NOW, THEREFORE, BE IT RESOLVED by the Mayor and the Council of the Borough of Carteret, County of Middlesex, State of New Jersey, as follows: The proposal from T &M Associates for engineering services with regard to the Noe Street Area Drainage Improvements Construction Phase services at a total cost not to exceed $565,000.00 is hereby approved. 2. This action is approved as an award of a professional services contract pursuant to N.J.S.A 40A:11- 5(1)(a) in accordance with the Borough's Fair and Open Process as authorized by law. 3. A copy of this Resolution be forwarded to the Borough's Purchasing Department and T &M Associates. Adopted this 5" day of May, 2016 and certified as a true copy of the original on May 6, 2016. In support of our proposed scope and fee, please find attached an NJDEP engineering services agreement resolution along with our anticipated task and manhour schedule for our services for consideration by the governing body. As you are aware, the Noe Street Area Drainage project is a neighborhood drainage improvement project which includes the significant replacement and enlargement of a majority of the existing drainage system and the addition of new street inlets and drainage system piping in the Noe Street Area of the Borough. The project also includes the construction of a new l acre stormwater basin (wet pond); associated stormwater pumping station; and two story generator building all located along Noe Street near the intersection of Pershing Avenue. The project also includes a new storm water force main from the new pump station which, will run along Harris Street and Industrial Road and terminate in a new stormwater outfall at the Noe's Creek headwater at Industrial Road. The project is being funded primarily through the NJDEP NJEIT Funding Program with a low interest loan, 18% principal forgiveness (aka grant funds) which will be taken off the end of the loan and local funding. The estimated construction cost of the project is $7.55M a mstjority of which is eligible for funding under the WIT Program. The remainder of the project (ineligible items) will be locally funded. Per the attached task and manhour breakdown and in accordance with the attached NJDEP engineering oversight agreement requirements, T &M Associates will provide the following services during construction of the project: Scope of Services Based on the above scope of work, we will provide the following contract administration and inspection phase services for the project. The construction inspection effort will be accomplished in four phases — Bidding, Pre - Construction, Construction and Post Construction. A N" 1t CART -02211 Le: Mayor and Borough Council Borough of Carteret Re: Construction Phase Engineering Services Noe Street Area Drainage Improvements Bid Phase February 22, 2016 Page 2 T &M will advertise for bids, answer bidders questions receive and review beds and provide the Borough with a recommendation of award. We will also coordinate NJDEP concurrence of award. Pre - Construction Phase T &M will request the contractor prepare and submit its proposed baseline project schedule, Included in the project schedule will be the contractor's submittal schedule outlining the submission of shop drawings and submittal documents. Upon receipt of contract documents and prior to the start of any site activity, we will conduct a pre- construction meeting, All participants of the project team will be Invited to this kick-off meeting — Borough personnel involved in day -to -day operations that interface with the work; contractor; utility reps, as required, and our construction team. At this meeting, among other topics, there will be an exchange of requirements, needs and protocols necessary for the project. A police representative will be invited; and a procedure for notifying local residents will be determined. Construction Our construction team, under my overall guidance, consists of individuals each with a specific role and responsibility in carrying out the construction management plan. The Project Manager (PM) has day -to- day responsibility for contract administration, He and his inspection team will monitor performance with the baseline schedule and contracted costs. The team will perform the required inspection and conduct bi- weekly job meetings as necessary to discuss performance to -date, any design and contract issues and upcoming tasks and plans for their implementation. We will produce and distribute minutes of all meetings. Our staff will provide part-time construction coverage Monday through Friday. As necessitated by the contractor's work schedule, on -site inspection will be provided, as required, beyond an eight -hour workday and Saturdays. In the field, our staff will oversee the construction activity including performing and documenting inspections to determine if the work is done in general conformance with the contract plans and specifications. We will notify the contractor in writing of any unacceptable work or material, track the deficient condition and inspect the work until it is corrected. We will address surrounding property and general public concerns that may arise during the construction phase, We will work closely with the neighboring property owners to achieve timely and efficient completion of the work with minimal disruption and inconvenience to the residents, while maintaining a safe work zone. Monthly contractor payment requisitions will be processed by our office. Pay items will be checked for accuracy with field measurements taken during the month. CART -02211 Le: Mayor and Borough Council Borough of Carteret Re: Construction Phase Engineering Services Noe Street Area Drainage Lnprovements February 22, 2016 Page 3 In addition to the above services, T &M will provide the services of a Licensed Site Remediation Professional (LS RPj as required by the NJDEP as the project is by NJDEP definition a Linear Construction Project (LCP) The following services will be provide by our LSRP and his staff to support the construction management team during construction of the project. T &M will conduct the following activities as part of the LCP/LSRP requirements per NJAC 7:26, Subchapter 16 and supporting technical documents. • Submit the required LSRP Notification Document to NJDEP. o The Borough will need to provide the $450 notification fee with that submittal. • Review contractor submittals per the Linear Construction Guidance for • Materials Handling Plan to ensure all contaminated material encountered and not reused as part of the construction are managed and/or disposed in accordance with NJDEP and other regulatory guidance. • Contractor Health and Safety Plan • Attend kick off meetings and other contractor meetings as necessary • Provide oversight during construction for areas that have known contaminated material. T &M will ensure contractor handles all the material in accordance with the Materials Handling Plan. • Provide consultation to the Borough in regards to NJDEP regulations and guidance regarding contaminated material • Prepare the Final Repo for NJDEP, in accordance with regulatory requirements and submit the report within 180 days of completion of the project. o The Borough will need to provide the $1000 fee for the submittal, as required by NJDEP. Post - Construction During this phase, we will perform a final inspection of work with involvement from the Borough as desired, issue a punchlist to the contractor, as necessary, and expedite corrections. Particular attention will be given to the restoration of adjacent property. We will manage the contract closeout process, including preparation of as -built drawings, execution of any affidavits, release of liens, production of maintenance bond, warranties/guarantees, operations and maintenance manuals and other technical data, as required; and prepare paperwork and documentation needed for NJDEP and NJEIT approval and reimbursement. i� S CART -02211 February 22, 2016 Page 4 Le: Mayor and Borough Council Borough of Carteret Re: Construction Phase Engineering Services Noe Street Area Drainage Improvements Exclusions The following services are specifically excluded from this scope of services and fee proposal. 1. Section 4 — Additional Services in the attached N7DEP engineering agreement 2. All Engineering Services beyond the 18 month contract completion period 3. Architectural support services 4. Soil and/or groundwater sampling and testing for assessment and or disposal. 5. Preparation of submittals that are the responsibility of the contractor in terms of materials handling, health and safety, or other documents, In addition to the above engineering services, it is recommended the Borough retain the services of Potter Architects to assist during construction of the generator building and to review architectural design element shop drawings and submittals for the building and respond to contractor Requests for Information (RFI's) related to their design, Pee Schedule T &M will provide the above described scope of services for an estimated fee not to exceed $565,000. This estimated fee is presented by phase below. Our services shall be billed on an hourly basis in accordance with the Schedule of Hourly Billing Rates and Schedule of Miscellaneous Charges in our current municipal contract.
