 46 APPROVAL OF MINUTES OF APRIL 17, 1986 47 48 Mr. Brown moved to approve the minutes of the previous meeting as prepared, seconded 49 by Ms. Silbertein and on unanimous voice vote the motion was carried. 50 51 APPROVAL OF CLAIMS FOR PAYMENT 52 53 Mr. Brown moved to approve claims in the amount. of 1,433,780.91 for payment, seconded 54 by Ms. Silberstein and on unanimous voice vote the motion was carried. 55 56 DEPARTMENT REQUESTS AND COMMENTS 57 58 Police Department 59 60 Revocation of Police Powers - Reserve Officer Larry Walton 61 62 Police Chief Nimitz read the following correspondence: 63 64 Board of Public Works and Safety 65 I1) Board of Works Minutes Cont 'd April 24, 1986 Page 2 1 Request that the police powers of Larry Walton, Richmond Police Reserve Officer 2 be revoked. 3 4 Please make this revocation effective immediately. 5111 6 This aciton is due to Larry Walton submitting a letter of resignation. 7 8 /s/ Joseph A. Nimitz 9 Chief of Police 10 11 Chief Nimitz: 12 13 Due to the resignation of Larry Walton from the Richmond Police Reserve it will 14 be necessary to revoke his Police Powers through the Board of Works. I am 15 requesting that this be done at the earliest possible convenience. 16 17 /s/ Capt . J.R. Farmer 18 19 Mr. Brown moved to revoke the police powers of Larry Walton as a Reserve Officer, 20 effective immediately, seconded by Ms . Silberstein and on unanimous voice vote the 21 motion was carried. 22 23 Board of Works 24 Executive Session for Fire Department Grievances No. 25 and 26-1985. 25 26 Ms. Silberstein stated the Board needed to establish an executive session to receive 27 information on the settlement in Grievances No. 25 and 26-1986 filed by Firefighters 28 Local 1408. 29 30 Mr. Brown moved to set April 28, 1986 at 4:00 P.M. to hold an executive session of 31 the Board of Public Works and Safety regarding personnel matters, seconded by Ms. 32 Silberstein and on unanimous voice vote the motion was carried. 33 34 ITEMS UNDER ADVISEMENT 35 36 G Street Bridge Weight Limit 37 38 Ms. Silberstein reported that Mr. Willis had contacted the County Commissioners regarding 39 lowering the weight limit on the G Street Bridge to three (3) ton. Mr. Willis had 40 indicated that the county has no objection, but is unable to take a position since 41 they are in the process of doing a survey of bridges and felt the action would be 42 premature on their part. 43 44 Ms. Silberstein stated that the three (3) ton limit is the lowest allowed to keep 45 the bridge open. 46 47 Mr. Brown asked if the High School and Sanitary District, etc. would be notified 48 and Ms. Silberstein stated they are all aware of the condition of the bridge, but 49 as a matter of courtesy they will be notified. 50 51 Captain Farmer informed the Board that it would take two (2) to three (3) weeks to 52 get the signs ordered and posted. 53 54 Mr. Brown moved to lower the weight limit on the G Street Bridge from eight (8) tons 55 to three (3) tons effective with the posting of signs, seconded by Ms. Silberstein 56 and on unanimous voice vote the motion was carried. 57 58 PUBLIC REQUESTS AND COMMENTS 59 60 Residential Handicapped Parking Designation - 400 S.W. 3rd Street 61 62 The request of Louella Loudy for a residential handicapped parking space at her 63 residence at 400 S.W. 3rd Street was presented. 64 65 Captain Farmer informed the Board that the request met all requirements and he 1tlf0 Board of Works Minutes Cont'd April 24, 1986 Page 3 • 1 recommended approval. 2 3 Mr. Brown moved to approve a residential handicapped parking designation at 400 11/ 4 S.W. 3rd Street, seconded by Ms. Silberstein and on unanimous voice vote the motion 5 was carried. 6 7 Approval for 10K Run for Richmond Area Life Underwriters 8 9 Ms. Silberstein read the following correspondence from David Zook, representing the 10 Richmond Area Life Underwriters: 11 12 The Richmond Area Association of Life Underwriters is requesting your approval 13 to use designated city streets (reference attached map) to conduct a 10K run. 14 The run is scheduled for May 10th between 8:30 a.m. and 10:00 a.m. The run will 15 begin and end at Earlham Race Track. This will be the fifth year for this race 16 and, as in the past, we will provide sufficient traffic control personnel to 17 assure a smooth and safe run. 18 19 Traffic Captain Farmer stated he had no objections and that the run utilizes very 20 little of the city streets . 21 22 Mr. Brown moved to approve the request of the Richmond Area Association of Life 23 Underwriters to use the designated streets for a 10K run on May 10, 1986 between the 24 hours of 8:30 A.M. and 10:00 A.M. , seconded by Ms. Silberstein and on unanimous voice 25 vote the motion was carried. 26 ' 27 Hodgin Road - Reduced Speed and Weight Limitations 28 III29 Mrs. Roy Hunteman of 3040 Hodgin Road requested the Board to consider the following 30 traffic regulations for Hodgin Road: 31 32 1. Reduce the speed from 40 MPH to 30 MPH on Hodgin Road from Henley Road to 33 Hunters Pointe due to the large number of children. They will also apply to 34 the County Commissioners to reduce the speed on the County section of the road. 35 36 2. Post Caution-Children Playing signs . 37. 3. Post no truck signs with a weight limit of ten (10) ton. 38 39 Ms. Silberstein stated that Mr. Willis was not in attendance, but that he was in 40 consensus with the request, especially the truck signs since the road was not constructed 41 for truck traffic and was deteriorating. 42 43 Ms. Silberstein also stated that Councilmember Hankinson had also indicated that he 44 was in favor of the request. 45 46 Captain Farmer stated that he agreed with the speed reduction and would post the 47 caution signs even though they would not produce miracles, but would serve as a 48 warning. 49 50 Captain Farmer stated that he would defer to Mr. Willis' professional opinion on the 51 weight limits. 52 III- 53 Mr. Brown stated that he was also in favor of the requests and moved to set the speed 54 limit on Hodgin Road between Henley Road and Hunters Pointe to 30 MPH, to place 55 Caution-Children Playing signs in the area and to place No Truck signs with a weight 56 limits of 10 Ton effective with ,the posting of the signs, seconded by Ms. 57 Silberstein and on unanimous voice vote the motion was carried. 58 59 Approval for Outdoor Concert at Earlham College 60 61 Ms. Silberstein presented a request from John Haskins, Earlham Student Activities 62 Board to get a permit from the Board of Works to allow an outdoor event on May 31, 63 1986 from 12:00 noon to 5:00 P.M. with amplification equipment for musical groups 64 to perform at the event. 65 Board of Works Minutes Cont'd April 24, 1986 Page 4 1Mr. Brown moved to approve the request for an outdoor event at Earlham College on 2May 31, 1986 between 12:00 noon and 5:00 P.M. with regard to exceeding the allowed 3sound levels, seconded by Ms. Silberstein and on unanimous voice vote the motion was 4 carried. 5 6 Request Regarding a Rose Garden on South A Street 7 8 Councilmember Lynn Morris presented a request to the Board from Mr. Elmer Thomas, 9 a resident of Cambridge Square, 3800 South A Street, to place a rose garden in a 10 dumping site at the dead end of South A Street. She stated that Mr. Thomas wanted 11 to use the area as a rose garden at his expense with the assistance of the 12 residence of Cambridge Square. 13 14 Ms. Silberstein questioned if this was a matter of use of private property. 15 16 Ms. Morris stated they were checking to make certain they were not impeding 17 on any right-of-way. 18 19 The item will be taken under advisement by the Board until the May 1, 1986 meeting 20 for more information. 21 22 REPORT ON UNSAFE PROPERTY AT 903-905 NORTH H Street 23 24 Mr. Bronston reported that the ownership of the property had reverted back to Bernard 25 Shipp from Oran Wilson and that Mr. Shipp has contracted a contractor for 26 demolition of the structure. Mr. Bronston stated he had not issued a permit, but 27 he felt if the permit were issued the structure would be demolished next week. 28 29 Mr. Bronston stated that the City has requested quotes from three (3) contractors, 30 but has not received any response. 31 32 Mr. Bronston stated that some work is being done on the property and he felt that 33 the contractor had given someone salvage rights on the structure. 34 35 Councilmember Morris stated that she is receiving complaints on the debris on the 36 property from the work being done and that some of the debris is being moved to other 37 locations. She indicated she hated to see another nuisance created. 38 39 Mr. Bronston stated that the City Attorney has corresponded about another possible 40 public nuisance. 41 42 CONTINUATION OF UNSAFE HEARING AT 511 NORTH 18TH STREET 43 44 Ms. Silberstein opened the continuation of the Unsafe Building Hearing on property 45 located at 511 North 19th Street pursuant to an order issued on March 10, 1986 to 46 Mr. Robert N. Holland, Milton, Indiana. The order required the following action 47 be accomplished within thirty (30) days of the receipt of the order: 48 49 1. Sealing of unsafe building within ten (10) days. 50 2. Repair of unsafe building to minimum Richmond Building andd Housing Code 51 Standards or removal of unsafe building within thirty (30) days. 52 53 Ms. Silberstein requested proof that the owner of record had been propertly notified. 54 Mr. Bronston stated that the owner had been notified by certified mail of the 55 original hearing and had also been notified of the continued hearing. 56 57 Mr. Brown moved to accept the Proof of Service, seconded by Ms. Silberstein and on 58 unanimous voice vote the motion was carried. 59 60 Ms. Silberstein requested finding of fact and recommendation from the Planning 61 Department. 62 63 The Clerk administered the oath to give testimony to Dennis Bronston. Mr. Bronston 64 informed the Board that he had requested a continuation for the owner to submit a 65 schedule of repairs and that he had recommended that the owner be present for the /10 Board of Works Minutes Cont'd .April 24, 1986 Page 5 1 hearing. Mr. Bronston said that to date he has not received a schedule of the repairs 2 nor had he been contacted by the contractor since the April 10, 1986 hearing date. 3 He said there is no written agreement with the contractor. 4 5 Mr. Bronston did report that the building had been secured. 6 7 Ms. Silberstein asked about the structural condition and Mr. Bronston stated it 8 was structurally sound, but showed evidence of a gas leak. 9 10 There was no one speaking in opposition to the order. 11 12 Mr. Bronston informed the Board that he recommended the order be modified to state 13 that the structure be repaired to minimum Richmond Building and Housing Code 1-4 Standards within thirty (30) days of the receipt of the order since he feels the 15 structure is good for rehabilitation. 16 17 Mr. Bronston stated the order would no longer require the sealing since it has been 18 accomplished and would not order the removal of the structure. 19 20 Mr. Bronston stated that if the Board affirmed the order as modified then the City 21 would have the authority to follow through on the rehabilitation. 22 23 Mr. Brown and Ms. Silberstein both indicated that the structure could be 24 repaired, but they felt a schedule of repairs should be submitted. 25 26 Mr. Brown moved to modify the order issued on unsafe premises located at 511 North 27 18th Street to read: Repair of unsafe building to minimum Richmond Building and 111 28 Housing Code Standards within thirty (30) days of the receipt of the order..and 29 to affirm the order as modified, seconded by Ms. Silberstein and on unanimous voice 30 vote the motion was carried. 31 32 ADJOURNMENT 33 34 There being no further business, on a motion duly made, seconded and passed the 35 meeting was adjourned. 36 37 38 39 Susan Silberstein, President 40 41 42 ATTEST: 43 Mary Merchanthouse, City Clerk 44 45 46 47 48 49 50 51 52 III 53 54 55 56 57 58 59 60 - 61 62 63 . 64 65
