AMENDMENT NO 1. TO INTERLOCAL AGREEMENT
THIS AMENDMENT NO. 1 amends the Interlocal Agreement ("Agreement") made and
entered into on September 11, 2018, by and between the City of Crestview, Florida, a political
subdivision of the State of Florida, hereinafter referred to as "CRESTVIEW", and the "CITY OF
FORT WALTON BEACH", a political subdivision of the State of Florida, hereinafter referred to as
"FORT WALTON", for Building Official Services.
WHEREAS, the parties entered into the Agreement to provide Building Official and/or
Building Inspector Services on an as needed basis for a period necessary to fill the Building Official
Position for CRESTVIEW;
WHEREAS, the parties hereto have the common power to employ a building official who
is certified by the Department of Business and Professional Regulation to perform plan review,
inspections and issue certificates of occupancy pursuant to Chapter 468, F.S., within their
geographic jurisdictions; and,
WHEREAS, both parties mutually agree to amend the Agreement to provide reciprocal
Building Official and/or Building Inspection Services as needed to the other per the terms of the
Agreement and this Amendment.
NOW THEREFORE, in consideration of the mutual covenants herein and other good
and valuable consideration, the parties hereby agree to amend the Agreement as follows:
1. Section 1 shall be amended to allow for reciprocal Building Official and/or
Building Inspector Services to each jurisdiction by the other as needed.
2. Section 2 shall be amended that the Designated Administrator to this agreement for
FORT WALTON is the Growth Management Director or his designee.
3. Section 3 shall be amended to state that the per hour rate for Building Official
and/or Building Inspector Services is commensurate to the current adopted pay rate
for these positions according to each jurisdiction's pay schedule.
4. Section 4 shall be amended to state that neither party shall be deemed to assume
any liability or responsibility to the other party, or any third party for errors,
omissions, or mistakes made as a result of the review set forth in Chapter 468, F.S.
5. Section 5 shall be amended to remove the expiration date of six (6) months, and the
Agreement shall not expire unless canceled by either CRESTVIEW or FORT
WALTON.
6. All other provisions of the Agreement shall remain unchanged unless specifically
modified by this Amendment. Should a conflict arise between this Amendment and
the Agreement, this Amendment shall control.
