HomeMy Public PortalAbout06-06-1985 WI BOARD OF PUBLIC MCMBES AND SAFETY OF ME CITY OF RICHMOND, INDIANA, JUNE 6, 1985 1 The Board of Public Works and Safety of the City of Richmond, Indiana met in 2 regular session, June 6, 1985 at the hour of 9:00 A.M. in the Municipal Building 3 in said City. Ms. Maness presided with Mr. Brown and Ms. Silberstein in 4 attendance. The following business was had to-wit: 5 6 9:00 A.M. BID OPENING FOR SLURRY SEAL 7 8 Purchaathg Director Rita Stout called for all bids to be received for the slurry 9 . seal of the streets in an area of Richmond from Richmond Avenue to U.S. 40 10 West from N.W. 8th Street to N.W. llth Street excluding Peacock Road. 11 12 Having received all bids, Ms. Silberstein moved to close the bidding, seconded 13 by Mr. Brown and on unanimous voice vote the motion was carried. 14 • 15 Mr. Barden examined the Proof of Publication and found it to be in order. 16 Ms. Silberstein moved to accept and file the Proof of Publication, seconded 17 by Mr. Brown and on unanimous voice vote the motion was carried. 18 19 The following bids were received: 20 21 Struasers Slurry Seal. The bid was in proper order, signed and notarized 22 and accompanied by a bid bond in 10% of the total bid price. Bid was 23 for $51,108.44. 24 25 Contractors United, Inc. Bid was in proper order, signed and notarized • 26 and accompanied by a bid bond in 10% of the total bid price. Bid was 27 for $95,248.35. 28 • III29 Benedict Slurry Seal, Inc. Bid was in proper form, signed and notarized 30 and accompanied by a bid bond in 10% of the total bid price. Bid was 31 for $58,142.81. 32 33 Ms. Silberstein moved to refer the bids to the Purchasing Director and Public 34 Works Director for evaluation and recommendation, seconded by Mr. Brawn and 35 on unanimous voice vote the motion was carried. 36 37 CONTINUATION OF AN UNSAFE BUILDING BEARING ON PROPERTY LOCATED AT 410 NORTH 16th 38 39 The unsafe building hearing on property located at 410 North 16th Street was 40 re-opened by the Board of Public Works and Safety. 41 42 The Clerk administered the Oath to give testimony to Mr. Dan Dooley, 43 Supervisor of the Planning Department. Mr. Dooley told the Board that he had 44 contacted Mr. Odis Lady and informed him of the continuation of the hearing. 45 Mr. Lady had expressed a desire to Mr. Dooley to begin work on this property 46 to bring it up to code. Mr. Dooley stated it was the philosophy of the Planning 47 Depa.luent to work with property owners to allow them to assume their 48 responsibilities with properties in question. Mr. Lady has been unable to 49 assume this responsibility. Mr. Dooley recommended to the 'Board that they 50 affirm the Unsafe Building Order allowing Mr. Lady fourteen (14) to fifteen 51 (15) days to begin work and to monitor the situation and if this is not done 52 to have the structure removed. III 53 . 54 Ms. Maness asked if any permits have been issued and Mr. Dooley stated they 55 have not. 56 . 57 Mr. Dooley stated that Mr. Lady is on a limited income, but that he indicated 58 he would like to bring the structure to code. 59 60 Also speaking in support of the Order issued was Mr. Ted Rice of 406 North 61 16th Street. 62 63 The Clerk administered the Oath to Mr. Rice to give testimony and Mr. Rice 64. told the Board that the City has cut the weeds on this property the last two 65 (2) years and that the structure has remained opened the past two (2) years. • Board of Works Minutes Cont'd June 6, 1985 Page 2 1 Mr. Rice also stated that he felt if Mr. Lady was going to renovate the structure 2 he would have started before now. 3 4 Ms. Silberstein asked how long the structure had been vacant and Mr. Rice stated 11/ 5 that it has been vacant over a year and at that time a family tried to occupy 6 the dwelling and was unable to do so. Mr. Rice said the dwelling was vacant 7 a year prior to the family attempting to reside there. 8 9 In response to Mr. Silberstein, Mr. Dooley told the Board that the only indications 10 he had from Mr. Lady that he would accomplish the work were verbal. 11 12 Ms. Silberstein asked if Mr. Lady would be able to do the repair on the plumbing 13 and electrical systems and Mr. Dooley said that since he was not living in 14 the dwelling he would not be permitted to do these repairs. 15 16 Mr. Brown asked if the Order should also include the immediate securing of 17 the premises and Mr. Dooley stated that since Mr. Lady is not present at the 18 hearing another Order would have to be issued from his office regarding the 19 securing of the premises. 20 21 There being no testimony received to show why the Order should not be complied 22 with, Ms. Silberstein moved to affirm the Order as issued, seconded by Mr. 23 Brown and on unanimous voice vote the motion was carried. 24 25 The order was issued on May 14, 1985 with the date of the second publication 26 and will expire thirty days later. 27 28 The Board also requested Mr. Dooley to issue an Order to have the dwelling 29 secured immediately. 30 31 APPROVAL OF MINUTES OF MAY 30, 1985 32 33 Ms. Silberstein moved to approve the minutes of the previous meeting as prepared, 34 seconded by Mr. Brown and on unanimous voice vote the motion was carried. 35 36 APPROVAL OF CLAIMS FOR PAYMENT 37 38 Mr. Brown moved to approve claims for payment in the amount of $254,138.60, 39 seconded by Ms. Silberstein and on unanimous voice vote the motion was carried. 40 41 TABLED ITEMS 42 43 Use of S.W. Corner of Municipal Building Lot for Helicopter Rides 44 45 Mr. Barden informed the Board that he had spoken with Mr. Carrico and that 46 they would be using the area requested on Friday, June 28, 1985 during the 47 evening hours only and not interfering with parking for persons working at 48 the County Building. 49 50 Mr. Barden stated that the area will be secured by barricades and all insurance 51 has been previously filed. 52 53 Ms. Silberstein moved to approve the request of Roto-Whirl to use the S.W. 54 corner of the Municipal Building Parking lot on Friday, June 28 starting at 55 6:00 P.M., June 29th and June 30th for helicopter rides, seconded by Mr. Brown 56 and on unanimous voice vote the motion was carried. 57 58 DEPARTMENT REQUESTS AND C PS 59 60 Mayor's Office 61 62 Retirement of Fire Chief Larry H. Bosell 63 64 Mayor Frank H. Waltermann requested the Board of Public Works and Safety to 65 accept the request of Fire Chief Bosell to retire. The Mayor stated that U . • Board of Works Minutes Cont'd June 6, 1985 Page 3 1 the Board of Trustees of the Fireman's Pension Fund placed Chief Bosell on 2 the pension rolls effective June 1, 1985 and asked the Board to concur with 3 that date in accepting the retirement. 4 5 Mayor Waltermann stated that Chief Bosell had faithfully served his community 6 for twenty-one (21) years in an efficient and effective manner. 7 8 Ms. Silberstein mvoed to accept the retirement of Fire Chief Larry H. Bosell 9 effective June 1, 1985, seconded by Mr. Brown and on unanimous voice vote the 10 motion was carried. 11 • 12 The Board extended their thanks to Chief Bosell for his service to the City 13 of Richmond. 14 15 Police Department 16 17 Revocation of Powers of Reserve Officer 18 19 Police Chief Nimitz presented the following request to the Board: 20 21 Board of Public Works and Safety 22 23 Dear Board Members: 24 25 Request that the police powers of James Branum, Richmond Police Reserve 26 Officer be revoked. 27 28 James Branum has resigned from the Police Reserves for personal reasons. III 29 30 Please make this resignation effective immediately. 31 32 /s/ Joseph A. Nimitz 33 Chief of Police 34 35 Ms. Silberstein moved to revoke the special police powers of Reserve Officer 36 James Branum, seconded by Mr. Brown and on unanimous voice vote the motion 37 was carried. 38 • 39 The Board expressed their thanks to Mr. Branum for his many hours of service 40 to the community. 41 42 Stop Signs Approved for S.W. 18th and G Streets 43 44 Traffic Captain Dan Wogoman presented the following request to the Board: 45 46 Board of Public Works and Safety 47 48 RE: Replacing Yield Signs with Stop Signs 49 50 We have had several complaints of the traffic not yielding at the intersection 51 of South West 18th and "G" Streets, which is now a Yield for East/West 52 traffic on "G" Street. With the opening of South West 18th, which is III53 a thru street into Hidden Valley SubDivision, there has been an increase 54 of traffic on South West 18th through this intersection. 55 56 Therefore, in the best interest of the motoring public and the residents 57 of this area, I request that the Yield signs be replaced with Stop signs 58 for East/West traffic on South West "G" Street. 59 • 60 /s/ Dan Wogaman, Captain 61 Department of Traffic Safety 62 63 CaptainpWogomanc exp .ained_:.that this waspreviously a T intersection'`,andrAS 64 now a thru intersection. 65 ( 30 Board of Works Minutes Cont'd June 6, 1985 Page V 1 Ms. Silberstein moved to approve the replacing of the Yield Signs at the inter- 2 section of S.W. 18th and "G" Streets with Stop Signs, seconded by Mr. Brown 3 and on unanimous voice vote the motion was carried. 4 111 5 Planning Depai huent 6 7 Release of Mortgage of Alice Mays 8 9 Mr. Barden explained that this is a Community Development Mortgage now satisfied 10 in full. 11 12 Ms. Silberstein moved to approve and execute a Release and Satisfaction of 13 Mortgage for Alice Mays, seconded by Mr. Brown and on unanimous voice vote 14 the motion was carried. 15 16 Law Depai liuent 17 18 600 and 700 Blocks of South 10th and 11th Streets 19 20 Mr. Barden presented the Board a summary sheet of Police Calls in an area 21 including the 600 and 700 blocks of South 10th and llth Streets. He stated 22 that it appears the Police respond when called, but they are unable many times 23 to get a specific address or identifiable person or family appearing to be 24 responsible for the noise, litter and loitering complaints in the area. Mr. 25 Barden said the disturbances are usually gone when the Police arrive and 26 neighbors complaining are reluctant to leave names or testify. Mr. Barden 27 informed the Board that one sollution could possibly be to utilize the Neighborhood 28 Associations being established through the Mayor's Office to assist areas like 29 this. 30 31 Chief Nimitz told the Board that this is not uncommon from other areas of the 32 City and is a problem of traditional lifestyle versus comtenporary lifestyle. 33 The Chief stated that the Police respond when called and are also checking 34 on their own. The Police are making arrests when possible, but many of the 35 neighbors refuse to assist the Police DepaLUtent. 36 37 Ms. Silberstein stated that she would be very distressed to see the rest of 38 sthe City having as much of a problem as this area since it looks substantial 39 on paper. Ms. Silberstein said she was very disturbed with the late hours involved 40 in sane of the complaints and possibly if citizens were assured persons 41 causing the disturbances would be brought to justice they might be more ready 42 to testify. 43 44 Chief Nimitz stated that these types of calls persist throughout the City. 45 46 Ms. Silberstein stated that the public is trying to send a message by complaining 47 and that there were many different persons complaining. She also said that 48 persons should not have to be harassed in their own homes. 49 50 Councilmenber Lynn Morris told the Board that the neighbors in that particular 51 area are convinced that the Foot Patrol had helped to solve a problem. She 52 encourage restoration of the Foot Patrol and more vigorous enforcement of the 53 curfew law. 54 55 Mr. Dennis Bronston stated that he had first brought the problem to the attention 56 of the Board and the persons bringing the complaint to him felt some of the 57 problems had been alleviated and they thanked the City for their efforts. 58 59 The Board thanked Mr. Barden and the Police Depailluent for their information 60 on this problem. 61 62 Policy Statement on Alarm Ordinance 63 64 Mr. Barden presented the following Policy Statement to the Board: 65 1st Board of Works Minutes Cont'd June 6, 1985 Page 5 1 Any complaints, suggestions, criticisms, recommendations, comments, 2 or inquiries with regard to the proposed'Alarm Ordinance (Ordinance No. 3 47-1985) will be received by the City Attorney, at his office at 50 North 4 5th Street, Richmond, Indiana 47347, for compilation and referral to the 5 Common Council for consideration, if in writing and signed by the person 6 with that person's name and address. No telephone calls or personal visits 7 regarding this ordinance will be accepted or compiled into the recommendations 8 made to Council. 9 10 Public Works 11 12 Bid Opening Date Set for Resurfacing of South N Street 13 14 Mr. Willis requested the Board to set a date for the hot asphalt resurfacing 15 of South N Street from South 6th Street to U.S. 27 South. He stated that this 16 request was being presented from a request of Kemper Cabinets with possible 17 future expansion under consideration. 18 19 Ms. Silberstein moved to set June 27, 1985 at 9:00 A:M: as the date and time 20 to receive bids for the hot asphalt resurfacing of South N Street fran South 21 6th Street to U.S. 27 South, seconded by Mr. Brown and on unanimous voice vote 22 the motion was carried. 23 24 Relinquishment of Right of Way to City - West Main Street 25 26 Mr. Willis presented the papers from the State of Indiana regarding the City 27 accepting control of West Main Street from 1st Street to N.W. 5th Street to - 28 National Road West. This area has been resurfaced per specifications set out 111 29 by the City prior before final acceptance. 30 31 The Board will take this under advisement for inspection by Mr. Willis. 32 33 Board of Works 34 35 Set date for Public Hearing for sale of Property near South Q and 9th Streets 36 37 Ms. Silberstein moved to Set June 20, 1985 at 9:00 A.M. as the date and time 38 to conduct a Public Hearing reagarding the possible sale of real estate owned 39 by the City of Richmond, Indiana located near South 9th and Q Streets, seconded 40 by Mr. Brown and on unanimous voice vote the motion was carried. 41 42 Building Division of Planning DepaLlluent 43 44 Weed Control Program 45 46 Mt. Bronston presented the Board a summary of action taken by the City in 1984 47 regarding weed control. He stated that 160 registered letters had been sent 48 in 1984 and that this does not represent all complaints received since some 49 are handled by telephone. Mr. Bronston also informed the Board that 65 properties 50 had been mowed. 51 52 Mr. Bronston stated that the Department has extra staff this summer and will III53 have a very active weed control program. He asked the public to assume their 54 responsibility to assist the City with weed control. 55 56 PUBLIC RFQOESTS AND COMMENTS 57 58 Temporary Closing of S.W. 4th Street for Block Party 59 60 The Board received the requests of Richard Shoemaker for the temporary closing 61 of S.W. 4th Street on June 21, 1985 from 5:00 P.M. to 10:00 P.M. for a 62 neighborhood block party. The street would be blocked from C to D Street. 63 64 Ms. Silberstein moved to approve the request to temporarily close S.W. 4th 65 Street from C to D Street on June 21, 1985 from 5:00 P.M. to 10:00 P.M., • Board of Works Minutes Cont'd June 6, 1985 Page 6 1 seconded by Mr. Brawn and on unanimous voice vote the motion was carried. 2 3 MISCELLANEOUS MATTERS 4 5 Ms. Maness informed the Board and public that the unsafe structures at 16th 6 and East Main Streets had been demolished and leveled off per order of 7 the Board of Public Works and Safety. 8 9 Councilmenber Lynn Morris asked the Board to investigate the complaints of 10 drag racing on South 9th Street from South E to South L Street particularly 11 during the hours of 9:30 P.M. to 10:00 P.M. She stated that this is happening 12 with sane consistency. 13 14 Councilmember Morris also informed the Board that the removal of the structures 15 at 16th and East Main Street had exposed another possible unsafe structure. 16 Mr. Bronston has started investigation of this situation. 17 18 ADJOURNMENT 19 20 There being no further business on a motion duly made, seconded and passed 21 the meeting was adjourned. 22 23 24 Cathy A.
