The Planning Commission approved a determination of public convenience and necessity for Fuller Inc., located at 9615 Las Tunas Drive. A determination of public convenience and necessity is required by the State Department of Alcoholic Beverage Control to issue licenses that would entail "an undue concentration" (per state statute definition) of such licenses in a census tract that already had a pre -specified number of that type of license . The Planning Commission approved this item on a 4-0 vote . B. The Planning Commission approved a Tentative Parcel Map and Conditional Use Permit to allow the development of a residential condominium project with three (3) detached units on the property located at 5451 Sultana Avenue . The subject site is located in the medium density residential (R-2) zone per the City's General Plan. The Planning Commission approved this item on a 3-1 vote with Vice- Chairman Cordes abstaining. C . The Planning Commission approved a zone variance located at 6339 Oak Avenue to allow the construction of a 636 square foot second dwelling unit while maintaining the existing side yard setbacks of the existing residence and its detached garage. The subject site is located in the single-family residential (R -1) zone per the City's General Plan . The Planning Commission approved this item on a 4-0 vote. D. COMMUNICATIONS-None E. MA TIERS FROM CITY OFFICIALS-None F. ADJOURNMENT The Planning Commission meeting was adjourned at 9 :26 p.m . CONCLUSION : The City Council is requested to receive and file this report.
