MAINTENANCE OF THE EAST — WEST CONNECTOR ROADWAY
THIS INTERLOCAL AGREEMENT is entered into on this 18th day of
June , 2019, between the BOARD OF COUNTY COMMISSIONERS OF
OKALOOSA COUNTY FLORIDA, a political subdivision of the State of Florida whose address
is 302 North Wilson Street, Suite 302, Crestview, Florida 32536 (the "County"), and the CITY
COUNCIL OF THE CITY OF CRESTVIEW, FLORIDA whose address is 198 North Wilson
Street, Crestview, Florida 32536 (the "City").
WHEREAS, this Agreement is entered into under the authority granted to the City and the
County; and
WHEREAS, the City and the County are collectively working to develop the East-West
Connector Roadway including associated sidewalks, multi -use paths, stormwater pipes, ditches,
and stormwater ponds (the "Project"); and
WHEREAS, the Project will be a newly developed roadway between Antioch Road and
State Road 85 north of Interstate 10 in the Crestview area; and
WHEREAS, the County is working to develop the Southwest Crestview Bypass including
associated stonnwater pipes, ditches and stormwater ponds (the "Southwest Crestview Bypass
Project"); and
WHEREAS, the Southwest Crestview Bypass Project will be a newly developed roadway
between the new I-10 interchange and US 90; and
WHEREAS, the City and the County seek to enter into this Agreement for the purpose of
establishing a cooperative process, develop approved design criteria, identify Project
responsibilities, and identify long term maintenance responsibilities.
NOW, THEREFORE, the City and the County do agree as follows:
A. Project Execution
1. Okaloosa County will be the lead agency for the following activities:
a. Preliminary Engineering
b. Alternative Analysis
c. Survey
d. Geotechnical Exploration / Analysis
e. Enviromnental Pennitting
f. Right -of -Way Mapping

g. Right -of -Way Acquisition
h. Construction Contract
i. Construction Engineering & Inspection
B. Alignment
1. An alternative analysis has identified multiple options for connecting the roadway between
Antioch Road and State Road 85. Figure 1 depicts those alternative aligmnents and it is
agreed that alignment alternative five prime (5') is the preferred alignment. This
alternative has the least amount of impacts to wetlands of any alternatives presented and
meets the purpose and need of the road.
2. The western end of the Project will connect with Antioch Road at the current intersection
with Arena Road. The eastern end of the Project will connect to the western terninus of
Physician's Drive. The Project will cross/intersect the Southwest Crestview Bypass
roadway that is being developed separately by the County.
3. The City will continue to work with the property owner (independent from the County with
this Project) east of the Project termination for future extension of the roadway to connect
with SR 85 across from Hospital Drive.
C. Design Criteria
1. Two typical roadway sections will be utilized for this Project:
a. Rural Section — depicted as the purple portion of proposed aligmnent 5', this roadway
section will be utilized on the western portion of the project. Figure 2 provides a
schematic of the Rural Typical Section and Figure 3 provides the design criteria that
will be utilized for this section of the roadway.
b. Urban Section — depicted as the green portion of the proposed alignment 5', this
roadway section will be utilized on the eastern portion of the project. Figure 2 provides
a schematic of the Urban Typical Section and Figure 4 provides the design criteria that
will be utilized for this section of the roadway.
D. Ownership
1. Once constructed, all property obtained by Okaloosa County associated with the Project
will be conveyed to the City for permanent ownership and maintenance. The County will
prepare all necessary documentation for formal acceptance of the improvements by the
City.
2. Conveyance of the improvements to the City will relieve the County from any further
obligation regarding the Project or any future expansion of the Project. Should the City
desire additional improvements in the vicinity of (or expansion of) the Project this
agreement shall not be construed as any obligation for the County to participate. Such
participation shall require subsequent action by the County.
E. Financial and Real Property Participation

1. The City shall provide the County with $8 million on or before December 31, 2019 to -be
utilized for the Project. These funds shall be available for any use related to the Project
including, but not limited to, design, right-of-way acquisition, construction, or inspection
services.
2. The County shall provide the remaining funding for the Project.
3. For portions of the Project and the Southwest Crestview Bypass Project that lie within, or
adjacent to,, existing City owned parcels or rights -of -way, these lands will be dedicated to
the County at no charge. The County will create all legal descriptions and conveyance
documents necessary for the Project and the Southwest Crestview Bypass Project for
execution by the City. Once the Project is completed, all land associated with the East-
West Connector will be conveyed to the City at no charge.
4. The City shall be responsible for any cost associated with any City utility adjustments or
expansions such as, but not limited to, adjustment of spray field, adjustment of Rapid
Infiltration Basin System (RIBS), lift stations, water lines, and sewer lines.
F. Coordination
1. Though the County will serve as the lead agency for the Project, regular updates and
coordination shall be performed with the City. For this Project the point of contact for each
entity shall be:

2. The City and County shall conform to all the requirements of applicable State and Federal
statutes and regulations and all County Ordinances and regulations, and shall secure such
permits and licenses as may be duly required by any such laws, ordinance's, or regulations.
3. This Agreement represents the entire understanding between the parties with respect to the
undertakings covered hereunder and there are no oral or collateral agreements with respect
thereto between the parties.
4. The validity, construction and performance of this Agreement shall be governed by the
laws of the State of Florida. Venue for any action arising out of this Agreement shall be in
Okaloosa County, Florida.
5. If any portion of the Agreement, the deletion of which would not adversely affect the
receipt of any material benefit by either party, is for any reason held or declared to be
invalid or unenforceable, such determination shall not affect the remaining portions of thi s

Agreement. If this Agreement or any portion of this Agreement is held or declared to be
inapplicable to any person, property or circumstance, such determination shall not affect
its applicability to any other person, property or circumstance.
