J.Owner/Developer _hasagreed to the estimated costs to comply with all Conditions of Approval described in Exhibit “B”attached hereto and incorporated herein by this reference,by thetime set forth herein pursuant to the terms set forth in this Agreement. II.TERMS Now,therefore,for valuable consideration,receipt of which is hereby acknowledged,the parties agree as follows. 1.Recitals.The recitals set forth above are incorporated into this Agreement for all purposes. 2.Owner’s Obli ations to Com 1 with Conditions of A roval. a.Prior to the issuance of building permits for the Property,Owner shall deposit with the City in the amount of Ninety One Thousand Seven Hundred and Fi?y Dollars ($91,750.00)(“Deposited Funds”)in immediately available funds to assure that the Conditions of Approval are timely completed or to provide City with the funds needed to complete the same.
