BOARD OF PUBLIC WORKS AND SAFETY OF THE
CITY OF RICHMOND, INDIANA JANUARY 31, 1985
1 The Board of Public Works and Safety of the City of Richmond, Indiana, met in
2 regular session, January 31, 1985 at the hour of 9:00 A.M. in the Municipal
3 Building in said City. Ms . Maness presided with Mr. Brown and Ms. Silberstein
III 4 in attendance. The following business was had to-wit:

6 APPROVAL OF MINUTES OF JANUARY 24, 1985

8 Ms. Silberstein moved to approve the minutes of the previous meeting as prepared,
9 seconded by Mr. Brown and on unaimous voice vote the motion was carried.

11 APPROVAL OF CLAIMS FOR PAYMENT

13 Mr. Brown moved to approve claims in the amount of 97,404.39 for payment, seconded
14 by Ms. Silberstein and on unanimous voice vote the motion was carried.

20 Awarding of Cold Bituminous Materials Bid for 1985
21
22 Since there was only one (1) bid received for the cold bitunimous materials,
23 Ms. Silberstein asked Rita Stout is the bid was comparable to the 1984 prices.
24 Ms. Stout informed the Board that the bid was comparable and was lower that
25 the bid originally received for 1985.

27 Ms. Silberstein moved to award the bid for cold bituminous coated aggregate
III28 F.O.B. plant to Stone Valley Paving Company at 24.90/ton effective date January
29 31, 1985 through December 31, 1985, seconded by Mr. Brown and on unanimous voice
30 vote the motion was carried.

34 Chief Nimitz read the following letters to the Board:

38 Request that the police powers of John Miller, Richmond Police Reserve
39 Officer be revoked.

41 John Miller has resigned form the Police Reserves for personal reasons.

3 Mr. Barden told the Board that his Office has been receiving many inquiries
4 about telephone solicitations. The City cannot vouce for any companies doing
5 phone solicitations, but the Attorney General's Office maintains a Hotline

6 for complaints on telephone solicitation and they can verify the validity of
7 these companies. The Hotline number is 1-800-382-5516.

9 MISCELLANEOUS BUSINESS

11 Special Meeting of Board of Works regarding Cable TV Rate Increase
12
13 Ms. Maness reminded the public and press that the Board of Works would be holding
14 a public meeting January 31, 1985 at 7:00 P.M. in the Council Chambers for the
15 purpose of informal discussion on the Clearview Cable proposed rate increase.

17 PUBLIC REQUESTS AND COMMENTS

19 Approval of Rose Festival Activities for 1985
20
21 Mr. Loren Vance, Executive Director of the Richmond Area Rose Festival, presented
22 the following requests for Rose Festival events for 1985:
23
24 Richmond Area Rose Festival Firemen's Waterball Competition - Request
25 permission to use 4th Street between East Main and South A Street on
26 Saturday, July 6, 1985 from 11:00 A.M. to 5:00 P.M.
27
28 Rose Festival Parade Route - From 22nd and Main Streets, west on Main Street
29 to North 16th and Main, North on 16th to A Strteetand west on A Street
30 to North 10th Street. The parade will be June 30, 1985 beginning at
31 2:00 P.M.

33 Parade Route Signs - Flags - Request permission to mount Rose Festival
34 parade signs on Richmond Power & Light poles for the month of June thru
35 mid July, 1985. Signs would be mounted on the parade route and on two
36 poles at 8th and Promenade and 9th and Promenade.

38 Closing of 6th Street - Request to close 6th Street from the South side
39 of the Service Drive at the rear of the 600 Building on North 6th Street
40 to a point on South 6th Street beginning at the North side of the Second
41 National Bank Drive and extending across 6th Street at an angle to the
42 Northeast corner of the Service Drive south of Elder Beerman on South
43 6th Street. The closing would begin on July 1, 1985 and extend thru July
44 6, 1985 for the purpose of placing vendors.

46 Moonlight Rose Parade - Request to use same route as Rose Festival Parade
47 on July 6, 1985 starting at 8:30 P.M. .

49 Captain Wogoman asked if the parade signs would interfere with the Historic
50 District signs on several of the light poles and Mr. Vance stated that the Rose
51 Festival would not be using these particular poles .

53 The Board reminded Mr. Vance that Proof of Insurance with the City named as
54 co-insured must be filed with the City thirty (30) days prior to the beginning
55 of the events.

57 Ms. Silberstein moved to approve the requests for the events presented at the
58 scheduled times and places subject to the filing of Proof of Insurance with
59 the City as co-insured thirty (30) days prior, seconded by Mr. Brown and on
60 unanimous voice vote the motion was carried.

62 Ms. Maness requested that the Rose Festival provide the City with a list of
63 areas needing baracades in advance in order that all events can be accomodated.

3 ORDER Issued Pursuant to
4 Chapter 98 of the Code of
5 Ordinances of the City of
6 Richmond, Indiana

8 1. Order Issued to: Stephen & Penny May
9 RR#2, Centerville, Indiana 47330
10 2. Address of the unsafe premises: 121-123 North 14th Street, Richmond,
11 Indiana 47374
12 Legal Description of the unsafe, premises: 516B 517B E. Starr Addition.
13 3. The building or structure or part thereof, located on the real estate
14 described above, as a result of inspection and investigation by the
15 Planning and Economic Development Department, Building Division, has
16 been found to be in an impaired structural condition or state which
17 renders it unsafe or dangerous to persons and property. Said findings
18 are according to minimum standards established and set forth in Chapter
19 98 of the City of Richmond Code of Ordinances .

21 Therefore, it is hereby ordered that the following action be accomplished
22 in regard to this property:
23
24 1. Dwelling secured - plywood placed over all first floor entrances -
25 windows and doors (fourteen days after receipt of this letter)
26 2. Secure permits to bring dwelling units up to the minimum established
27 by the City of Richmond Housing & Building Codes.

29 4. The action required above shall be accomplished within sixty (60) days
30 of the date of receipt of this Order.
31 5. A hearing regarding this order will be conducted by the Richmond Board
32 of Public Works and Safety in the Board of Works Room at the Municipal
33 Building, 50 North 5th Street, Richmond, Indiana, 9:00 A.M. , November
34 1, 1984. You may appear at the above said hearing to show cause this
35 order should not be complied with; you may be represented by an attorney,
36 present evidence, call witnesses and make arguments at the hearing.
37 If you fail to appear, the hearing will be held in your absence.

39 6. If the Order is not complied with within the time specified above,
40 the Building Division of the Planning and Economic Development Department
41 will cause said action to be taken. The cost incurred by the Department
42 in processing the matter and performing the work may, if not paid,
43 be recorded after a hearing as a lien against all persons having a
44 fee interest or life estate interest in the unsafe premises . A person
45 who uses a building in violation of this Order or interferes with or
46 delays the carrying out of this Order commits a Class C infraction.
47 Each day that the violation continues constitutes a separate offense.

49 7. You have an obligation according to Section 12 of Chapter 98 of the
50 City of Richmond Code of Ordinances to supply full information regarding
51 this order to any person who may take or agree to take a substantial
52 property interest in the unsafe permises, prior to such transfer or
III53 agreement to transfer; also, to supply to the Building Division of
54 the Planning and Economic Development Department within five (5) calendar
55 days of the transfer or agreement to transfer, (a) the full name, address
56 and telephone number of the person acquiring substantial property interest,
57 and, (b) a true and accurate copy of the legal instrument under which
58 the transfer or agreement to transfer is accomplished.

60 8. If you have any questions regarding this Order, you may contact the
61 Building Division of the Planning and Economic Development Department
62 located in the Municipal Building, 50 North 5th Street, Richmond, Indiana

1 City Attorney Kenneth Barden made determination that Steven and Penny May had
2 received proper notice of the Order and the date of the Original hearing and
3 that the May's had also been properly notified of the date of the continuation
4 of the hearing.

6 The Clerk administered the oath to give testimony to Mr. Dennis Bronston. Mr.
7 Bronston told the Board that correspondence on this property had begun in April
8 of 1984 and that he had requested a continuation on the original hearing due
9 to a problem Mr. May was having on an insurance settlement on the property being
10 vandalised. Mr. Bronston stated that the property had been secured as ordered,
11 but as of yet no permits have been issued for repair to the property.

13 Mr. Bronston requested the Board to allow a seven (7) to fourteen (14) day time
14 period for Mr. and Mrs . May to submit copies of contracts for repairs on the
15 property or a schedule of repairs to be made.

17 Ms. Silberstein asked if contracts or repair schedules were not filed. on
18 time woul.d_ the Order stand and the City take action. Mr. Bronston stated those
19 were his intentions.

21 The Clerk administered the oath to present testimony to Fire Chief Larry Bosell.
22 Chief Bosell told the Board that Fire Prevention Bureau had declared the property
23 a fire hazard.

25 The Clerk administered the oath to give testimony to Mr. Steven May, 3590 Willow ,
26 Grove Road, owner of the property at 121-123 North 14th Street . Mr. May explained
27 to the Board about the problem with the insurance company covering the damages
28 to the property from the vandalism and that he was still trying to settle this
29 claim with the company. The property was vandalised in April of 1984 and the
30 repair estimates were 11,200.00. Mr. May stated that the insurance company
31 was holding up the claim on the basis that the property had not been rented
32 sixty (60) days prior to the vandalism. Mr. May said that he did have a renter
33 up until February of 1984 and was unable to locate the person to prove to the
34 insurance company that i was rented. He stated that he does have rent receipts .

36 Mr. Barden commented that Mr. May's attorney should file a Declaratory Action
37 in court against the insurance company and that if this legal action were taken
38 it would stay the Order on the property.

40 Ms. Silberstein stated that the Board has already given Mr. May a ninety (90)
41 day continuation and the Board hesitates to allow these unsafe conditions to
42 go on forever.

44 Ms. Silberstein moved to amend the original Order as issued on September 28,
45 1984 by deleting Section 1 since it has been accomplished and by Ordering that
46 within fourteen (14) days from this date plans are to be submitted for repairs
47 or copies of contracts for repairs be submitted as under Section 2 of the Order
48 or the submission of any legal document on the filing of a Declaratory Action
49 against the insurance company, seconded by Mr. Brown and on unanimous voice
50 vote the motion was carried.

52 Ms. Maness closed the Public Hearing on the Unsafe Building on 121-123 North
53 14th Street.

55 Report on 321 N.W. E Street
56 - - -57 Martel Winburn of the Wayne County Health Department told the Board that the
58 property at 321 N.W. E Street - Rhonda Lawrence - was ordered by the Court to
59 be returned to the deed owner and that the property has been cleaned up and
60 that he was dismissing the complaint filed by the Health Department on this
61 property. Mr. Bronston requested the Board to allow the nuisance filed by the
62 City to stand until he can inspect the premises for structural violations.
63 He will report to the Board on the condition of this property in two (2) weeks.
