I No. 16 -92 Date of Adoption �bY 5, 2016 AUTHORIZING A PROFESSIONAL ENGINEERING SERVICES CONTRACT WITH CME ASSOCIATES, RE: WATERFRONT MARINA WHEREAS, the Borough of Carteret is in need of specialized engineering services in connection with the Special Permitting for the Waterfront Marina, US Army Corp of Engineers and NJ Department of Environmental Protection; and WHEREAS, CME Associates, 1460 Route 9 South, Howell, New Jersey 07731, possesses the requisite experience and expertise to provide said services; and WHEREAS, CME Associates has submitted a proposal to provide said services at a total cost not to exceed $65,000.00; and WHEREAS, the Mayor and the Council have reviewed said proposal; and WHEREAS, the Chief Financial Officer has certified that fiends are or will be available for said purpose. NOW, THEREFORE, BE IT RESOLVED by the Mayor and the Council of the Borough of Carteret, County of Middlesex, State of New Jersey, as follows: 1. The proposal from CME Associates for engineering services related to the Special Pemdtting with regard to the Waterfront Marina, US Army Corp of Engineers and NJ Department of Environmental Protection at a total cost not to exceed $65,000.00 is hereby approved. 2. This action is approved as an award of a professional services contract pursuant to N.J.S.A 40A:11- 5(1)(a)in accordance with the Borough's Fair and Open Process as authorized by law. 3. This process has spanned approximately one year, where we have responded to these agencies requests for a significant amount of information, above and beyond the original anticipated scope of our work. Most of our effort has been focused on addressing comments made by the Harbor Safety Navigation and Operations Committee (Harbor Ops). In order to respond to their objections, we have attended numerous offsite meetings, coordinated with hired maritime professionals, and conducted our own assessments at the Carteret cove and Elizabeth marina to determine the validity of the Harbor Ops comments. During this period, we have also had to work on resolving the outstanding wetlands and mudfiat mitigation issue, which remains unresolved, Our proposal dated November 27, 2012, discussed the mitigation needs and associated costs associated with the work, but was never authorized by the Borough. Knowing that the Borough is going to appeal to the US ACOE decision to deny the permit application, if they do in fact to approve the project, they will have to know the specific details on mitigation. Construction on the marina cannot begin unless the mitigation construction has also begun. In light of this, and in anticipation of the need for additional coordination and plan amendments, we are requesting an additional authorization of $75,000.00 to cover our past work and expected additional services needed to get us through the anticipated approvalprocess.
