BOARD OF PUBLIC WARMS AND SAFETY OF THE
CITY OF RICHMOND, INDIANA, MARCH 14, 1985
1 The Board of Public Works and Safety of the City of Richmond, Indiana, met in
2 regular session March 14, 1985 at the hour of 9:RO A.M. in the Municipal Building
3 in-said City. ';Ms. ManesS presided with Mr. Brown and Ms'. Silberstein in
4 attendance. The following business was had to-wit:

16 1. Order issued to: Nick and Betty Porfidio, 1516 Middleboro Pike, Richmond,
17 Indiana 47374
18 2. (a) Address of the unsafe premises: 605 South 8th Street, Richmond, Indiana
19 (b) Legal Description of the unsafe premises: Lot #87 Schwegman Addition
20 3. The building(s) or structure(s) or part(s) thereof, located on the real
21 estate described above, as a result of inspection and investigation by the
22 Planning and Economic Development Department, Building Division, has been
23 found to be in an impaired structural condition or state which renders it
24 unsafe or dangerous to persons and property. Said findings are according
25 to minimum standards established and set forth in Chapter 98 of the City
26 of Richmond Code of Ordinances.

28 Therefore, it is hereby ordered that the following action be accomplished
III29 in regard to this property:

31 1. Vacating of unsafe building (10 days)
32 2. Sealing of the unsafe building by the placement over all first floor
33 entrances, windows and door (within 10 days)
34 3. Repair of the unsafe building to meet minimum code standards as established
35 by the Building & Housing Codes of the City of Richmond (30 days)
36 4. The action required above shall be accomplished within 30 days of the date
37 of the receipt of this Order.
38 5. A hearing regarding this order will be conducted by the Richmond Board of
39 Public Works and Safety in the Board of Works Room at the Municipal Building,
40 50 North 5th Street, Richmond, Indiana, January 24, 1985. You may appear
41 at the above said hearing to show cause why this order should not be complied
42 with; you may be represented by an attorney, present evidence, call witnesses
43 and make arguments at the hearing. If you fail to appear, the hearing will
44 be held in your absence.
45 6. If the Order is not complied with within the time specified above, the Building
46 Division of the Planning and Economic Development Department will cause said
47 action to be taken. The cost incurred by the Department in processing the
48 matter and performing the work may, if not paid, be recorded after a hearing
49 as a lien against all persons having a fee interest of life estate interest
50 in the unsafe premises. A person who uses a building in violation of this
51 Order or interferes with or delays the carrying out of this Order commits
52 a Class C infraction. Each day that the violation continues constitutes
III 53 a separate offense. •
54 7. You have an obligation according to Section 12 of Chapter 98 of the City
55 of Richmond Code of Ordinances to supply full information regarding this
56 order to any person who may take or agree to take a substantial property
57 interest in the unsafe premises, prior to such transfer or agreement to
58 transfer; also, to supply to the Building Division of the Planning and
59 Economic Development Deparatment within five (5) calendar days of the transfer
60 or agrement to transfer, (a) the full name, address and telephone number
61 of the person acquiring substantial property interest, and (b) a true and
62 accurate copy of the legal instrument under which the tranfer or agreement
63 to transfer is accomplished.

8 Mr. Barden determined that the owner of record had been properly notified of
9 the hearing on the above Order and the continuation of hearing by Certified
10 Mail with the signed receipts returned.

12 Ms. Silberstein moved to accept the Proof of Notification, seconded by Mr.
13 Brown and on unanimous voice vote the motion was carried.

15 The Clerk administered the Oath to give testimony to Mr. Dennis Bronston of the
16 Planning DepaiLuient.

18 Mr. Bronston told.the Board that he had boson requested to look into the premises
19 at 605 South 8th Street by a member of the Common Council and had made an
20 inspection on December 11, 1984. At this time he found the premises unsecured
21 and accessible, electrical, heating and plumbing not to code, trash and debris
22 inside the premises, the roof damaged and deteriorated and trash outside the
23 premises. Mr. Bronston then issued the above Order to Nick and Betty Porfidio,
24 owner of record. The first two (2) sections of the order including the vacating
25 of the premises and the securing of the premises have been accomplished, but
26 as of March 13, 1985 nothing has been accomplished to bring the premises to code.
27 Also the debris around the exterior of the premises is still there.

29 Councilmember Lynn Morris requested Mr. Bronston to check an existing chimney
30 for loose bricks which was a concern of neighboring residents.

32 The Clerk administered the oath to give testimony to Mr. Nick Porfidio of 1516
33 Middleboro Pike, owner of record. Mr. Porfidio told the Board that he has not
34 been able to make repairs to this property due to the weather and his business.
35 Mr. Porfidio stated that he will either remodel this property or tear it down.
36 Mr. Pordifio said that when he realized the tenants had finally moved out he
37 did secure the building. He indicated that he had had trouble getting the
38 tenants to move from the premises. Mr. Porfidio asked the Board for thirty (30)
39 days to get into the property and make a determination to either remodel the
40 building or tear it down.

42 In response to Ms. Silberstein, Mr. Porfidio stated that he had owned the property
43 approximately one (1) year.

45 Mr. Brown commented that he felt the weather should have been no hardship on
46 cleaning up the debris around the premises.

48 Ms. Silberstein stated that the Board had given Mr. Porfidio a thirty (30) days
49 extension in February to allow him to determine if it was feasible to remodel
50 the property.

52 Ms. Silberstein moved to affirm the Order issued pursuant to Chapter 98 of the
53 Code of Ordinances on the unsafe premises located at 605 South 8th and to modify
54 the order by deleting Sections 1 and 2 and cause Section 3 to read that the
55 obtaining of permits to cause the unsafe building to be demolished or repaired
56 and the initiation of repairs to be accomplished within thirty (30) days from
57 today and within ten (10) days from today all debris to be removed from the
58 exterior of the premises and the chimney checked to determine if unsafe and
59 repaired, seconded by Mr. Brown and on unanimous voice vote the motion was
60 carried.

64 Ms. Silberstein moved to approve the minutes of the previous meeting as prepared,
65 seconded by Mr. Brown and on unanimous voice vote the motion was carried.

3 Mr. Brown moved to approve claims in the amount of 179,978.32 for payment,

10 Curb Cut Request at 813 Richmond Avenue

12 Mr. Bronston presented a residential curb cut request for Bobbie Brannock at
13 813 Richmond Avenue for the addition of a garage to the property. The request
14 has been approved by Captain Wogoman of the Traffic Division, Dan Dooley of the
15 Planning Deparl.ment and Ralph Willis, City Engineer.

17 Ms. Silberstein moved to approve the curb cut request for .Bobbie Brannock at
18 813 Richmond Avenue, seconded by Mr. Brown and on unanimous voice vote the motion
19 was carried.

21 Fire Department

23 Fire Chief Bosell presented a slide presentation to the Board consisting of the
24 slides produced by the National Fire Protection Association showing Richmond
25 Firefighters in action. The slides will be used as a part of a training program.

27 Chief Bosell also told the Board that the remodeling at Firehouse No. 6 is almost
28 complete.

•q2 Telecommunications Council Meeting

34 Ms. Maness stated that the Telecommunications Council had set their regular
35 meeting night for the first Tuesday of each month at 7:30 P.M. in the Board of
36 Works Room. They have also scheduled a study session for March 19, 1985 with
37 the agenda to include presentations by the Board of Works and Clearview Cable
38 and an explanation of recent cable legislation by the City Attorney.

40 PUBLIC REQUESTS AND COMMENTS

42 South Fourth Street Fair

4.4 Gertrude Ward, P.O. Box 14, Centerville, Indiana, requested permission fran the
45 Board to close South 4th Street from B Street to E Street on October 5th and
46 6th from 10:00 A.M. to 5:00 P.M. for the Annual South Fourth Street Arts and
47 Crafts Fair. The rain date request would be October 12th and 13th, 1985.
48 There will be a tour of hones on October 4, 1985 fran 8:00 P.M. to 11:00 P.M.
49 Ms. Ward stated that they carry liability insurance and inform all residents .
50 of the event and invite them to participate. The Fair will also include Horse
51 drawn vehicle rides.

53 Ms. Maness stated that the proof Of insurance with the City named as co-insured
54 must be on file in the Office of the City Clerk thirty (30) days prior to the
55 event.

57 Captain Woganan told the Board that his department has no problems with the Fair
58 and they are working to assist the Tourism Bureau with parking for buses.

60 Ms. Silberstein moved to approve the closing of South Fourth Street from B to
61 E on October 5th and '6th with a rain date set for October 12th and 13th and to
62 also approve the route as specified for the horse drawn vehicles subject to the
63 filing of the proof of insurance, seconded by Mr. Brown and on unanimous voice
64 vote the motion was carried.

1 Residential Handicapped Parking Request for 132 South 9th Street Approved

3 The request of Lucretia D. Long, Attorney in Fact for Mrs. Edith L. Long, for
4 a residential handicapped parking designation at 132 South 9th Street was
5 presented to the Board. The designation would be used for Edith Long and they
6 have the proper handicapped parking permit.

8 Captain Wogoman stated he had looked at the situation and there was no problem
9 with this request.

11 Ms. Silberstein moved to approve the residential handicapped parking designation
12 for 132 South 9th Street, seconded by Mr. Brown and on unanimous voice vote the
13 motion was carried.

15 Richmond Power & Light

17 Mr. Robert Hankosky reported that the conversion of street lights from mercury
18 to sodium had been completed North A to South A from 1st Street to 12th Street.

20 Congratulations and Best Wishes to the Richmond Red Devil Basketball Team
21
22 Mr. Brown offered the congratulations of the Board to the Richmond Basketball
23 Team and the Coach on their victories in the sectional and regional tournaments
24 and espressed their best wishes to the team for continued success at the Semi-
25 State tournament.
