HomeMy Public PortalAbout1804 Industrial.Richburg RezoningORDINANCE: 1804 AN ORDINANCE OF THE CITY OF CRESTVIEW, FLORIDA, PROVIDING FOR THE REZONING OF 46.38 ACRES, MORE OR LESS, OF REAL PROPERTY, LOCATED IN SECTIONS 04, 05 & 09, RESPECTIVELY, TOWNSHIP 3 NORTH, RANGE 23 WEST, FROM THE OKALOOSA COUNTY MIXED USE ZONING DISTRICT TO THE COMMERCIAL (C-2) ZONING DISTRICT; PROVIDING FOR AUTHORITY; PROVIDING FOR THE UPDATING OF THE CRESTVIEW ZONING MAP; PROVIDING FOR SEVERABILITY; PROVIDING FOR SCRIVENER'S ERRORS; PROVIDING FOR LIBERAL INTERPRETATION; PROVIDING FOR REPEAL OF CONFLICTING CODES AND ORDINANCES; AND PROVIDING FOR AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF CRESTVIEW, FLORIDA AS FOLLOWS: SECTION 1 — AUTHORITY. The authority for enactment of this ordinance is Section 166.041, Florida Statutes and Chapter 102, City Code. SECTION 2 — PROPERTY REZONED. The following described 46.38 acres, more or less, of real property lying within the corporate limits of Crestview, Florida, with 46.38 acres, more or less, being formerly zoned Okaloosa County Mixed Use with the Commercial Future Land Use Map designation recently ratified by the City Council through adoption of Ordinance 1803, is hereby rezoned to Commercial (C-2) to wit: PIN # 04-3N-23-0000-0029-0000, 05-3N-23-0000-0005-0000, & 09-3N-23-0000-0011-0000 BEGIN AT THE SOUTHWEST CORNER OF SECTION 4, TOWNSHIP 3 NORTH, RANGE 23 WEST, OKALOOSA COUNTY, FLORIDA; THENCE PROCEED NORTH 90 DEGREES 00'00"WEST, ALONG THE SOUTH LINE OF SECTION 5, TOWNSHIP 3 NORTH, RANGE 23 WEST, OKALOOSA COUNTY, A DISTANCE OF 387.79 FEET TO A POINT ON THE EASTERLY RIGHT OF WAY LINE OF THE OLD L&N RAILROAD RIGHT OF WAY; THENCE DEPARTING THE SOUTH LINE OF SAID SECTION 5, PROCEED NORTH 11 DEGREES 51'22"EAST, ALONG SAID EASTERLY RIGHT OF WAY LINE A DISTANCE OF 700.11 FEET; THENCE PROCEED NORTH 78 DEGREES 05'40" WEST, ALONG SAID EASTERLY RIGHT OF WAY LINE A DISTANCE OF 17.95 FEET; THENCE PROCEED NORTH 12 DEGREES 02'11 EAST, ALONG SAID EASTERLY RIGHT OF WAY LINE A DISTANCE OF 521.04 FEET; THENCE PROCEED SOUTH 78 DEGREES 09'44" EAST ALONG SAID EASTERLY RIGHT OF WAY LINE A DISTANCE OF 15.92 FEET; THENCE PROCEED NORTH 11 DEGREES 50'16" EAST ALONG SAID EASTERLY RIGHT OF WAY LINE A DISTANCE OF 136.21 FEET; THENCE DEPARTING THE EASTERLY RIGHT OF WAY LINE OF SAID OLD L & N RAILROAD, PROCEED SOUTH 89 DEGREES 52'37" EAST A DISTANCE OF 111.94 FEET TO THE NORTHWEST CORNER OF THE SOUTHWEST QUARTER OF THE SOUTHWEST QUARTER OF SAID SECTION 4; THENCE PROCEED SOUTH 89 DEGREES 52'37" EAST, ALONG THE NORTH LINE OF THE SOUTHWEST QUARTER OF THE SOUTHWEST QUARTER OF SAID SECTION 4 A Page 88 of 297 DISTANCE OF 1311.03 FEET TO THE NORTHEAST CORNER OF THE SOUTHWEST QUARTER OF THE SOUTHWEST QUARTER OF SAID SECTION 4, THENCE PROCEED SOUTH 00 DEGREES 0355" WEST, ALONG THE EAST LINE OF THE SOUTHWEST QUARTER OF THE SOUTHWEST QUARTER OF SAID SECTION 4, A DISTANCE OF 1325.45 FEET; THENCE DEPARTING THE EAST LINE OF THE SOUTHWEST QUARTER OF THE SOUTHWEST QUARTER OF SAID SECTION 4; PROCEED SOUTH 80 DEGREES 01'40" WEST, ALONG THE NORTHERLY RIGHT OF WAY LINE OF RICHBOURG LANE (50.00 FOOT RIGHT OF WAY), AND AN EXTENSION THEREOF, A DISTANCE OF 275.22 FEET; THENCE PROCEED SOUTH 78 DEGREES 51'40" WEST ALONG SAID NORTHERLY RIGHT OF WAY LINE A DISTANCE OF 350.87 FEET; THENCE PROCEED SOUTH 83 DEGREES 17'40" WEST ALONG SAID NORTHERLY RIGHT OF WAY LINE, A DISTANCE OF 189.92 FEET; THENCE PROCEED SOUTH 78 DEGREES 05'20" WEST ALONG SAID NORTHERLY RIGHT OF WAY LINE, A DISTANCE OF 11.05 FEET TO THE POINT OF CURVATURE OF A CURVE CONCAVE NORTHEASTERLY AND HAYING A RADIUS OF 323.45 FEET; THENCE PROCEED ALONG THE ARC OF SAID CURVED NORTHERLY RIGHT OF WAY LINE, THROUGH A CENTRAL ANGLE OF 36 DEGREES 00'20", AN ARC DISTANCE OF 203.26 FEET (CHORD BEARING AND DISTANCE - NORTH 83 DEGREES 54'30" WEST 199.93 FEET) TO THE POINT OF TANGENCY OF SAID CURVE; THENCE PROCEED NORTH 65 DEGREES 54'20" WEST, ALONG SAID NORTHERLY RIGHT OF WAY LINE, A DISTANCE OF 306.81 FEET; THENCE PROCEED SOUTH 24 DEGREES 05'40" WEST ALONG SAID NORTHERLY RIGHT OF WAY LINE; A DISTANCE OF 5.29 FEET TO A POINT ON THE SOUTH LINE OF SAID SECTION 4; THENCE DEPARTING THE NORTHERLY RIGHT OF WAY LINE OF SAID RICHBOURG LANE; PROCEED NORTH 90 DEGREES 00'00" WEST, ALONG SOUTH LINE OF SAID SECTION 4, A DISTANCE OF 7.50 FEET TO THE POINT OF BEGINNING OF THE PARCEL HEREIN DESCRIBED. LESS AND EXCEPT THE FOLLOWING: PARCEL AS DEEDED TO JOHN R. MAHONE, JR. AND JUDITH B. MAHONE, HUSBAND AND WIFE, IN O.R. BOOK 2084, PAGE 2147, RECORDS OF OKALOOSA COUNTY, FLORIDA. BOOK 2518, PAGE 568; RECORDS OF OKALOOSA COUNTY, FLORIDA. SECTION 3 — MAP UPDATE. The Crestview Zoning Map, current edition, is hereby amended to reflect the above changes concurrent with passage of this ordinance, which is attached hereto. SECTION 4 — SEVERABILITY. If any word, phrase, sentence, paragraph or provision of this ordinance or the application thereof to any person or circumstance is held invalid or unconstitutional, such finding shall not affect the other provisions or applications of this ordinance which can be given effect without the invalid or unconstitutional provision or application, and to this end the provisions of this ordinance are declared severable. SECTION 5 — SCRIVENER'S ERRORS. The correction of typographical errors which do not affect the Page 89 of 297 intent of this Ordinance may be authorized by the City Manager or the City Manager's designee, without public hearing, by filing a corrected or re -codified copy with the City Clerk. SECTION -b — ORDINANCE TO BE LIBERALLY CONSTRUED. This Ordinance shall be liberally construed in order to effectively carry out the purposes hereof which are deemed not to adversely affect public health, safety, or welfare. SECTION 7 — REPEAL OF CONFLICTING CODES, ORDINANCES, AND RESOLUTIONS. All Charter provisions, codes, ordinances and resolutions or parts of charter provisions, codes, ordinances and resolutions or portions thereof of the City of Crestview, in conflict with the .provisions of this Ordinance are hereby repealed to the extent of such conflict. SECTION 8 — EFFECTIVE DATE. The effective date of this Ordinance shall be the date Comprehensive Plan Amendment is adopted by Ordinance # 1803 and becomes legally effective.
