CITY OF RICHMOND, INDIANA, JUNE 16, 1983
1 The Board of Public Works and Safety of the City of Richmond, Indiana, met
2 in regular session June 16, 1983 at the hour of 9:00 a.m. in the Municipal
3 Building in said City. Mr. Webb presided with Mr. Cordell present. Mr. Meredith
4 was out of town.. The following business was had, to-wit:

6 APPROVAL OF MINUTES OF JUNE 9, 1983

8 Mr. Cordell moved the minutes of June 9, 1983 be approved and placed on file,
9 seconded by Mr. Webb and on unanimous voice vote the motion was carried..

11 REFERENCE: CLOSING OF 500 S. W. 1ST STREET - John B. Martin
12
13 John B. Martin, Rt. 1, Fountain City, Director of Buildings and Grounds for the
14 Richmond Senior High School, appeared to request a temporary closing of the 500
15 block of S. W. 1st betweeri .'.'E'' .and ''E"y. The closing-would not exceed five (5)
16 weeks and for the purpose of delivery and erecting structural steel. Access to
17 the area would be maintained for through local traffic. The closing would prob-
18 ably be from 7 :00 a.m. to 4:00 p.m. and barricades would be erected. They are
19 -to begin work on the 20th of June. Lt. Ron Williams has checked the area and
20 stated it is for the convenience and safety of the workers and the citizens.

22 Mr. Cordell moved that we close the 500 block of S. W. 1st Street, starting
23 Monday, June, 20., .1983. between the hours: of .7 :00. a.m. to 4:00 p.m. for approxi-
24 mately five (5) weeks Monday through Friday for the construction of the Tiernan
25 Physical Education Building, seconded by Mr. Webb and on unanimous voice vote
26 the motion was carried.

28 HIRING OF PROBATIONARY OFFICER - Chief Chris.

30 Police Chief Charles Chris read the following letter to the Board:

32 The following applicant for the position of Probationary
33 Police Officer with the Richmond Police Department is re-
34 commended for hiring: .

36 Charles R. Fitzgerald, Age: 35
37 - 35 N. W. 17th Street
38 Richmond, Indiana

40 This applicant has..successfully completed;written examina-
41 tions, background investigation, physical qualifications
42 and has been accepted by the Police Pension Board.

44 This applicant has been approved by the Police .Merit Commission.
45
46 It is requested that the above named individual enter police
47 service with the Richmond Police Department effective June 20,
48 1983. .

50 Mr. Cordell moved that Charles R. Fitzgerald of 35 .N. W. 17th St. , be accepted
51 to the position of probationary Police Officer with the Richmond Police Depart-
52 ment effective June 20, 1983, seconded by Mr. Webb and on unanimous voice vote
53 the motion was carried.

55 SET DATE FOR SALE OF OBSOLETE STREET DEPARTMENT EQUIPMENT - Cordell

57 Edward Cordell of the Street Department told the Board .that the Street Department
58 has several cars, motorcycles and well used eq_,u-ipment in the back field they would
59 like to dispose of at public auction. He set July 19, 1983 at 5:30 p.m. at the
60 Department of Transportation, 700 Richmond Avenue. The auction will be advertised.
61 They will have traffic signal heads and. two of .the cars are operable. Mr. Cordell
62 suggested the items will be available for inspection- Monday through Friday from
63 8:30 a.m. to 3:30 p.m. or-by appointment. -

4 Mr. Webb reconvened the meeting at 9:30 a.m.

6 Complaintant Dennis Bronston stated the inoperable vehicle is still there
7 but the certified letter sent to the owner of the property was returned.

9 Building Commissioner Roberts stated his letter regarding an Unsafe Building
10 Hearing at the same address was served.

12 City Attorney Anderson has determined satisfaction with the "Unclaimed" marking
13 on the certified letter and feels the hearing can be held in Ellison's absence.

15 Acting President Webb turned the meeting over to City Attorney Ed Anderson to
16 conduct the hearing.

18 City Attorney Ed Anderson stated this is a matter of the City of Richmond vs.
19 Donald Ellison and the first requirement is whether satisfactory notice has
20 gone to the party. Mr. Bronston replied that proper notice had been sent by
21 mail, Mr. Ellison owns the property, he has observed the nuisance at that ad-
22 dress and the envelope was returned marked "Unclaimed".

24 Mr. Anderson stated the Ordinance provides that in the failure of the party to
25 appear at the hearing, the hearing can be held if it is felt satisfactory service
26 was attempted. Mr. Ellison was •not present.

28 Mr. Bronston believes the nuisance truck to be in an inoperable condition which
29 has been there considerably over a month. He presented pictures to the Board,
30 and offered his opinion that it a hardship and inconvenience to the neighbors.
31 The truck is not plated and can be plainly seen from the alley. Mr. Anderson
32 replied to a question that even if the vehicle were not Mr. Ellison's, he allows
33 it to be maintained on his property. The Board must determine three (3) things:
34 (1) if a nuisance is maintained there (2) if a nuisance is present, should it be
35 removed and (3) why it should be removed. 11/

37 Building Commissioner Roberts, speaking as a witness, testified he has observed
38 this nuisance for some time, is familiar with the land and Ellison is the owner
39 of the land.

41 Mr. Anderson suggested his order might read as follows:

43 Comes now the Board of Public Works and Safety of the City of Richmond,
44 Indiana and having examined the evidence and being otherwise duly advised
45 in the premises now finds that:

47 1. A nuisance does in fact exist on the premises known as 1516 South
48 Street; and
49
50 2. Defendant, Donald Ellison, does own said premises and the nuisance
51 being now maintained on said premises; and

53 3. The maintaining of such nuisance is contrary to Section 94.04 of
54 the Municipal Code of the City of Richmond, Indiana.

56 NOW THEREFORE BE IT ORDERED THAT:

58 1. Defendant, Donald Ellison, owner of the real and personal property
59 which has created a nuisance remove and abate said nuisance from the
60 aforesaid premises by June 27, 1983; and

62 BE IT FURTHER ORDERED THAT:

64 1. If defendant fails to comply with this order to abate said nuisance
65 as set out above the Board of Public Works and Safety of the City of
66 Richmond, Indinana will cause said nuisance to be removed and the cost
67 thereof assessed against said defendant and said costs to be placed on
68 the real estate tax duplicate for said premises.

1 Mr. Cordell moved the Board find the junk vehicle at 1516 South 4th
2 Street is a nuisance. The owner of the property must remove this
3 nuisance by June 27, 1983, seconded by Mr. Webb and on unanimous voice
4 vote the motion was carried.

6 Mr. Webb stated the City Attorney will prepare the order.

10 There being no further business on motion duly made, seconded and
11 passed the meeting was adjourned.
