BOARD OF PUBLIC WORKS AND SAFETY OF THE
CITY OF RICHMOND, INDIANA, OCTOBER 27, 1983
1 The Board of Public Works and Safety of the City of Richmond, Indiana, met in
2 regular session October 27, 1983 at the hour of 9 :00 a.m. in the Municipal
3 Building in said City. Mr. Meredith presided with Mr. Cordell present. Mr.
4 Webb was on vacation. The following business was had, to-wit :

8 Mr. , Cordell moved to approve the minutes of October 20, 1983 as prepared,
9 seconded by Mr. Meredith and on unanimous voice vote the motion was carried.

11 REQUEST OF MAYOR FOR 1/2 FARE ON CORTA FOR HANDICAPPED AND ELDERLY - Mayor Dickman

13 Mayor Cliff Dickman stated in conjunction with handicapped parking improvements
14 going on in the downtown area, he is requesting the Board of Works lower the
15 bus fares for the elderly and handicapped by reducing one-half the price for
16 these citizens. Senior citizens are those sixty-two (62) or older. The require-
17 ments for handicapped are the same as used by the license bureau and set up by the
18 State Legislature. The City Clerk will be going to the Salvation Army, SWAC,
19 Interfaith, Sycamore Square and Cambridge Square to set up for people to receive
20 the passes. Passes will be available at those areas, the Clerk's office and the
21 downtown parking garage. The effective date for the passes is November 1 . Acting
22 Transportation Director Bill Davis stated 10% to 15% of our ridership falls into
23 these catagories. The busses have been doing much better on income, but will
24 probably still run short of income.

26 Mr. Cordell moved that as of November 1, 1983, senior citizens over 62 years of
27 age or anyone with a handicap as outlined in the requirements for passes be
28, issued free of charge a pass for 1/2 price to board the busses, seconded by Mr.
29 Meredith and on unanimous voice vote the motion was carried.

31 REQUEST TO BLOCK ALLEY BEHIND PALLADIUM--ITEM BETWEEN 11TH & 12TH FOR CONSTRUC-
32 TION - George Reller

34 Attorney George Reller and Business Manager Paul Higgs, representing the Pal-
35 ladium Publishing Corporation, appeared to request the closing of the alley to
36 the south of the Palladium between llth & 12th Streets for temporary construction.
37 The Palladium is proposing to .expand its current facility by building both above
38 and below grade south and west of the existing facility. The new building will
39 go up to the north line of the alley. The work is scheduled to start the latter
40 part of November. It will be necessary as a part of that work to encroach on the
41 alley itself probably four to ten feet just to work on the building even though
42 there will be no intrusion on the alley itself as far as building is concerned.
43 The building will be entirely north of the north line of the alley. The alley is
44 requested to be closed from llth Street to Harrington Hoch's parking lot on the
45 north side of the alley. At no time would access from 12th Street be cut off.

47 Traffic Capt. Dan Wogoman noted the Palladium Item closed their south parking
48 lot off Main Street by chaining it off and adding a parking space there. Mr.
49 Higgs stated they will want to take the chain down and use it again. He projected
50 the closing should be for one (1) year. In response to a question concerning
51 placement of the building, Mr. Higgs stated the building will be set back from
52 11th Street approximately the same as the existing building but may extend four (4)
53 feet west of the building. Mr. Higgs stated their engineer has contacted the
54 utilities and their location will be verified before any digging is done.

56 Mr. Cordell moved that the request to block the alley behind the Palladium Item
III57 building between 11th & 12th to Harrington Hoch's parking lot for construction.
58 This would start the latter part of November, 1983 and run for approximately
59 one (1) year, seconded by Mr. Meredith. Mr. Anderson noted if the alley is going
60 to be blocked for one (1) year there is a question of liability as the alley
61 belongs to the City of Richmond. He recommended indemnification of the City as
62 a result of anyone getting into this alley. Mr. Reller stated, if the alley is
63 blocked, the Palladium should and would assume liability in the event someone
64 comes onto the property and as a result of construction work is injured. Certain-
65 ly the City should not be liable for any actions that might arise as a result of
66 the construction. The Palladium would indemnify and hold the city harmless.

1 Mr. Anderson suggested the motion should be modified to include that the
2 Palladium Publishing Corporation will provide the City of Richmond, because
3 of the long period of the blocking, with an indemnification agreement during
4 the period of construction and the continuation of the blocking of the alley.

6 Mr. Cordell further moved to modify his motion that the Palladium Item pro-
7 vide an indemnification agreement to the City of Richmond during the period
8 it is blocked, seconded by Mr. Meredith and on unanimous voice vote the motion
9 was carried.

11 Once completed it is anticipated there will be an additional twenty-three (23)
12 full time employees along with those during construction. The cost for the
13 building itself is two to three million.

15 NUISANCE HEARING FOR 1434 RIDGE

17 Mr. Meredith turned the meeting over to City Attorney Ed Anderson to conduct
18 the hearings.

20 Mr. Anderson stated this hearing is City of Richmond vs Robert Thomas, conducted
21 under Ordinance No. 16-1978. The defendant was not present; however the ordi-
22 nance does provide this hearing can be held in the absence of the defendant.
23 A complaint has been filed by the Zoning Administrator, Dennis Bronston, against
24 Robert Thomas for an inoperable vehicle located at 1434 Ridge Street. Mr. Bronston
25 stated he filed a complaint three weeks ago after receiving complaints from
26 neighbors. He presented a picture taken showing the nuisance is still there. Mr.
27 Bronston has been in contact with Mr. Thomas who says he has contacted a local
28 contractor to remove the vehicle. He assured Mr. Bronston it will be removed
29 today. The vehicle does not have tires or an engine and the windows are broken
30 out. Mr. Thomas was notified of this hearing and did receive a certified letter
31 as shown by return receipt. Mr. Bronston stated the nuisance has existed for a
32 couple of years but a complaint was just recently received. He recommended the
33 Board issue an order that the vehicle be removed so, if not done, he will not
34 have to come back before the Board.

36 Mr. Meredith moved that there is a nuisance found at 1434 Ridge Street and
37 that the owner be given a period of not more than one (1) week to have the
38 vehicle removed, seconded by Mr. Cordell and on unanimous voice vote the
39 motion was carried.

41 UNSAFE BUILDING AT 11`22 NORTH "I"

43 Mr. Anderson stated this hearing is held pursuant. to Ordinance No. 100-1979 which
44 adopted the unsafe building law and the Building. Commissioner has issued hisorder
45 pursuant to the ordinance showing an unsafe building at 1122 North "I". This
46 case is City of Richmond vs LaLaura and Marie Patterson. The defendants were
47 not present; however, the ordinance provides the hearing can be held in their
48 absence. The defendants did receive a copy of the order by a return receipt
49 on registered mail. Building Commissioner Charles Roberts presented a picture
50 which he noted tells the story. One cannot go inside because the floors are so
51 bad you could fall into the crawl space or the basement. This is the only
52 building onthe property and has been in disrepair for quite some time. He re-
53 ceived a letter from Mrs. Patterson stating she would not be able to attend this
54 hearing and requesting the cost of demolishing the building. He did not send
55 her an estimate as he talked with those who had already given her an estimate to
56 demolish the building for $1000. He recommended the building be demolished as
57 his order says. Mr. Anderson noted the order is brought under section 2(b) (4) .
58 He noted it is up to the Board to modify, affirm or disallow Mr. Robert 's
59 order. The order says it is to be demolished by November 2; however, the
60 Board may want to modify that portion of the order.

62 Mr. Meredith moved the Board does find an unsafe building at 1122 North "I"
63 Street and that the owners be given a two (2) week period to provide a contract
64 with someone to demolish that building within a short period of time; if no
65 contract is forthcoming within that period, the Building Commissioner proceed
66 under the ordinance and cause the building to be removed, seconded by Mr , Cordell
67 and on unanimous voice vote the motion was carried.

3 The next hearing is City of Richmond vs Wilbur Twine for property at 1119
4 North "I" Street. Mr. Anderson stated Mr. Roberts has information to report
5 to the Board that may cause them to dismiss this hearing. Mr. Roberts stated
6 the building was to be secured and the garage torn down; however, Mr. Twine .
7 came in- October 4 and got a permit to repair the garage. He has purchased
8 the materials for repair and will start as soon as he can. Under the permit,
111 9 work has to be substantially started within ninety (90) days and completed
10 within a year.

12 The order was issued on September 28, 1983 by the Building Commissioner
13 stating Mr. Twine was in violation of the unsafe building ordinance Section
14 2(b) (4) . Mr. Twine received a copy of this order by certified mail on Sep-
15 tember 29.

17 It was- recommended the order be stayed for ninety. (90) days instead of a
18 dismissal to prevent going through this same procedure if nothing is ac--
19 complished.

21 Mr. Meredith moved that there is an unsafe building and an unsecured building
22 to be found at 1119 North "I" Street and the order of the Building Commission-
23 er be stayed for a ninety (90) day period, seconded by Mr. Cordell and on
24 unanimous voice vote the motion was carried.
