'S BOARD OF PUBLIC MORES AND SAFETY OF THE CITY OF RICHMOND, INDIANA, MAY 30, 1985 1 The Board of Public Works and Safety of the City of Richmond, Indiana met in 2 regular session May 30, 1985 at 9:00 A.M. in the Municipal Building in said City. 3 Mr. Brown presided with Ms. Silberstein in attendance. Ms. Maness was absent. III4 The following business was had to-wit: 5 6 9:00 A.M. UNSAFE BUILDING HEARING ON PROPERTY LOCATED AT 410 NORTH 16TH STREET 7 8 ORDER Issued Pursuant to 9 Chapter 98 of the Code of 10 Ordinances of the City of 11 Richmond, Indiana 12 13 14 Date: May 7, 1985 15 16 1. Order issued to: Odis and Mary Mildred Lady 17 2. (a) Address of the unsafe premises: 410 North 16th Street 18 (b) Legal Description of the unsafe premises: Pt. Lot 634 Elizabeth Starr 19 3. The building(s) or structure(s) or part(s) thereof, located on the real estate 20 described above, as a result of the inspection and investigation by the Planning 21 and Economic Development DepaiLatent, Building Division, has been found to 22 be in an impaired structural condition or state which renders it unsafe or 23 dangerous to persons and property. Said findings are according to minimum 24 standards established and set forth in Chapter 98 of the City of Richmond 25 Code of Ordinances. 26 Therefore, it is hereby ordered that the following action be accomplished 27 in regard to this property: 28 III29 Removal of the building (dwelling) , or to cause repairs to be made to bring 30 the building up to the minimum standard of the Building and-Rouging- Code 31 of the city of Rlhcmond, Indiana. 32 33 4. The action required above shall be accomplished within thirty (30) days of 34 the receipt of this Order. 35 . 5. A hearing regarding this order will be conducted by the Richmond Board of 36 Public Works and Safety in the BOard of WOrks Roan at the Municipal Building, 37 50 North 5th Street, Richmond, Indiana,a May 30, 1985 at 9:00 A.M. 38 You may appear at the above said hearing to show cause why this order should 39 not be complied with; you may be represented by an attorney, present evidence, 40 call witnesses and make arguments at the hearing. If you fail to appear, 41 the hearing will be held in your absence. 42 6. If the Order is not complied with within the time specified above, the Building 43 Division of the Planning and Economic Development DepaLUaent will cause said 44 action to be taken. The cost incurred by the Depailinent in processing the 45 matter and performing the work may, if not paid, be recorded after a hearing 46 as a lien against all persons having a fee interest or life estate interest 47 in the unsafe premises. A person who uses a building in violation of this 48 Order or interferes with or delays the carrying out of this Order commits 49 a Class D infraction. Each day that the violation continues constitutes 50 a separate offense. 51 7. You have an obligation according to Section 12 of Chapter 98 of the City 52 of Richmond Code of Ordinances to supply full information regarding this III53 order to any person who may take or agree to take a substantial property 54 interest in the unsafe premises, prioer to such transfer or agreement to 55 transfer; also, to supply to the Building Division of the Planning and 56 Eocnanic Development Department within five (5) calendar days of the transfer 57 or agreement to transfer, (a) the full name, address and telephone number 58 of the person acquiring substantial property interest and (b) a true and 59 accurate copy of the legal instrument under which the tranfer or agreement 60 is accomplished. 61 8. Dooley I4 Board of Works Minutes Cont'd May 30, 1985 Page 2 1 Mr. Brown requested proper'proof that the owner of record had been properly notified. 2 3 Mr. Dooley stated that they were unable to reach the owner of record by certified 4 mail and had published the Order twice in the Palladium-Item. May 14, 1985 was 5 the last date of publication and the Order would start on that date. 111 6 7 Ms. Silberstein moved to accept and file the Proof of Publication on the Order 8 on unsafe premises at 410 North 16th Street, seconded by Mr. Brown and on unanimous 9 voice vote the motion was carried. 10 11 The Clerk administered the Oath to give testimony to Mr. Dooley. Mr. Dooley 12 informed the Board that numerous complaints had been received by his office regarding 13 the property at 410 North 16th Street. He said that in 1984 the weed control 14 ordinance had been enforced at this property and the same complaints were 15 being received in 1985. Mr. Dooley said that in March of 1985 a letter was sent 16 to the owner of record asking them to take action to repair or removed the unsafe 17 structure. The structure has broken windows, rear door off, electrical system 18 out of date and shut off, no heating plant exists in the dwelling, the plumbing 19 is not functional, the interior is covered with rubbish, the outside has weeds 20 out of control and there is a delapidated shed at the rear of the property. 21 22 Mr. Dooley stated that after a title search the Order to remove or bring to code 23 was issued on May 7, 1985 and since it could not be served the order was published. 24 • 25 Supporting letters from the Fire Department and Martel Winburn, Public Health 26 Sanitarian, accompanied Mr. Dooley's testimony. 27 28 Ms. Silberstein asked Mr. Dooley why the order was published and Mr. Dooley explained 29 that the order was not signed for by Mr.. Lady, owner of record. 30 31 In response to Mr. Brown, Mr. Dooley verified that the property is not secured 32 and there are signs of persons having entered the property. The Planning and 33 Economic Development Department had since learned that Mr. Lady is residing at 34 801 North H Steet and a copy of the order was left at this address. Mr. Dooley 35 recommended to the Board that they receive evidence and continue the hearing 36 to June 6, 1985 to give them time to contact Mr. Lady. 37 38 Ms. Silberstein asked if the structure was sound and Mr. Dooley stated that it 39 could be sound with some major renovation. 40 41 Also speaking in support of the Order against the unsafe premises was Dennis 42 Rice. The Clerk administered the Oath to give testimony to Mr. Rice. Mr. 43 Rice told the Board that he was representing his parents who reside next door 44 to the unsafe premises. He presented the Board a very large weed removed from 45 the premises and pictures of the premises to show the condition of the property. 46 Mr. Rice stated that neighbors have seen youngsters in and out of the structure 47 and that his Father is concerned about the dwelling being unsafe and unsightly. 48 Mr. Rice also informed the Board that Mary Mildred Lady is deceased and she is 49 listed as one of the owners of record. 50 51 There being no one presenting evidence against the Order and no further discussion 52 offered, Ms. Silberstein moved continue the hearing to 9:00 A.M. June 6, 1985, 53 seconded by Mr. Brown and on unanimous voice vote the motion was carried. 54 55 APPROVAL OF MINUTES OF MAY 23, 1985 56 57 Ms. Silberstein moved to approve the minutes of the previous meeting as prepared, 58 seconded by Mr. Brown and on unanimous voice vote the motion was carried. 59. 60 APPROVAL OF CLAIMS FOR PAYMENT 61 62 Ms. Silberstein moved to approve claims in the amount of 15,822.41, seconded 63 by Mr. Brown and on unanimous voice vote the motion was carried. 64 . 65 l0• .S Board of Works Minutes Cont'd May 30,, 1985 • Page 3 • 1 DEPARTMENT REJESTS AND COMMENTS 2 3 Public Works III4 5 Street Sweeping Contract 6 . 7 The contract between the City of Richmond and McCoy's Sweeping Service was presented 8 to the Board for action. .Mr. Bill Hillard, Street Commissioner, told the Board 9 that the newest street sweeper owned by the Street Depailluent was one purchased 10 last year that was nine (9) years old. They feel they can save dollars by contracting 11 the sweeping in the downtown area. They have had a test run for thirty (30) 12 days and they would like to see it continue until such time as the depaLlunent 13 can afford new sweepers in order to cut down on the costs of repairs. • 14 15 Ms. Silberstein asked about the deletion of North llth and 12th Streets from the 16 contract and if this affected the total number of miles to be serviced. Mr. . 17 Hillard stated that other areas have been added to make the mileage the same. 18 19 Ms. Silberstein noted that (b) of Section 1. needed to be changed to read South 20 3rd to South 18th. Street. 21 22 Ms. Silberstein moved to approve and execute the contract between the City of 23 Richmond and McCoy'.s Sweeping Service to sweep and clean both curbs in the 24 designated area per the specified rate, seconded by Mr. Brown and on unanimous 25 voice vote the motion was carried. 26 , 27 PUBLIC REQEUSTS AND COMMENTS III 28 29 Residential Handicapped Parking Request - 203 North 19th 30 31 The request of Carrie Jackson for a residential handicapped parking request at 32 203 North 19th Street was presented. Ms. Jackson has Handicapped Permit No. 9115. 33 Captain Wogcman stated there was no problem with thetraffic division:and there 34 is no off street parking available. 35 36 Ms. Silberstein moved to approve the residential handicapped parking request 37 at 203 North 19th Street, seconded by Mr. Brown and on unanimous voice vote 38 the motion was carried. 39 40 41 Request to Use S.W. corner of Municipal Lot for Helicopter Rides 42 43 Roto Whirl, Inc. presented a request to .the Board to use the S.W. corner of the 44 Municipal Building Parking Lot for Helicopter rides on June 28, 29 'and 30, 1985. 45 ' 46 Ms. Silberstein stated• that the 28th was a Friday and the lot would be used by 47 persons working in the County Courthouse. 48 49 Ms. Silberstein moved to table the request of Roto-Whirl, Inc. for use of the 50 S.W. corner of the Municipal Building Parking Lot until June 6, 1985 for further 51 information, seconded by Mr. Brown and on unanimous voice vote''the motion was 52 carried.
