AWARDING BID FOR ENVIRONhIENTAL REiVIEDIATION OF COVE AT
CARTERET WATERFONT PART{ AND CONSTRUCTION OF THE
WATERFRONT 1VIARINA -PHASE I
WHEREAS, the Borough has publicly advertised for the receipt of bids for the environmental
remediation of the Cove at Carteret Waterfront Park and construction of the Waterfront Marina -
Phase I ( "Project"); and „
WHEREAS, the Borough has received six (6) bid proposals for said work; and
WHEREAS, Cashman Dredging & Marine Contracting Co., LLC, 549 South Street, Quincy,
IVIA 02169 ( "Caslunan ") has submitted the lowest responsible bid for said contract work in the
amount of $19,769,100.00 for the Based Bid with Bid Alternative 'A', and also submitted the
lowest responsible bid for the Base Bid in the amount of $21,943,650.00, all as evidenced by the
bid responses on file with the Borough's Purchasing Deparhnent and with the Borough's
consulting Engineer for the Project, CME Associates ( "CME "); and
WHEREAS, the CME has reviewed the above bid proposals and has recommended the award of
a contract to Cashman, in a total amount not to exceed $19,769,100.00 for the Based Bid with Bid
Alternative 'A'; and
WHEREAS, in the alternative, should the final necessary approvals, particularly those needed
from the New Jersey Department of Environmental Protection, not be able to be procured for
Cashman and the Borough to utilize the Alternate Disposal Site Location for the processed dredge
spoils being removed from the Cove pursuant to the Project, which Site Location represents the
savings of $2,174,550.00 to be realized under Bid Alternative 'A', CNfE has recommended the
award of a contract to Cadman, in a total amount not to exceed $21,943,650.00 for the Based
Bid, as Cashman was also the lowest responsible bidder for the Base Bid; and
WHEREAS, Cashman has agreed to continue to honor its bid price in the amount of
$21,943,650.00 for the Based Bid should Cashman not be able to secure all of the approvals
required for Bid Alternative 'A' despite its most diligent effort; and
WHEREAS, the Chief Financial Officer has certified that funds are or will be available for said
purpose, including either the Based Bid with Bid Alternative `A' or the Base Bid.
NOW THEREFORE BE IT RESOLVED by the Mayor and Council of the Borough of
Carteret as follows:
1. That the appropriate Borough Officials are hereby authorized to enter
into a contract with Caslunan Dredging & Marine Contracting Co.,
LLC, 549 South Street, Quincy, MA 02169 for the above referenced
project for the sum of $19,769,100.00 for Based Bid with Bid
Alternative `A,' in accordance in all respects with the request for
proposals and bid on same.
2. That, in the alternative, the appropriate Borough Officials are hereby
authorized to enter into a contract with Cashman Dredging & Marine
Contracting Co, LLC, 549 South Street, Quincy, IVIA 02169 for the
above referenced project for the sum of $21,943,650.00 for the

Based Bid should all of the approvals required for Bid Alternative
`A`not be able to be procured despite the diligent effort by Cashman
to pursue and secure the same.
3. That a copy of this Resolution shall be forwarded to the Borough's
Purchasing Department and CME Associates for distribution to
Cashman Dredging is Marine Contracting Co., LLC.

Enclosed herewith please find a summary of bids received on April 8, 2016, for the above
referenced project. A total of six (6) bids were submitted, ranging from an apparent low
base bid of $21,943,650.00 by Cashman Dredging & Marine Contracting Company, to a
high base bid of $29,341,345.69 by Carver Construction. Please find enclosed a complete
Summary of Bids for the Council's review.

It should be noted that there were several irregularities present in some of the bids
submitted; however, there were no irregularities present in that of the low bidder, Cashman
Dredging & Marine Contracting Co., therefore, the outcome of the bid is unaffected.
Cashman Dredging was the only bidder to submit an alternate disposal site for all dredge
material, at the former Agrico, LLC site, owned by DuPont, on Block 304, immediately to the
north of the Waterfront Park site. The bidder proposes that the amended dredge materials
be utilized for beneficial reuse as fill material to bring the site to grade above the FEMA flood
elevation. Awarding the bid alternate would result in a net decrease of $2,174,550.00, for an
overall contract value of $19,769,100.00. � --° //

Our office has met with the low bidder to discuss the scope and schedule of the project.
Cashman is comfortable with the bid prices submitted and performing the work within the
duration of the contract.
The project is being funded, in part, by a 75% matching grant from the NJDEP Hazardous
Discharge Site Remediation Fund (HDSRF) for all items relating to the dredging and
remediation of the site. This funding includes a commensurate cost grant to stabilize the
shoreline with an articulated concrete revetment in lieu of full payment for a steel bulkhead.
NJDEP has Indicated that funding for project costs in the amount of $20,203,572.07 (which
includes remedial action soft costs) shall be recommended for formal approval in early May.
Through FY2017, the Borough shall receive a total of $14,896,421 in.funding for both
Remedial Action design and construction costs related to this project.
Based on this information, we recommend the following actions:
Award of the contract to the low bidder, Cashman Dredging and Marine Contracting Co.,
549 South Street, Quincy, MA 02169 within 60 calendar days, on a unit price basis in the
total amount of $19,769,100.00 for base bid items 1 through 15, inclusive, and Alternate
A items DEL -1 through DEL -3 and ADD -1 through ADD -2, inclusive, as available funding
permits. The award should be subject to review and approval by the Borough Attorney,
including concurrence to waive any minor irregularities, the review of the bid bond and
surety from the low bidder, review and approval by the NJDEP, and submission of the
required bonds and insurance certificates for the project.
2. Bids and bid securities of the second and third low bidder, Bird Construction and Agate
Construction Co., Inc., be retained and ,held open, pending execution of the contract
agreement by Cashman Dredging and Marine Contracting Co.
3. Return of bid bonds to remaining low bidders.
4. It is our understanding that in the event that the site for Alternate A cannot be pursued,
the base bid shall be applied through a change order.
By copy of this letter, we are requesting the Borough Attorney prepare the necessary
Resolution of Award. Upon execution, please have four (4) signed and sealed copies of the
resolution forwarded to my office for further execution.
