BOARD OF PUBLIC WORKS AND SAFETY OF THE
CITY OF RICHMOND, INDIANA, FEBRUARY 20, 1985
1 The Board of Public Works and Safety of the City of Richmond, Indiana met in regular
2 session February 20, 1986 at the hour of 9:00 A.M. in the Municipal Building in said
3 City. Ms. Maness presided with Mr. Brown and Ms. Silberstein in attendance. The
III4 following business was had to—wit:

6 UNSAFE BUILDING HEARINGS

8 1440 N.W. 5th Street
9
10 Pursuant to an order issued on January 30, 1986 to Mary Boswell to wreck and remove
11 the dwelling located at 1440 N.W. 5th Street within thirty (30) days, Mr. Bronston
12 advised the Board that he had a telephone conversation with David Boswell and was
13 informed that he had contracted with Delucio and Sons to have the building demolished
14 within thirty (30) days . Mr. Bronston informed the Board that he had confirmed the
15 demolition contract and recommended the Board continue the hearing for thirty (30)
16 days to allow the Order be accomplished.

18 Ms. Silberstein moved to continue the Unsafe Building Hearing on property located
19 at 1440 N.W. 5th Street to March 20, 1986 at 9:00 A.M. , seconded by Mr. Brown and
20 on unanimous voice vote the motion was carried.

22 25 South 10th Street

24 Ms. Maness opened the Unsafe Building Hearing on property located at 25 South 10th
25 Street. The hearing was held pursuant to an Order issued on January 31, 1986 to
26 Thomas G. Davis and Marilyn Davis on unsafe premises located at 25 South 10th Street.
27 The order stated- that the following action, be accomplished: „Repaid or wreck and
28 remove dwelling within thirty (30) days .

30 The Clerk administered the oath to give testimony to Mr. Bronston.

32 Mr. Bronston informed the Board that after a title search and the owners of record
33 established that proper notification had been made of the hearing set for February
34 20, 1986. He said he had spoken with Mr. and Mrs . Davis, the owners of record, and
35 they had stated they would secure the dwelling and take the necessary steps to repair
36 the structure. The structure had been damaged by fire in 1984 and remains vacant.

38 The owner of record, Mr. Thomas Davis, took the oath to give testimony.

40 Mr. Davis informed the Board that he had been acting under the advise of his attorney
41 to not be concerned and he had received no correspondence regarding the property
42 until the order was received. Mr. Davis asked the Board fo additional time to either
43 sell the property or for him to be able to make the necessary repairs . He also stated
44 he understood that any order issued on the property would also transfer to any new
45 owners. Mr. Davis said he would work with the City and with additional time would
46 get the building torn down or fixed up.

48 Mr. Brown asked is the order could be changed to secure the property within ten (10)
49 days and Mr. Davis indicated he had already nailed the doors shut and put plywood
50 on the outside of the structure.

52 Ms. Silberstein asked about the structural condition and it the dwelling was salvageable.

54 Mr. Davis informed the Board that there was mostly smoke damage with some fire damage
55 to the first floow.

57 Mr. Bronston stated he had not gained interior access to the dwelling, but outwardly
58 the structure was sound and he recommended the Board give the Davises time to work
59 through a schedule of repairs .

61 Mr. Brown requested a structural report on the structure and Mr. Bronston stated
62 he would need Mr. Davis to consent for him to enter.

64 Ms. Silberstein moved to continue the Unsafe Building Hearing on 25 South 10th Street
65 to March 6, 1986 at 9:00 A.M. to enable the Board to receive a structural condition

1 report and for recommendations to be made on additional time to be allowed, seconded
2 by Mr. Brown and on unanimous voice vote the motion was carried.

4 541 Porterfield Avenue

6 Ms. Maness opened the Unsafe Building Hearing on property located at 541 Porterfield
7 Avenue pursuant to an order issued on January 31, 1986 to Joseph A. Hossman and
8 Catherine M. Hossman recommending the following action: Wreck and remove dwelling
9 and mobile home.

11 Mr. Bronston, still being under oath, informed the Board that after a title search
12 the owners of record had been properly notified of the hearing to be held on February
13 20, 1986. Mr. Bronston stated the dwelling had been vacant for a long period of
14 time and he was unable to find record of electric or sewer service to the property.

16 The Clerk administered the oath to give testimony to Mr. Joseph Hossman, owner of
17 record. Mr. Hossman stated that sewer and water were connected into the car wash
18 adjacent to the dwelling and that the mobile home still had electric service hooked
19 up. He indicated the house has been vacant several years and was being used for
20 storage.

22 Mr. Hossman stated that within sixty (60) to ninety (90) days he would be able to
23 get the house back in shape and he would secure the dwelling and mobile home within
24 a week. He said he would like to hang onto the house since he felt it was still
25 in good shape.

27 Mr. Bronston asked when the house was last occupied and Mr. Hossman stated ten (10)
28 years ago, but it was used as a warehouse.

30 Mr. Bronston stated the house is secured and he is unable to get into the dwelling
31 and he would like to do a structural condition report since it has been vacant for
32 such a long period of time. He indicated it may need electrical, heating and plumbing
33 repairs. Mr. Bronston stated he would recommend additional time be allowed if after
34 the inspection licensed contractors were used for any repairs and the repairs would
35 be kept within a specified time frame.

37 Ms. Siblerstein asked about the condition of the mobile home and Mr. Bronston stated
38 the windows were broken and steps ready to collapse. He said there was debris in
39 the interior and it looked like it had been adandoned and vandalised.

41 Ms. Silberstein asked Mr. Hossman what his intentions were with the property if he
42 were allowed to fix it up and Mr. Hossman stated he would live in the house or rent
43 it, but would not leave it vacant .

45 Mr. Bronston stated there were also two (2) accessory buildings on the lot to the
46 north that needed removed and also asked Mr. Hossman about the store front west of
47 the car lot.

49 Mr. Hossman stated he would take down the accessory buildings and get the store front
50 in shape.

52 Mr. Bronston stated that Mr. Hossman owned other buildings in the area that need
53 major repair and if he was not committed to the repairs he would be back before the
54 Board on the other buildings.

56 Ms. Silberstein moved to continue the Unsafe Building Hearing at 541 Porterfield
57 Avenue to March 6, 1986 and to modify the order to require the removal of of debris
58 and securing of the dwelling and mobile home within two (2) weeks and to remove the
59 accessory buildings in danger of collapse within four (4) weeks , seconded by Mr.
60 Brown and on unanimous voice vote the motion was carried.

62 Fire Chief Harbin approached the Board regarding the burning of unsafe buildings
63 as training for the Fire Department. The Chief stated he could get a blanket
64 variance from the State to be able to burn and asked for a line of communications
65 on buildings.

1 Ms. Maness stated the Board perferred to see houses rehabilitated rather than
2 demolished.

III4 Ms. Silberstein stated they would keep that in mind, but it would be the exception
5 rather than the rule.

7 APPROVAL OF MINUTES OF FEBRUARY 13, 1986

9 Ms. Silberstein moved to approve the minutes of the previous meeting as prepared,
10 seconded by Mr. Brown and on unanimous voice the motion was carried.

12 APPROVAL OF CLAIMS FOR PAYMENT

14 Mr. Brown moved to approve claims in the amount of 31,450.43 for payment, seconded
15 by Ms. Silberstein and on unanimous voice vote the motion was carried.

17 DEPARTMENT REQUESTS AND COMMENTS

19 Fire Department

21 Approval to Attend Training Classes

23 Fire Chief Harbin requested the Board's approval for Fire Prevention Personnel Joe
24 Pierce to attend the Building and Fire Code Courses, March 19, 26, April 2 and 9
25 in Indianapolis . The Course is Using the 1985 Indiana Building Code.

27 Chief Harbin stated that Lt. Pierce is the only member of the administrative offices
28 not having attended the Courses and with his attendance all members will have attended.

30 Ms. Silberstein moved to approve the request for Joe Pierce to attend a Building
31 and Fire Code Course on March 19, 26, April 2 and 9, seconded by Mr. Brown and on
32 unanimous voice vote the motion was carried.

34 Public Works

36 Street Sweeping Contract

38 A contract between the City of Richmond and McCoy's Sweeping Service for sweeping
39 the streets in the Downtown area, South E from 5th to 16th and N.W. 5th from U.S.
40 .40 to Dana Parkway was presented.

42 The sweeping is done one every seven (7) days and is done when traffic is at a minimum
43 in these areas. The contract is for a payment at the rate of Twenty-five dollars
44 ($25.00) per curb mile with a maximum of 467.50 per week. The contract runs from
45 April to October and McCoy's will obtain insurance to indemnify the City.

47 Ms. Silberstein moved to approve the contract between the City of Richmond and McCoy's
48 Sweeping Services per the terms and purposes stated, seconded by Mr. Brown and on
49 unanimous voice vote the motion was carried.

111 53 Ms. Maness requested this item be tabled for one (1) week for further clarification.

55 PUBLIC REQUESTS AND COMMENTS

57 Optimist Club Request regarding Traffic on Peacock Road

59 The request of the Optimist Club regarding items for traffic control on Peacock
60 Road was presented The area includes Peacock..Road between N.W. llth and N.W. 13th

62 where youth progr'ams' are' run. ! They requested the Board consider (1) No parking
63 on..either-;side-of Peacock=-Road; --(2) .Paint cross; s walk just east of bridge on Peacock,
64 (3) Place stop sign or flasher at cross walk for the months of May thru August and
65 (4) set 15 M.P.H. speed limit in this area.

1 Ms. Maness stated she would like to refer the requests to the Traffic Division.

3 Captain Farmer informed the Board that he had looked at the requests and would have
4 to reject the last two (2) requests, but that the no parking could be a viable
5 possiblity and he had no opposition to the cross walk. He stated he would like more
6 time to investigate the requests.

8 ITEMS UNDER ADVISEMENT

10 Residential Handicapped Parking Request at 1222 South 0 Street

12 Captain Farmer informed the Board that the request did not meet the guidelines for
13 a residential handicapped parking designation since there was a driveway and the
14 parking area in question probably belongs to the property owner.

16 Ms. Sillberstein moved to deny the request for a residential handicapped parking
17 designation at 1222 South 0 Street, seconded by Mr. Brown and on unanimous voice
18 vote the motion was carried.

20 Intersection of East Main and 5th Streets

22 Captain Farmer requested this item be removed from the Agenda due to an equipment
23 breakdown.

25 Ms. Maness requested the item be reported on by March 20, 1986.

27 Right of Way Encroachment - Waverly Drive

29 Mr. Barden stated that he is still trying to contact Mr. Backmeyer and he will follow
30 up with another letter.

32 Ms. Silberstein requested Mr. Barden to investigate action to be taken if Mr. Backmeyer
33 does not sign the agreement with the City.

35 Ms. Maness requested a report on the item in two (2) weeks.

39 Ms. Maness requested this item be brought hsrre-wrdtfen next: week to give Mr. Brown
40 a chance to look it over.

42 MISCELLANEOUS BUSINESS

44 Chicago Tribune News Stands

46 Mr. Barden informed the Board that he will be filing the necessary documents with
47 the Chicago Tribune regarding news stands being placed on city streets.

49 Mr. Barden also issued a Press Release regarding EPA guidelines for underground
• 50 storage tanks . Mr. Barden requested the Media assist him in informing the public
51 on the reporting requirements.

55 Mr. Bronston reported he would follow up on the sealing and assumed it had been
56 completed.
