Public Works and Safety of the City of Richmond Indiana, : met 2 in regular session June 23, 1983 at the hour of 9:00 a.m. in the Municipal 3 Building in said City. Mr. Webb presided with Mr. Cordell present. Mr. 4 Meredith was on vacation. The following business was had, to-wit: 5 6 APPROVAL OF.MINUTES OF JUNE 16, 1983 7 8 Mr. Cordell moved the minutes of June 16, 1983 be approved and placed on file, 9 seconded by Mr. Webb and on unanimous voice vote the motion was carried. 10 11 SET BID DATE FOR POLICE VEHICLES - Chief Chris 12 13 Police Chief Charles Chris requested the Board set a date to receive bids for 14 the purchase of new police vehicles. He requested issuing the bid for thir- 15 teen (13) vehicles according to the specifications, which he presented, for 16 police package sedans. 17 18 Mr. Webb set July 14, 1983 at 9:00 a.m. to receive bids for police cars. 19 20 GARAGE SALE SIGNS 21 22 Mr. Cordell noted garage sale signs are remaining up to three (3) weeks after 23 the sale has been held. There has been a drive to keep the city clean and the 24 signs detract from the beauty of the city. 25 26 RECESS 27 28 Mr. Webb recessed the meeting until 10:00 a.m. 29 30 UNSAFE BUILDING HEARING FOR 1516 SOUTH 4th 31 32 Mr. Webb turned the meeting over to City Attorney Ed Anderson to conduct the 33 hearing. 34 35 Mr. Anderson noted this hearing is held pursuant to Ordinance 100-1979 which 36 adopted the unsafe building law. The Building Commissioner issued the order 37 to Section 4 of the Ordinance. The order has been served in accordance with 38 Section 8 of the Ordinance. Certified mail went out and was returned marked 39 as unclaimed; however, the Ordinance provides that the hearing can be held in 40 the absence of the Defendants, Donald F. Ellison and Charmane Ellison. The 41 record shows the defendants do not respond or are they present. 42 43 The Clerk read the following order: 44 45 Order Issued to: Donald F. Ellison and Charmane Ellison '46 1516 South 4th St. 47 48 RE: Lot 723, Beallview 49 1516 South 4th St. " 50 Richmond, IN- 51 - 52 The building or structure, or part thereof, located on the real estate 53 described above has, as a result of inspection and investigation by the 54 Building Commissioner of the City of Richmond, been found to be in an 55 - impaired structural condition or state which renders it unsafe or dan- 56 gerous to persons and property. Said findings are according to the 57 specifications of an unsafe building as set forth in Section 2(b) (4) . 58 59 Therefore, it is hereby ordered that the following action be accom- 60 plished in regard to this property: 61 62 Remove unsafe building, According to Section 3, Paragraph 6, 63 City of Richmond Ordinance No. 100-1979. 64 65 The above stated action shall be accomplished no later than June 22, 1983. 66 67 A hearing regarding this order will be held in the Board of Works Room 68 at the Municipal Building, 50 North 5th Street Richmond, Indiana, at 69 10:00 a.m. on June 23, 1983. You may appear at the above said hearing 70 to show cause why this order. should not be complied with; you may be Board of Works Minutes Cont'd. June 23, 1983. Page 2 1 represented by an attorney, present evidence, call witnesses and make 2 arguments_ at° the hearing. If you fail to appear, the hearing will be 33 held in your absence. If the order is affirmed, the Building commissioner 4 will cause said action to be taken pursuant to this order. The costs 5 thereof will be assessed against you on the real estate tax duplicate. 6 Further, failure to comply with this order will subject you to litigation. 7 8 You have an obligation according to Section 12 of Ordinance No. 100-19.79 9 to supply full information regarding this order to any person who may 10 take or agree to take a substantial property interest in the unsafe 11 premises, prior to such transfer or agreement to transfer; also to 12 supply to the Building Commissioner, within five (5) calendar days of 13 the transfer or agreement to transfer, (a) the full name, address and 14 telephone number of the person acquiring substantial property interest, 15 and (b) a true and accurate copy of the legal instrument under which 16 the transfer or agreement to transfer is accomplished. 17 18 Mr. Roberts has determined. Ellisons. are the owners. He has found the property 19 unsafe due to no electricity in the house and hasn't been for a couple months.. 20 There is no water and where the toilet was you could look through the roof to 21 the-sky. When he knocked on the front door, that section of the building almost 22, fell out on him. The roof is completely shot and the heating system is inade- 23 quate. The house is in a deplorable state and has been for many years. Mr. 24 Roberts presented pictures taken of the property. The owner is living in the 25 property. The recommendation is to completely clear the lot. In his opinion 26 it cannot economically be repaired. 27 28 Mr. Anderson recited Section 2(b) (4) . Mr. Anderson noted it is now up to the 29 Board to determine if it is an unsafe building and whether or not the order 30 issued by the Building Commissioner should be complied with... 31 32 After discussion, Mr.. Anderson suggested the motion only has to be "having heard 33 the evidence, the Board now finds .un unsafe building exists and affirms the order 34 of the Building Commissioner for the removal of said building within ten (10) 35 days from the date hereof". 36 37 Mr. Cordell so moved, seconded by Mr. Webb and on unanimous voice vote the motion 38 was carried. 39 40 APPEARANCE BY MS. VIVIAN PERKINS REGARDING DOGS - 41 42 Ms. Vivian Perkins, 818 North 14th Street, stated she has had dogs for eleven (11) 43 years. She. stated she has a kennel license and the dogs have had shots. They are 44 small dogs. One dog got out at 10:00 on the 13th and bit a little boy. The dog 45 was not on a leash`. She stated the dog catcher and a police officer came and 46 gave her fifteen (15) days to get rid of five (5) of her dogs or go to jail. She 47 said she will go to jail and they will then go in and kill her dogs and condemn 48 her. home. The time will be up tomorrow. 49 50 City Attorney Ed Anderson noted this is not the Board to be hearing this as they 51 have no jurisdiction. No complaint has been filed with his office against Ms. 52 Perkins, as should have been done with an ordinance violation. Once a complaint ' 53 has been received, a warning letter goes to the party and then the matter goes to 54 court. The proper place for her to go is to the dog warden to see if a complaint 55 has been filed. There is no violation until someone makes a complaint.
